During the assault, 67 hostages were killed, another 58 died in buses and hospitals. One of the reasons - the gas was classified, and the doctors were not ready to provide effective medical care. The official authorities have long denied that the staff of the liquidation headquarters had contact with people who were in the theater. Еще две Звезды достались штабу, а именно: руководителю штаба по освобождению заложников первому замдиректора ФСБ генералу В. Проничеву и начальнику Центра спецназначения ФСБ генералу А. Тихонову. Пятую Золотую Звезду получил химик, пустивший газ в театральный центр. Об этом стало известно из открытого письма бойцов «Альфы», которые рассказали о закрытом указе президента о награждении.

11 июля 2007 года организация «Норд-Ост» направила в Генпрокуратура просьбу о возбуждении уголовного дела против членов оперативного штаба по спасению заложников. В своем заявлении «Норд-Ост» отмечает, что организация медицинской помощи пострадавшим в ходе операции по спасению заложников не была на должном уровне. В частности, для газа, который использовался для нейтрализации террористов и от которого пострадали заложники, по данным «Норд-Оста», не существует антидота. Это не первый иск к руководителям операции. В ноябре 2002 года первая группа истцов подала свое заявление в Тверской районный суд, избрав ответчиком правительство Москвы. Они заявили, что операция по спасению была плохо спланирована и организована. Суд отклонил иски.

28 апреля 2003 года Мосгорсуд рассмотрел кассационную жалобу. Суд заявил, что следствие по делу о событиях 23–26 октября 2002 года продолжается и причинно-следственная связь между специальной операцией и гибелью людей не установлена, как не установлена вина лиц, отвечающих за проведение операции. В результате иски заявителей были отклонены.

Верховный суд не нашел в действиях рай- и горсуда нарушения законности. Иностранные граждане подали заявления в Басманный суд против федерального правительства. Все инстанции также отклонили их иски.

В начале апреля 2007 года производство по делу «Норд-Оста» начал Европейский суд по правам человека.

PS В декабре 2011 года Страсбургский суд признал нарушение российским государством права на жизнь своих граждан и присудил заявителям €1 млн 254 тыс. компенсаций.
