The Federal Penitentiary Service for the Bryansk Region did not recognize the claims, and some clause of Bakulin’s statements (for example, causing grievous bodily harm) were simply ignored, the fsinists did not even give any explanations on them. “Compensation for non -pecuniary damage should be compensatory, and not serve as an additional source of income. The fact of causing non -pecuniary damage is not proved, the claims of the plaintiff are unfounded and are not subject to satisfaction, ”the objections of the Federal Penitentiary Service indicated.

The Klintsovsky City Court in October of this year, having examined the case in an open meeting, where witnesses from Bakulin (also former IK-6 prisoners) were also heard on all points of the claim. Alexander Bakulin is going to appeal the court decision.

"Needles, screws were driven to refuse to pay money"

Alexander Bakulin: “The acceptance of the newly arrived in the zone took place under the leadership of the head of the colony of Lieutenant Colonel Mikolost and the deputy chief of Chernenka. There were two stages. At the first, people were actually brought to the loss of consciousness, the remnants of the mind were knocked out. And the second stage is quarantine, where they were simply finished off.

The whole team under the leadership of Major Ivanov Dmitry Evgenievich, 8-10 people, was directly engaged in acceptance. After beating, Major Ivanov built his employees and thanked for a well -conducted reception operation. I watched this several times.

There are nine detachments on the territory of the colony, and each has its own purpose: one serves the Zhilzone, the other - the industrial zone ... And on the basis of the second detachment they made the so -called adaptation for the new ones. There, he was refueling an asset. They sent there instead of a schizo. They tortured there. The bullying was so serious that people for a month or two could not understand what was happening, very poorly oriented in the situation. They also sent there and guilty from other detachments. If someone has bought up, of course, they no longer beat. And all this is under the supervision of the administration. This came from the highest leadership. All this was encouraged and organized. After all, this asset did not arise by itself, an asset is the production of the administration. So they built a demonstrative camp.

Intractable activists drove sewing needles under the nails. And the screws screwed into the joints with screwdrivers, drilled with a screwdriver of the head. For example, the convicted Zaitsev with a screwdriver drilled his head. Passathys pulled out their teeth. I saw a man who had two upper teeth, incisors, were torn by pliers. This is a convicted Dzhangir. They extorted money from him, he refused to pay, so they pulled out his teeth. I personally examined these people, because I worked in the curtain of the colony (I am a doctor by profession), and even took part in the examination when an investigator from the police (not an employee of the FSIN) came. In particular, I took part in the examination of the victim, who screwed self -tapping screws into the shoulder joints. He had traces on the body, we described them, and I put my signature.

There were X -ray pictures of people with broken ribs. The rib could be broken in two, or even in three places. You can imagine how they beat them in order to break one rib in several places! There were a lot of such pictures. Since I worked in a medical unit, I had the opportunity to see these pictures. ”

Bakulin: “In 2013, at least two or three people went to the next month. They beat his feet until all the ribs broke in a person, and then he died quietly. I personally saw repeatedly how beaten prisoners were carried out in beds, and blood flowed. ”

Kovchevsky: “Needles, screws were driven to refuse to pay money. The main thing is not discipline, but money. If you pay, you could live in a medical unit, drink cognac every day and do nothing, and they will not beat. It was possible to get so. If you pay 2 million, then you can no longer pay. And if 100 thousand per 100 thousand, they can demand more. ”

"For a jar of red caviar and fried chicken they could sell their mother"

Bakulin: “At the very beginning, the asset headed the Petrantsov ( Valery Petrantsov, born in 1979, the nickname“ Lyubertsy . He took the prisoners to the asset who could sell his mother for a jar of red caviar. He took away several people from each quarantine. He built newly arrived, satisfied, dressed: “Guys, if you go to the asset, if you go to the asset, you go to the asset, you go to the asset, you go to the asset. You will eat satisfying ... ”The person unknowingly agreed, he was accepted into the asset, and it was almost impossible to break out of there.

I was released from the charges, the asset made sure that no one hit me ... And then I refused to be the commandant: "Why on earth should I bend for some good food?" And I got such repressions ...

If the asset was indeed an asset, like the Komsomol leaders once, and here the Uffer workers actually simply transferred their powers to the convicts. Here you imagine: the prisoners come out for construction - and there is not a single UFSINIT, activists are commanded by everyone. There were few of them then - 30–40 people in the zone, but they were in every detachment, 5-6 people each, and all the dirty work - searches, requisitions of money, mockery - all took over. ”

From the verdict of the Klintsovsky City Court of April 14, 2017: “Having strong leadership qualities, distinguished by ingenuity, initiative, in order to obtain control over the convicts of the Petrances, etc. The colony council, which functioned under the administration of the Federal State Institution IK-No. 6 of the Federal Penitentiary Service of Russia in the Bryansk region. On behalf of the leadership <...> Petrantsov and others, they took on obligations to unite part of the “activists” convicts in the group to organize with their help to convicts the internal regime of the correctional institution.

Having misleading the leadership of the FCU-No. 6 of the Federal Penitentiary Service of Russia in the Bryansk region regarding the purpose of their activities, Petranes, etc., among the convicts, they picked up psychologically stable and necessary physical data of persons, with the help of which, using physical violence and threats, forced the convicts to observe the internal regime of the correctional institution <...>.

In the future, to maintain their authority, Petranes and others, taking advantage of the situation, began to select physically strong persons from among the “activists” from among the convicts who again arrived in the colony. At the same time, Petrantsov et al., Which was part of the “Council of the Colony”, which functioned under the administration of the Federal State Institution IK-No. 6 of the Federal Penitentiary Service of Russia in the Bryansk Region, convinced the leadership of the colony to provide “activists” with privileges in the form of an increase in the number of long-term dates, free movement through the territory of the correctional institution, visiting the gym, a bath, exemption from public work, etc.

“Activists”, at the direction of Petrantsov and others, applied physical violence in relation to the convicts who arrived in the correctional institution and contained in the quarantine department and adaptation detachment No. 2 in order to intimidate them, suppress the will to resist illegal requirements for the transfer of cash for the needs of detachments under the type of voluntary donations.

From the statement of claim by Alexander Bakulin : “After the convict’s uprising, more than 400 applications for lawlessness, which was going on in the colony, and from me, were also submitted to the Investigative Committee of Bryansk. Before the uprising of convicts, with the current asset, it was unrealistic to file any complaint, as this threatened with beating and translation into the “harem”.

Bakulin: “They scared them very strongly, God forbid, you will go against the asset. I myself saw a huge queue that stood in the toilet, and all these love male bullying were just going there.

People saw that wherever they wrote, everything was blocked. Everyone openly walked with the phone in the asset, they were allowed, they were through round-the-clock passes, and I had this for some time. And imagine such a picture: the convict was given the phone, the asset looked into his eyes, and he had to tell his relatives only what he was allowed. As a result, everything came down to the fact that he begged to send at least some amount. To transfer money, SIM cards and bank cards were used. All this was usually done after beating.

What kind of money was we talking about? The asset was admitted to the database of prisoners, and if a person in the verdict costs that he stole a million, two, three - this is one amount. If a wallet or 50-100 thousand are other numbers. I took out the amount from 200 to 500 thousand rubles, although in the sentence I have not a word that I stole something. But since I have 159th, it means that I have made up and have to pay for the benefit of the colony, and first of all, an asset. ”

Kovchevsky: “A lot of people were injured. Someone bought up, paid frantic money so that they would not beat. We found the phone in their pocket, which means that and for this it was necessary to pay 300 thousand assets ... "

The road to freedom

Bakulin: “I asked the deputy chief of the colonel Kondratenko several times to give a form for a complaint in the ECHR. He never gave me a uniform. Although in each detachment there is a list of what the convict can, and there it is said that the administration is obliged to give forms for the ECHR at the first request. For the second or third appeal, it was said: “Once again, you will go in a schizo, they will be beaten up there, but we’ll forget about the parole in general.”

But the Fsinovites cannot guarantee a court decision. Although they released so many. Each, in addition to orphans, found the opportunity to send 30–40 thousand to court ... About 300 people left in 2013 on a parole.

How did the money go to court? I know the lieutenant colonel alone - Kovalev Nikolai Alekseevich, who wore money in court and burnt it on this. ( In 2014, the deputy chief of IK-6 Kovalev promised the wife of one of the convicts that he would help in court with parole for 200 thousand rubles. But the court was refused, Kovalev opened a criminal case under Part 3 of Article 159 - Fraud using his official position . It was 2012-2013. The chief of the colony Milokost boasted that we were holding the first place in the FSIN in Russia, because we have been leaving for parole in us. Well, indeed, about 8-10 people were released a week. And all for the money. Sample figures - from 30 to 50 thousand. And the court was ordinary - Clintsovsky city. ”

"Flayer"

Bakunin: “Milokosta got away with his hands, until they made a very young guy in the zone of a very young guy instead of Petrantsov, about 25–26 years old. His nickname is a flayer. ( Roman Pelipenko, in IK-6 was on the court verdict for theft. - E. m .). This is the same flayer, under whose leadership, the teeth were torn by the pliers and the needles under the nails were driven. He appeared in the colony since the end of 2013.

They miscalculated with the flayer, he chose the most scumbags, bandits, there were almost one and a half hundred of them, in each detachment a man of 25. A normal person was simply not allowed to breathe. Because of this flayer, the first riot occurred. He went over the stick, and the whole undertaking of the UFSINS quietly to select money and to silence the bullying.

In my lawsuit, the court says that in 2013 20 young convicts died in the colony. For example, prisoner Bulkov was beaten by an employee named Chechnya (served in Chechnya). He beat the prisoner Bulkov with the door. I inflicts terrible beatings. Bulkova, with a diagnosis of “pneumonia” was taken to a civilian hospital, and there he died. ( In 2014, the former IK-6 employee Andrei Yakubov was sentenced to 10 years strictly for causing grievous bodily harm that entailed the death of the convicted Vladimir Bulkov. - E. m .).

In 2015, seven years for the deliberate murder of the prisoner received an activist Zinoviev ( Evgeny Zinoviev , the nickname Zina Bun, was in IK-6 for the robbery and the threat of murder . After the first rebellion, all activists were kept in a separate detachment, behind the fence, and only with employees were taken out. At first, there were 30 people there, then less and less, then they were transferred to another isolated sector. I know that one of those who participated in the asset is a member of the Kushchevskaya gang Evgeny Gurov, who, being a minor, received 14.5 years.

Riot after rebellion

Kovchevsky: “After the first rebellion of Milokost, they transferred the head of the“ Promka ”( industrial zone of the colony. - E. m .). And the second rebellion, in August 2016, was under the head of Yuri Nikulin and the deputy security and operational work (Bor) Gartman ( *Colonel of the internal service Dmitry Gartman held this position until September 2017. - *e. M. ). He came from the Sverdlovsk UFSIN, we knew what atrocities are being done there when acceptance.

The rebellion was due to the fact that Gartman organized a new asset of convicts (mainly boxers) from Chechnya and Dagestan. Almost the same began - the same beating and the same extortion. The three could come from another detachment and beat. People were simply announced how much to pay. ”

Bakulin: “ In the fourth detachment, weekly meetings were held on the mandatory collection of money from each convicted person. To the questions of convicts about the future fate of money, the asset under the leadership of Ahmed Arsunukaev said: "This is not your business." The eighth detachment was the first to rebel, and they went the wall to the wall. There was about 100 people in a clash. ”

Kovchevsky: “ The asset was allocated to the sports ground, they engaged in boxing there, trained daily. They also organized special nutrition, they were preparing everything in the highest category. Ну и, естественно, ходили, как хотели — небритые, с бородами, хоть в майках или в трусах, и им никто замечания не делал.

Очень бунт был сильный, троим из актива сломали челюсти. Сильно их избили. 14 человек из актива погрузили тут же в автозак и прямо на глазах у всех вывезли из лагеря».

Бакулин: «Но сейчас в колонии опять есть предпосылки для создания актива. Бедные УФСИНовцы никак не хотят понять: как же так, то все шиковали, получали не по 20–30 тысяч, как обычно, а куда более серьезные деньги. Самые низы получали по 100 тысяч…

Сейчас уже десятый начальник колонии за три года. Там очень тяжелая обстановка. Я написал в Генпрокуратуру обращение из девяти пунктов. Например, там очень сильно издеваются над пенсионерами, не выплачивают им деньги, шмоны идут через день. Меня эти осужденные — от 60 до 80 лет — попросили быть их представителем. Им там совсем тяжело».

Клетка для зэка

Иван Тавриев (имя и фамилия изменены в интересах безопасности), заключенный ИК-6: «У нас на зоне есть клетка на КПП, между промзоной и жилой зоной, у дежурной части. Вот как в вольере держат собак, вот такая же там клетка. Не понравилось, как пришита пуговка или еще какая-то мелочь, все — в клетку. В чем взяли, в том и сажают. Могут и в тапочках зимой туда отправить.

Эта клетка на улице появилась в конце прошлого года, Гартман ее придумал, теперь уже бывший замначальника. Клетка в помещении была всегда, а вот на улице — это Гартман, его ноу-хау. Гартмана уже нет в колонии, а клетка его есть.

ФСИНовцы ее называют «изолированное помещение», но это реально вольер для собак. И в зимнее время туда помещают, и в жару, какая разница. Моего товарища, например, прямо в 6 часов утра выволокли из барака и посадили в эту клетку. Меня за то, что я отказался от зарядки, перед тем, как закрыть в ШИЗО, тоже посадили в эту клетку. Я простоял в ней с утра и до вечера, до водворения в ШИЗО.

Сколько человек может находиться в этой клетке? Очень много, битком могут набить, люди друг на друге стоят. Зимой, когда меня закрывали, туда забили где-то человек 30, а помещение клетки — ну, два на два метра. И пенсионеров сажают, и инвалидов, разницы нет. Могут держать и сутки, и двое. В туалет могут вывести, но это зависит от дежурного, бывают нормальные, выводят. Но можно и 8 часов простоять без туалета.

Избиения в колонии по-прежнему есть. У нас сейчас спецназ стоит в лагере. Причем непонятно, по каким причинам. 12 сентября у нас опять был шмон. Они пришли на общелагерные обыскные мероприятия, которые проходят каждый месяц. Как в этот день спецназ зашел, вот так и стоит. Что касается ШИЗО, то там спецназ уже больше чем полгода.

Спецназ зэков не избивал. Это исключительно сотрудники. Есть такой очень ярый сотрудник в ШИЗО, очень любит зверствовать, — это майор Шевцов Сергей Иванович. У него такое лицо, что вы никогда не подумаете, что он садист, а он реально садист. Меня он просто бил по ногам, чтобы я стоял на растяжке. Спецназовцы неоднократно защищали осужденных в ШИЗО от сотрудников. Например, конкретно от этого Шевцова.

На зонах с особым режимом зэков водят буквой «Г». Вот то же самое и у нас в штрафном изоляторе, хотя колония общего режима, первоходы. Ведь есть приказ Минюста, запрещающий обыскивать заключенных на растяжке, в том числе и на особом режиме. А у нас и на общем режиме это указание не выполняется.

В августе в ШИЗО очень сильно избили Дениса Никифорова. Все, что ниже пояса, что можно было отбить, отбили. А заявления в прокуратуру отсюда просто не уходят. Они говорят: «Ты его не отправлял. Чем ты докажешь, что ты его отправлял?» Nothing.

«Нет закона в Российской Федерации»

Бакулин: «Из прошлого актива в колонии никого не осталось, их всех перевели в Брянск, сейчас они сидят в СИЗО-1 и СИЗО-2. Их всех раскидали по разным камерам и возят на суды». ( Дела девяти активистов ИК-6 в настоящее время рассматривает Клинцовский городской суд по статье о вымогательстве организованной группой. А вот бывший начальник ИК-6 подполковник в/с Дмитрий Милокост за происходящее в ИК-6 ни к какой ответственности привлечен не был. Сейчас Милокост работает замначальника по кадрам и воспитательной работе в СИЗО-2, где и сидят бывшие активисты. — Е. М.**)

Тавриев: «А вот тех зэков, которые взбунтовались против избиений, издевательств и вымогательств, уже осудили, от 2 до 5 лет добавили, развезли по разным лагерям, и они будут сидеть. Еще вчинили им иски на 60–80 тысяч за порчу мебели. Потому что нет закона в Российской Федерации…»

Еще в 2010 году приказом Минюста РФ были запрещены так называемые секции дисциплины и порядка (СДиП), формировавшиеся из числа осужденных, ставшие на самом деле репрессивными органами в руках администраций колоний. То есть то, что в приговоре Клинцовского суда по делу «Петранцова и др.» называется «Советом колонии», к моменту описываемых событий просто не должно было быть.

Чем закончился эксперимент по перевоспитанию в образцово-показательном исправительном учреждении? Взбунтовавшиеся против беспредела заключенные получили дополнительные сроки наказания. «Активисты», обеспечивавшие «чистоту эксперимента» и повышение благосостояния сотрудников, осуждены или ждут суда. И только «введенное в заблуждение» руководство ИК-6, которому самое место в компании Петранцова среди «др.», оказалось ни при чем. However, no.
