
The peace judge of the 16th section of the Kaluga region in Obninsk Dmitry Trifonov sentenced human rights activist Tatyana Kotlyar to a fine of 150 thousand rubles for fictitious registration of foreigners, but exempted from paying this amount due to the expiration of the statute of a time in the case. The 66-year-old Kotlyar was announced guilty under Article 322.3 of the Criminal Code (a fictitious registration of a foreigner for registration at the place of stay), which provides up to three years of the colony. Previously, REGNUM reported that the human rights activist registered 187 people in her apartment, of which 185 are citizens of Ukraine, including refugees from the Donetsk and Lugansk regions. The light, however, writes that in the verdict it was about 167 Kotlyar registered in the apartment.
The defendant herself refused to recognize her actions by criminal. “I am judged for a strange crime, from which no one was injured,” she remarked in the last word. “The help of refugees from Ukraine actually promised not me - it was the President of Russia Putin. Yesterday a woman came to me who escaped to Russia after a mine got into their house. What should I say to them? To help you, then they will judge me as a criminal? Refugees do not help - it is really a bad state. "
Earlier it was noted that more than 100 foreigners, thanks to the registration in the Kotlyar apartment and free legal assistance, have received Russian citizenship as part of the state program of the resettlement of compatriots.
The lawyer of the social activist Illarion Vasiliev explained that the refugees from Ukraine does not have the host party and the Kaluga region refuses them to register, without which legalization is impossible. In most cases, refugees refuse to register the owners of housing rented by migrants. In such a situation, there are two options: buying registration in the black market for 20-30 thousand rubles or contacting Kotlyar.
Two years ago, the human rights activist was already convicted in a similar case. Then she was charged with five episodes under Article 322.3, as well as seven episodes under Article 322.2 of the Criminal Code (fictitious registration of a foreigner at the place of residence), the sanction of which is also up to three years of colony. As stated in the case, the human rights activist prescribed hundreds of foreigners who arrived in Russia under the program of resettlement of compatriots in her apartment.
In court in the first case, as now, Kotlyar confirmed that hundreds of people had prescribed in her apartment, but she refused to recognize this with a crime. The law on "rubber apartments", which included in the Criminal Code of Article 322.2 and 322.3, the human rights activist called the Constitution contradictory, since he "introduces the criminal for help for people."
The case was listed twice. On April 13, 2015, the judge returned the materials to the prosecutor's office. On November 9 of the same year, according to the results of the re-trial, Kotlyar was fined for the same 150 thousand rubles, but was exempted from punishment in amnesty to the 70th anniversary of the victory over Germany.
The human rights activist filed a complaint against the ECHR, accusing Russia of violating articles 7 (punishment exclusively on the basis of the law) and 10 (freedom of expression) of the European Convention. On January 10 of this year, the Strasbourg court communicated the complaint.
Kotlyar also conducts political activity. Previously, she was a deputy of the Legislative Assembly of the Kaluga Region and the city assembly of Obninsk. It is included in the Federal Political Council of "solidarity". In 2010, in the elections to the regional Legislative Assembly, he headed the apple list. Was the leader of the regional branch of the RPR-Parnas.
In 2015, Kotlyar was advanced from the region’s Legislative Assembly from the Democratic Coalition, one of the members of which was the RPR-Parnas. According to the results of the in -party primaries, the second place took the second place - by a small margin, the co -founder of Dissernet Andrei Zazakin ahead of her. Immediately after the primaries, Kotlyar, without questioning the voting results, said that she was not satisfied with the second place in the list.
Party co -chair Mikhail Kasyanov traveled to Obninsk to convince a colleague, but as a result, the regional branch of the party approved the list led by Kotlyar and submitted it to the Oblazbirk.
Kasyanov said that Kotlyar violated the basic agreements regarding the conduct of the primaries and its actions "harm the interests of the party." The Federal Political Council of the RPR-Parnas excluded Kotlyar from among the candidates. The list was headed by Zayakin.
