
Members of the Khalkie-Boltai hacker group Konstantin Teplyakov and Alexander Filinov were found guilty of “illegal access to the computer information protected by the law” and sentenced to three years in prison with a sentence in a general regime colony.
The lawyers of the convicts intend to appeal the verdict, as they consider it overly harsh. Even the prosecution required a more humane punishment.
In the judicial debate, the prosecutor asked Filinov to sentenced to two and a half years in prison, and Teplyakov to three years. At the same time, he proposed to send Shaltai-Boltaevites to a colony-settlement.
The process in the Moscow City Court over the participants of the hacker group was held closed, since, according to the investigation, the materials of the criminal case contained secret information. Information about the criminal case is very scarce.
Let me remind you that the first FSB operatives detained the leader of the Shaltai-Boltai, Vladimir Anikuev, known in cyberspace under the nickname Lewis. And this happened on November 9, 2016 at Pulkovo Airport near St. Petersburg. Anikeev immediately pleaded guilty, repented, went to cooperate with the investigation and began to openly talk about everything that he knew about hacks of correspondence by spokesman Dmitry Medvedev Natalia Timakova, director of the Russian MIA Today Dmitry Kiselev, Timur Prokopenko from the internal policy of the presidential administration and public persons.
Anikeev’s case was allocated in a separate production and considered in a special manner, without researching evidence. In early July, the Moscow City Council sentenced Anikeev to two years in prison.
Shortly before the sentences against Filinov and Teplyakov from the Moscow City Court, “information” leaked from the Moscow City Court that Anikayev, questioned at this process as a witness, said in his testimony that, putting up the hacking correspondence of high -ranking officials for sale, he and his accomplices “partially falsified” “goods” in order to “attract additional attention” to Shaltai-Boltu and “artificially overstate the price” for incriminating evidence. Allegedly, this was confirmed by Anikeev’s lawyer Khazret Bijoev.
This “stuffing” immediately seemed to me not a calling confidence.
At least because the Grif “Secret” was imposed on the criminal case, and, disclosing the information that became known to him during the process, the lawyer Bijoev violated the subscription of the non -disclosure of “information constituting a state secret”. Not a single lawyer will go to this.
The verdict against Konstantin Teplyakov and Alexander Filinov strengthened my doubts about the reliability of the “falsification” of correspondence and added new doubts, much more serious.
The fact is that Teplyakov and Filin were sentenced to part 3 of Article 272 of the Criminal Code of the Russian Federation, which provides for up to 5 years in prison for “illegally access to computer information protected by law”, committed by a “group of persons by prior conspiracy”.
But, I repeat, the stamp "Secret" was imposed on a criminal case. If the classification of the process occurred due to the fact that the hackers opened the officials of the officials and gained access to materials that fall under information containing state or commercial secrets, the verdict would be pronounced according to the most severe part of Article 272-fourth, which provides for seven years in prison. The disposition of this part of the “hacker” article of the Criminal Code states that it is applied if the crime has entailed “grave consequences or posed a threat to their occurrence”.
But members of the "Shaltai-Bolta" part 4 of Article 272 of the Criminal Code passed. Therefore, in their disposal, there were neither state nor commercial secrets. How then to explain the classification of the criminal case and the trial?
The experts interviewed by us agreed that the Grif “secretly” could impose on the criminal case due to the fact that during the interrogations of heating and Anyans, Filin, and earlier, could testify that they were recruited by the FSB officers and “worked” under the patronage of their curators from the FSB information security center.
And this version is very similar to the truth. It is no coincidence that the information about the arrest of the participants of the hacker group "Shaltai-Boltai" leaked into the public space after the arrest of the FSB officers-Colonel Sergey Mikhailov and Major Dmitry Dokuchaev, suspected of treason. And this despite the fact that Mikhailov and Dokuchaev were arrested on December 4, 2016, and the same Anikeev - almost a month earlier.
