The victim of the shooting of Major Evsyukov demanded to reconsider the court's refusal to compensate for moral damage

Moscow resident Alena Dudal, who suffered from the shooting of Major Denis Evsyukov in 2009, demanded that the refusal of compensation of 1 million rubles from the Ministry of Finance be canceled. The human rights organization “Zone of Law” reported this to Mediazona.

In 2011, the Tver Court rejected Dudal’s claim against the Ministry of Finance for compensation for moral damage: the judge found that the Russian authorities should not be held responsible for Evsyukov’s actions, since he was “off duty” at the time of the crime.

Dudal considers the basis for reviewing the decision on the claim to be the position of the European Court of Human Rights, which in December 2016 found the government guilty of violating the right to life (Article 2 of the European Convention on Human Rights). The ECtHR concluded that the crime was committed by an official.

Lawyer Ilnur Sharapov, who represents Dudal, noted that “the state bears part of the responsibility for his crimes, since it hired Yevsyukov without proper mental health checks and entrusted him with firearms.”

The hearing of Dudal's claim is scheduled for October 25.

At the end of 2016, the ECHR awarded Dudal 12 thousand euros as moral compensation. Two other victims - Ilya Gerasimenko and Luiza Salikhova - were also awarded 12 thousand euros each.

On April 29, 2009, the head of the Tsaritsyno police department, police major Denis Evsyukov, started shooting near the Moscow Ostrov supermarket. Two people were killed and seven were wounded; In total, almost 30 people were victims in the case. In 2010, the Moscow City Court sentenced Evsyukov to life imprisonment in a special regime colony.
