The policeman denied the right of Navalny's campaign coordinator not to incriminate himself

On October 12, Oles Khristosenko, the coordinator of Alexei Navalny's headquarters in Sochi, was handed a summons to give explanations about the October 7 action. When she came to the department, the policeman denied her right not to testify against herself (Article 51 of the Constitution of the Russian Federation), the right to legal assistance (Item 1 of Article 48 of the Constitution of the Russian Federation) and snatched her passport from her hands. This was reported to OVD-Info by an employee of the headquarters herself.

“Major Andreev called from three o'clock in the afternoon. He said that I was obliged to appear to testify, ”says Khristosenko. The coordinator on the phone said to give her a formal subpoena. The major came to the headquarters at about six in the evening and gave her a notice with a call to the department. An hour later, Khristosenko came to police station No. 1 and asked to postpone the testimony until tomorrow, so that a lawyer would be with her, otherwise she would refer to Article 51 of the Constitution.

“The major made a farce. He said that I have no right to use Article 51. Then he asked me for a passport, and frankly began to tear it out, ”says an employee of the headquarters.

When the coordinator referred to paragraph 22 of part 2 of the regulation on the Passport of the Russian Federation, which allows not to give the document into the hands of the police officers, but offered to look at all these documents from her hands, Andreev said that “he wants the passport to lie on the table.”

In addition, the policeman denied Khristosenko's right to a lawyer, since "there is no persecution behind her." Clause 1 of Article 48 of the Constitution - everyone is guaranteed the right to receive qualified legal assistance, to which she referred, says the opposite.

According to the coordinator, the argument lasted about 40 minutes. She has an audio recording of the conversation. “He ended up handing me the agenda for tomorrow. And I signed a sheet with questions for explanations, referring to Article 51, ”said an employee of the headquarters.
