The prosecutor's office of the Central District of St. Petersburg returned the second case of extremism, excited against the former activist of the now loose ethnopolitical association "Russian" Dina Garina, in the TFR for the subsequence and elimination of violations. This was reported to the "Franes" by the lawyer of "Agora" Vitaly Cherkasov, representing the interests of the nationalist. The lawyer referred to a notification signed by the first deputy prosecutor of the district Svetlana Petrova.
Garina's case was already entered in the Dzerzhinsky district court of St. Petersburg, but on February 1, the judge (presumably Natalya Soboleva) returned the materials to the prosecutor of the Central District Peter Zaburko. The relevant resolution indicated that the investigator committed a number of procedural violations, in particular, violated the right of the accused to familiarize themselves with the case file. It was also noted that "the charges of the charge is extensive and does not establish the actions related to the subjective side of the corpus delicti."
The prosecutor's office transferred materials to the investigation department. A few months later, the TFR repeatedly sent the case to the prosecutor, but now the supervisory authority itself refused to approve the indictment. As Cherkasov suggested, the prosecutor’s office could take into account the arguments of the defense that the operatives of the CPE did not form a social group.
Garina became known about the second case on April 20, 2016 . Part 1 of Article 282 of the Criminal Code was imputed by the nationalist (excitement of hatred or enmity in relation to the social group "CPE employees"); She faces up to four years in the colony. The accused is under the subscription about the wonness.
The reason for the initiation of the case was Garina’s speech at a agreed rally against political repression, which took place on the Marse Field on March 15, 2015. The action raised about 200 people. Participants demanded the exclusion from the Criminal Code of Articles 280 (public calls for extremism) and 282, the dissolution of the CPE and the abolition of political investigation.
Garina in her speech stated that the operatives of the CPE - "of course, are still those assholes", "loafers, darmoists, moral freaks." “In general, there are no Russians there,” the activist also remarked. “There are mainly half -breeds, mixed. That is, they hate Russians initially, genetically ... Drivers are going on to the center.
The video with Garina’s performance was placed on the Internet on the evening on the day of the rally, and the next day the CPE drew up an act of inspection of the video, after which the Investigative Committee began a preliminary investigation. Nevertheless, the case was opened only from the sixth time, on March 29, 2016 - after more than a year after the action.
During the time, while the checks continued, the first case was initiated against Garina - in part 2 of Article 280 (public calls for extremism via the Internet) and the same part 1 of Article 282 of the Criminal Code. The reason was the xenophobic publication of the nationalist in VKontakte. In early November 2015, Garina was sent to a pre-trial detention center. The arrested fully pleaded guilty and chose a special procedure for considering the case - without interrogation of witnesses and analysis of evidence.
The court in the first case Garina was held at one meeting - March 3, 2016. Judge of the Kirovsky District Court of St. Petersburg Olga Malkova sentenced the activist to one and a half years conditionally . Garin was released from custody in the courtroom.
