The Basmanny District Court of Moscow, who decided on Tuesday, October 17, the issue of extending the preventive measure for the defendants in the Seventh Studio case, extended house arrest to the director Kirill Serebrennikov, the chief accountant of the Seventh Studio Nina Maslyaeva and the former general director of the Seventh Studio, Yuri Itina, as well as the period Ex-director of the Gogol Center Alexei Malobrodsky until January 19, 2018, as required by the prosecution.
According to Mediazona , the application of the investigation to extend house arrest was considered by Judge Arthur Karpov. The petition said that the fault of the defendants is confirmed by the testimony of other accused, confrontation protocols and other case materials. Only Nina Maslyaeva finds guilty of all four.
There are no grounds for changing the preventive measure, the investigator believes. The crime was committed by an organized group, one of the accused, Ekaterina Voronova, disappeared and is on the wanted list. The petition stated that at large, accused would be able to come into contact with her and each other, agree on versions, and destroy evidence.
In addition, it was argued that Malobrodsky has Israeli citizenship, and Serebrennikov has a residence permit of Latvia, as well as real estate in Germany, acquired during the commission of crimes. In this regard, the investigation asked to extend the preventive measure for all four accused until January 19, 2018.
Alexei Malobrodsky, protesting against the extension of the arrest, said that he knew "All theatrical Moscow and Russia" that he is not going to leave the country, he has many projects here, he lives in Odintsovo. The judge interrupted him and asked him to express his position clearly; Malobrodsky said that he could not affect the results of examinations or investigative actions, and asked him to replace him with a preventive measure, not related to the detention.
Nina Maslyaeva complained to the judge of the attacks of lawyers and former colleagues and asked to protect them.
Serebrennikov asked "to let everyone go." The lawyer said that on walks the director is met by provocateurs
Serebrennikov in his speech asked the judge to "refuse the petition and" let us go all. "
“I learned that I was monitoring, much earlier than from the case file, the waiters said:“ You have a tape recorder under the table there. ”That is, I knew about it. Friends said to me:“ How are you in such a situation, maybe to leave? ”I refused, I have a theater for which I am responsible, the project in the Bolshoi Theater, then the film is low ... I always returned to Russia for the same I think that if a person is not to blame, did nothing - and run? Well, you are running only when you are guilty, ”the director said in his speech.
He added that he feels his innocence even after “these enchanting searches have passed,” and “technically cannot leave,” since the investigation is passport.
“This is some kind of absolute cunning that we can hide. Moreover, I am interested in the truth so that it triumphantly, so that the truth is manifested,” the director added.
Serebrennikov admitted that the bookkeeping of the Seventh Studio was in full chaos, but there was no evidence that there were some embezzlement.
He told the judge that he needed to “finish a large project at the Bolshoi Theater”, where his presence is needed, and he needs five days to tie the film “Summer”, “Romantic Story” about Victor Tsoi, as the director described the picture earlier. “Five days left until the end of the filming. Well, I ask for walks, if you can increase the time, then make their time floating so that I can choose,” he explained.
His lawyer also asked to make the time of walking, explaining that the director’s place of residence is known to the large number of "not the most clean journalists and just provocateurs who provoke conversations, and sometimes simply say nasty things."
Lawyer Kharitonov says that he was deprived of the opportunity to prepare for the meeting, and noted that he knew only one extension of the arrest period for which the investigation provided completely different documents, and not declared in advance, when extending the arrest of the Hermitage Capital Foundation to Sergey Magnitsky.
"Mediazona" interpreted this as a hint of Judge Karpov’s participation in the Magnitsky case. Arthur Karpov refused Magnitsky’s mother in the complaint of the refusal of the RF IC to investigate the circumstances of the murder of her son in the Sailor Silence pre -trial detention center. Karpov, as the website of Open Russia indicates, appears in the list of judges who "refused to justice of the mother of Sergei Magnitsky," compiled by Hermitage Capital.
Despite the objections of all the defenders, the judge quickly introduced a pack of new materials to the case
The meeting began with the fact that the judge took turns asking all the defendants to introduce himself and asked about chronic diseases. Malobrodsky answered this question: "So far, there is no." Nina Maslyaeva, who came to the court in dark glasses that covered half of her face, listed her diseases: diabetes mellitus, coronary heart disease, arthrosis.
The investigator petitioned for the introduction to the case of additional materials - the protocol of the interrogation of Sinelnikov’s witness of May 31 and June 17, 2017, according to which he cashed the money as an individual entrepreneur, and then on the Platform project, he handed money with Itin and Maslyaeva, transferred cash in his office, at the same time, from the words of Malobrodsky, such a scheme was satisfied with Kirill Serebrennikova.
He also proposed to introduce the Sinelnikov -Frequency Protocol with Malobrodsky, during which Sinelnikov confirmed that Malobrodsky independently withdrew the money of the Seventh Studio.
In particular, according to Interfax , two employees of the seventh studio accounting told the investigation that the organization was the Black Cashier. Investigator Alexander Lavrov in the Basmanny Court of Moscow asked the court to attach to the case file the corresponding testimony of "witnesses of Zhirikova and Filimonova."
Lavrov clarified that the witnesses explained to the investigation that the Black Accounting was conducted in the ANO and the Black Cashier was conducted.
Investigator Alexander Lavrov also asked for the testimony of "witness Voikina, who explained that in December 2014, at the direct instructions of the proxy, Serebrennikov (Ekaterina) Voronova, destroyed the financial documentation of the Seventh Studio.
Lawyers insisted that the submission of additional materials is not provided for by law, Malobrodsky believes that the documents can be questioned, Itin wants to get acquainted with them first, and Serebrennikov opposed the introduction, saying that "this is absurd." Maslyaeva left a decision to introduce documents at the discretion of the court.
After a half -hour break, Judge Karpov announced that he decided to satisfy the investigator’s request and introduce all the documents submitted by him.
All lawyers and defendants supported the request to announce a break until tomorrow, because in these 30 minutes the defenders managed to only photograph the materials, but could not familiarize themselves with them. Only Maslyaeva did not support the request: “I want to be taken out today,” she asked.
The judge explained that approximately half of the materials was presented at the election of a preventive measure and there was no grounds for postponing the meeting, and gave only 15 minutes for additional familiarization with them. After that, although all the defendants announced that they did not fully get acquainted with the materials, the judge introduced them to the case.
Serebrennikov opposed the manifestation of Maslyaeva friendship with the investigation "in bright form"
Another application of the investigator examined on this day concerned Maslyaeva. Since Maslyaeva was under house arrest, he asked not to advertise her address during the court session due to excessive attention of the media, writes Mediazon. According to Ksenia Larina, the Echo journalist of Echo , the Echo journalist, lawyers opposed the closed regime of the trial. As a result, the court refused to the investigator.
The lawyer of Malobrodsky Ksenia Karpinskiy said that Maslyaeva repeatedly stipulated her client, so she earned the opportunity to be under house arrest. “I don’t really understand why a 60-year-old Russian woman cannot be in custody, and a 60-year-old Jewish man can,” the defender of the Mediazon quotes.
Kirill Serebrennikov on this occasion said: "Friendship of the investigation with Maslyaeva is known, this is the reason why she continues to negotiate us, and I, of course, against the manifestation of this friendship in such a bright form."
As Ksenia Larina said on her Facebook page, Malobrodsky asked to introduce his complaints, petitions to the case, comments on investigators, a convoy of violation of rights during interrogations, during escorting and conducting investigative actions in handcuffs. He began to list his statements, which he submitted to the investigator and the prosecutor’s office, as well as their appeal in the courts.
Judge Karpov interrupted him, saying that this was not the subject of today's meeting. "You are now standing and evaluate court decisions in various instances, this is not the subject of today's meeting," the judge said. Investigator Lavrov said that Malobrodsky's complaints are not related to today's meeting. Karpov introduced all the papers to the case file.
