The main witness of the prosecution, entrepreneur Yuri Zudheimer, on this day again did not appear at the process: neither messages nor notifications about the reasons for the failure to appear from him were received. Although earlier the prosecutor’s office assured that he would definitely “come”. Recall that it was the Zudheimer precisely during the so -called investigative experiment of the FSB in one of the restaurants in the center of Moscow that handed the white gift package (supposedly for his birthday), in which the money was.

“Your honor, but what happens to Zudheimer with a witness?” - First of all, after he was brought into the hall, asked Natalya Vasyuchenko and Nikita Belykh himself.

Instead of Zudheimer, the first witness of the accusation for the rostrum was Ruslan Tsukanov, General Director of the Novovytsk Ski Plant (NLK), in 2013 he was also the general director of the LLC Leskhoz. The witness explained that Zudheimer, being the main shareholder of NLK, and invited him to take these positions. Tsukanov did not know anything about extorting a bribe by the governor of the Kirov region. However, the prosecutor’s office interrogated him all day, not allowing the second witness to speak, who eventually left with nothing, hurrying to the plane.

-Do you know anything about the provision of white patronage in the activities of the Criminal Code of the Leskhoz? - asked Tsukanova the prosecutor.

- Literally about patronage I can not say. At the meetings in the government, including with the participation of Nikita Yuryevich, questions about the participation of the Leskhoz and NLC Criminal Code were considered in investment projects - according to the witness, the role of the governor in terms of investment projects was regulated by internal acts of the regional government. The commission was gathered at the level of the regional government, then the project was transferred to the Ministry of Physics and Technology, where further decisions have already been made. The governor signed orders on the consideration and entry of an application for one or another investment project to the government.

Judge Vasyuchenko now and then slowed down either a witness, then the prosecutor, demanding from both to speak loudly and slowly.

- You understand, our secretary writes in the protocol! She does not have time! I can’t decipher all this later in headphones, ”she said nervously, turning to the prosecutor and witness. - I have a lot of things. Help me!

The prosecutor began to utter every question with the arrangement and the pause between the sentences. Tsukanov also strongly slowed down the pace. Everyone worked for the protocol.

The accusation raised the topic directly to the investment project of the Criminal Code of the Leskhoz. Belykh, Tsukanov recalled, proposed to change something in this project at a meeting in 2014, because in the form in which he was offered, he could not be implemented. The investment project was at the stage of lag and non -fulfillment, the owner was changed at the Leskhoz Criminal Code (instead of Albert Laritsky, Yuri Zudheimer became it). Zudheimer tried to eliminate problems and prepared written proposals to the government. Tsukanov himself, on these issues, contacted the governor’s deputy and separately from the White at meetings. According to the witness, he talked and met with the governor exclusively “in a working vein”.

- One of the extreme meetings took place on May 17, 2016. The day before, they called me from the governor’s reception and asked to coordinate the possibility of holding a meeting.

- It was an unusual, or ordinary case that you are called from the governor’s reception and invited to a meeting? - the prosecutor was interested.

- Well, they called me the first time. I did not know the topic of the meeting. I called the owner, said that Nikita Yuryevich invites me to meet me and the topic is unknown to me. Zudheimer said that it was by his agreement with Nikita Yuryevich, it is necessary to come and explain all the current problems of enterprises.

The meeting took 8-10 minutes. On behalf of the owner, Tsukanov announced the main issues for the enterprise to the governor: the implementation of investrots of the Criminal Code of Leskhoz and NLK, the situation on the withdrawal of the boiler house NLK and the state of affairs in relations with the tax service of the region. After the intervention of the whites, a “certain work” began to be carried out. The prosecutor asked if she promised white help.

- I was aware of his meetings in the federal authorities, in the Ministry of Industry and Trade ...

The whites interrupted:

- Not my meetings, but Mikheev (deputy governor - ed. ).

“I ask the defendant not to intervene, this can be regarded as pressure on a witness,” said the Tarasov prosecutor heavily tanned (the first day as she left vacation).

- Can the prosecutor be expelled? - calmly asked the white judge. -She is some kind of nervous after vacation.

“Your honor, I ask you to make a remark to the defendant and warn that after the third remark, he has the right to remove the meetings from the hall,” Tarasova summed up.

Tsukanov further said that the third issue of his meeting with the White discussed the problems of NLK with the tax service: the enterprise had an VAT debt about 80 million rubles, which arose "as a result of the activities of the previous owner." The tax authorities went with the audit on NLK at the end of December 2015 to capture the period of the enterprise in 2012 for their verification.

“It was just that muddy time, again those criminal actions of the previous owner of Laritsky,” the witness remarked. - We were afraid that they would count the large amounts to which we have nothing to do, since we did not work at that time.

After asking what relationship was between Zudheimer and the White (answer: “workers”), the prosecutor moved deeper:

-And the gifts for the white Zudheimer ever asked you to convey you?

- Before the New Year 2016, he instructed me to give him a bottle of wine.

-Do you know anything about the transfer of white money to Zudheimer?

- I know this from the media.

However, the prosecutor’s office did not finish this and moved to the topic of participation of the Criminal Code of the Leskhoz and NLK in charity.

The witness said that representatives of the companies participated in various competitions in the forest area, in addition, Belykh gathered the entire entrepreneurial community in April 2016 with a request to provide all possible assistance in restoring the temple and participating in other social projects. After the April meeting, in the first half of June, Zudheimer's companies sent funds to restore the temple, and there was another transfer to the account of the fund, "which was engaged in other initiatives, including the restoration of facades." The witness did not remember the name of the fund and the amount.

According to Tsukanov, the owner of Zudheimer enterprises knew about these translations, the amount was agreed with him. “I’ll say offhand that more than a million by 2016, and after meeting with the governor, we made more transfers.” Money was transferred by a bank transfer: "How else?"

- Did you propose to bring in cash? - asked the prosecutor.

“I don't know about it.”

The prosecutors found that Tsukanov used the recorder at one of the meetings from the whites.

“Not every day you meet with the governor, and in order not to forget anything for yourself,” he explained the need for audiofixation. -This is not some private meeting, but a meeting in the government, so I decided to miss anything, to do so. There was nothing so unnatural there, a normal conversation.

Before reporting to the meeting of Zudheimer, Tsukanov, according to him, once again listened to the record, made notes for himself. “Then, when a criminal case was instituted, I spoke about the existence of the recording of Zudheimer. Then the employees of either the FSB, or the Investigative Committee asked me, ”he recalled.

The prosecutors were cut in court. Bottom line: the extortion of the governor did not go about the money. The problems of Zudheimer enterprises were discussed.

The opportunity to ask a question to the witness finally appeared in the whites:

- How could you characterize your relationship with the regional government? - continued the defendant.

- Well, Nikita Yuryevich ... I look from the prism of my approach to business. It is clear that the regional government has a lot of tasks, functions ... In my opinion, the situation was very drawn with decisions for us for a number of reasons and circumstances. As for both investment projects and the withdrawal of the boiler room, it dragged on.

“I just agree, just this accusation believes that I was patronizing you ...” the whites remarked-was the patronage, were the governor’s relationship with NLK and the Leskhoz Criminal Code? Was the position of the government as a whole to exclude projects or save?

- I only know that attempts to preserve the investment project were made. Both ours and governments.

- Great! Was there something that went beyond the scope of business communication between the government and entrepreneurs?

- These were workers, business relations, I do not see anything out. The complexity and slowness of interaction in NLC speaks of this, everywhere a pause was taken to study a decision.

-Do you know about the transfer of any money to Zudheimer? - asked lawyer Andrei Grokhotov.
