On September 6, the Moscow City Court recognized the extension of the arrested by the defendants in the “Seventh Studio” - Nina Maslyaeva, Yuri Itina and Alexei Malobrodsky. The appellate court left the preventive measure unchanged to each of them. The former general producer of the Seventh Studio Alexei Malobrodsky and ex-bohglatter Nina Maslyaeva will remain in jail until October 19. To the former director of the Seventh Studio Yuri Itin, the court only softened the conditions of house arrest - he was allowed to walk. All three, together with director Kirill Serebrennikov, are accused of fraud on an especially large scale - of the theft of budget funds allocated for the production of performances as part of the Platform project. Everyone except Maslyaeva denies their guilt.

On the consideration of the appeal on the extension of the arrest of the defendants in the case of the Seventh Studio, Alexei Malobrodsky, Yuri Itina and Nina Maslyaeva - several dozen people gathered in the Moscow City Court. There were fewer people than two days earlier, when the director Kirill Serebrennikov was appealed here, but the court still had to allocate an additional premises with broadcasting.

At the meeting, Nina Maslyaeva was brought from the pre-trial detention center of the Seventh Studio, but none of her relatives came to court. But the hall was attended by the sisters and spouse of the former general producer of the Seventh Studio Alexei Malobrodsky - he himself participated in the process from the pre -trial detention center from the video. The former director of the Seventh Studio Yuri Itin - he is now under house arrest - was also in the hall.

- I did not want to attend this meeting. I wanted to say this last time, but the broadcast broke off too quickly, ”Maslyaeva told the judge before the meeting.

The judge replied that the court received a receipt of Maslyaeva from the pre -trial detention center and now nothing can be done: "We will not take it away."

Maslyaeva the only one spoke out against video and photography. The judge allowed the television channels and agencies to remove part of the meeting, forbidding to shoot the process participants themselves.

The lawyer of Lesserobrodsky Ksenia Karpinskaya asked the court to introduce the case of a guarantee for her client of a number of famous cultural figures to the materials. In total, the lawyer listed 38 surnames, among them - Chulpan Khamatova, Lev Rubinstein, Vladimir Mirzoev, Vasily Sigarev, Andrey Molchy and Elena Koreneva.

When the judge agreed to satisfy the petition of the defense of Malobrodsky, Nina Maslyaeva asked the judge: “I wanted to ask you. Today we are only considering the case of Malobrodsky? Or appeal? " Borisova assured her that today a complaint would be examined about the extension of the arrest of all three defendants in the case.

The new lawyer Maslyaeva Efimenko (he did not name his behalf; since the beginning of the case, Nina Maslyaeva replaced three lawyers) told the judge that his client - they met only in early September - did not support the appeal. “I said that I did not want to participate in the complaint, I did not want to go out on a video conference. All that will go here today will concern Lose Brodsky. There is no strength to sit and endure it for five hours, ”Maslyaeva herself explained.

After the judge read out an appeal about the extension of the arrest of Lesserobrodsky and Maslyaeva and Home arrest, Itin (former lawyer Maslyaeva Yuri Zaitsev managed to mitigate the preventive measure to mitigate his client), the lawyer of the Less Bullets Yulia Lakhova appealed to the court.

She called the decision of the Basmanny court to extend her client’s arrest illegal and unreasonable. According to Lakhova, Malobrodsky was not charged with reasonable accusations. Lakhova recalled that the prosecution was sure that the play “Summer Nightnaya Night” was not staged “Seventh Studio”, and the money for its creation was stolen. But the opposite, she recalled, says articles of critics who came out back in November 2012, and a video shot at the pre -premiere show of the performance.

According to lawyer Lakhova, on July 17, 2017-on the first day of the meeting to choose a preventive measure to her client-the investigation stated that Malobrodsky had committed unlawful actions from 2011 to 2014. But, Lakhova told, her client since 2012 was not an employee of the Seventh Studio. “The court decision was made in the absence of a decision on initiating a criminal case,” Karpinskaya added to her colleague and clarified that in the absence of an initiated case it was impossible to arrest her client (“Medusa” analyzed in detail why this is so).

According to Julia Lakhova, in addition to the unfounded statements of the investigation that Malobrodsky could hide from Russia, has the intention to threaten witnesses and destroy the evidence, there were no grounds for his arrest. At the same time, the lawyer recalled that the criminal case of embezzlement was opened in May and her client had a whole month to hide, but he did not use this opportunity.

Alexey Malobrodsky, in the video, said that he wanted to testify and was ready to answer the questions of investigators, but they do not turn to him for this. “I demand that the investigation and the prosecutor’s office stop bluffing and submit the documents that this Julie refers to,” Malobrodsky said.

The lawyer Yuri Lysenko defending Itina asked his client to be allowed to communicate with relatives. By a court decision, Itin cannot communicate with them - since they go through witnesses in the case of the Seventh Studio. As his lawyer said, his 79-year-old father specially arrived at Itina from Crimea. But he was also called for interrogation and moved to the status of a witness. Lysenko asked the court to allow his client daily walks and a visit to the clinic - ITINA HHITERNIA of the second stage. "Former governors and ministers allow walks, one of the participants in this case allow walks, how does Itin differ from them?" The lawyer asked the court.

Nina Maslyaeva lawyer repeated that his client did not support his appeal.

- Do you consider the decision of the Basmanny court legitimate? The judge asked Maslyaeva.

-And what, can you change something? - the former accountant answered her.

The prosecutor and the investigator said that they consider the decision of the court of first instance legal and justified. The judge called a witness to the hall - the composer Alexander Manotskov, who collaborated with Serebrennikov and Malobrodsky. Manotskov called the Malobrodsky a raging master of the theater. “I was ready that during the process there would be circumstances that will formally indicate a violation, but no circumstances were found. This is an additional plus for Alexei’s reputation - even with such a meticulous investigation, no violations were found, ”Comrade Manotkov encouraged.

The lawyer Karpinskaya said that Nina Maslyaeva stipulates herself and other participants in the process, and the investigation exerts pressure on the former accountant. “So that she will change lawyers to refuse complaints. Do you want to sit in a pre -trial detention center? " - turned to Maslyaeva lawyer. Karpinskaya recalled that during the latest interrogation, the former accountant said that the Seventh Studio was created specifically with the aim of theft of budget funds.

“There are no criminals in this case, just Nina Maslyaeva became a weak link. If there were no testimonies, the investigation would have nothing to based her accusation, ”said Karpinskaya.

Lawyer Maslyaeva Efimenko expressed confidence that his client says what he wants, and there is no pressure on her. Maslyaeva herself turned to the judge with a request to protect her from Lose -Bruski's lawyers. “Let them engage in Malobrodsky. I do not want to listen to their conclusions about my actions, ”she said.

Alexei Malobrodsky said that his civil rights are trampled from the very beginning of the process. “An organized group of investigators is mocking the law, practicing lies and intimidation,” said Less Baby. - My wife was a witness in the case, and we are refused dates and telephone conversations. A ban on our property was imposed, a laptop and a tablet were taken from the wife. What is this goal? Get me, like Nina, to testify against myself and others? But this will not happen, ”Malobrodsky said confidently. He added that he would not participate in any investigative actions - in handcuffs, and said that he was ready to cooperate with the investigation, but would not stipulate his colleagues.

After him, the word was taken by Yuri Itin. “After such global questions, I do not want to go down to the requests that we prepared with my lawyer, I understand their incommensurability,” he said and asked the court to allow him to see his father.

Judge Borisova decided to leave a preventive measure unchanged to all three. Only Itin received a small indulgence - he was allowed daily walks from ten in the morning to noon.
