Верховный суд не нашел в действиях рай- и горсуда нарушения законности. Иностранные граждане подали заявления в Басманный суд против федерального правительства. Все инстанции также отклонили их иски.
В начале апреля 2007 года производство по делу «Норд-Оста» начал Европейский суд по правам человека.
PS В декабре 2011 года Страсбургский суд признал нарушение российским государством права на жизнь своих граждан и присудил заявителям €1 млн 254 тыс. компенсаций.
