What is known about the special operation of the SBU, as a result of which the Russian Magomed Dukuzov was detained

On Saturday, November 18, employees of the Security Service of Ukraine detained a citizen of the Russian Federation in Kyiv, suspected of killing Paul Khlebnikov. The message that appeared on the official website of the department did not name the surname of the detainee, however, it is indicated: a native of Chechnya, who, according to Interpol, took part in the commission of custom-made murders, in particular, US citizen Paul Khlebnikov, chief editor of the Russian version of Forbes, and Deputy Prime Minister of the Chechen Republic in 2001-2002 (Yana (Yakuba) Sergunin. Paul Khlebnikov, journalist, writer, author of the book “godfather of the Kremlin Boris Berezovsky, or the history of the plunder of Russia”, shot down on July 9, 2004 in Moscow, next to the editorial office of the magazine. Kazbek Dukuzov, Musa Vakhaev and Fail Sadretdinov ( the latter went through another episode that were charged with the defendants . - O. M. ), could not catch the rest of the crime and put on an international wanted list on the bench of the defendants in this case. The jury college in May 2006 justified the defendants who did not admit their guilt. The General Prosecutor's Office of the Russian Federation appealed the decision, followed by the Supreme Court canceled the verdict, but the defendants in the high -profile case were already disappeared from sight.

In a telephone conversation with the correspondent of the “new” SBU speaker Elena Gitlyanskaya also refused to reveal the identity of the detainee, but noticed that the American side was very interested in the indicated citizen for understandable reasons. This man has recently been in Kharkov, was engaged in extorting money from local entrepreneurs, which actually came across.

“He used documents with fake installation data,” said Gitlyanskaya.

According to her, the SBU transfers the suspect whose personality is established, to keep the prosecutor's office, where within 72 hours he will be determined by the preventive measure. “If the corresponding decision is not made within such a period, then, according to the law, they must be released,” said the speaker of the security service. - In the case of detention, the international prosecutor’s office will send materials to the local court to consider the issue of extradition to Russia there. Ukrainian legislation allows the court for 40 days to such a procedure. ”

A source in the special service claims: in Kyiv they took the 39-year-old Magomed Dukuzov, the brother of the alleged killer Kazbek Dukuzov, also allegedly involved in the murder of Khlebnikov. Magomed was suspected of complicity in the execution of Sergunin.

On Monday, in the afternoon, I turned to the head of the press service of the General Prosecutor's Office of Ukraine Andrei Demartino with the question of whether the Russian citizen Magomed Dukuzov under the prosecutor’s “guardianship” was already accepted. Mr. Demartino a few hours later gave an answer: “The prosecutor's office of Kyiv conducts an extradition check. This is all that can be said. ”

The New Gazeta has already sent a request to the public relations department and the media of the Prosecutor General of Ukraine.

It is not entirely clear whether Magomed Dukuzov’s fate “ice age” will affect the fate of Ukrainian-Russian relations. Criminologist lawyer, candidate of legal sciences Anna Maryar in the commentary "New" said:

- I do not know the details of the matter. General rules of extradition: a person is sent to the country of citizenship, and a stateless person to the country from which he arrived in Ukraine. But extradition is a bilateral act, agreements are necessary with the host. If there is a request for issuance, then they will be given to the country that requested - except in cases where political persecution has been proved.

-I do not take parallels, but in 2013, Moscow demanded the issuance of a detainee and convicted in Odessa Adam Osmaev. He was accused of preparing an attempt on Putin. Then Osmaev, through lawyers, turned to the ECHR, and Ukraine was forbidden to issue it to the Russian Federation.

- Given our current relations with Russia, this option is quite real.

- Can the detainee request America?

- The issue is regulated primarily by the Convention on the issuance and bilateral agreements between Ukraine and the USA or the Russian Federation. Our laws must strictly comply with international legal acts. An international lawyer can explain more objectively. I know from criminal law that a crime committed against a US citizen falls under American jurisdiction and the States have the right to make a request to Ukraine. My sources confirm: the issuance of odious Russians by Kyiv is political agreements, not legal. Therefore, if the states are very interested in this comrade, they, with a high probability, will receive it. Although, if, on the contrary, the Kremlin really needs someone, the Americans will interfere, and Kyiv will be offered, for example, a loud exchange. This is the case when the rule of law is secondary in relation to politics - as it was with Gereshniki ( *we are talking about citizens of the Russian Federation Evgeny Erofeev and Alexander Alexandrov - *approx. “The Russian Ministry of Internal Affairs was named the name of the detainee - his name is Magomed Dukuzov,” Interfax reports.

“On November 17, Magomed Dukuzov was detained in Kyiv, born in 1978, put on the international wanted list at the request of Russian law enforcement agencies. He is accused of involvement in the commission of custom -made murders in Moscow, including the editor -in -chief of the Russian version of the Forbes magazine Paul Khlebnikov, ”the report said.

Kazbek and Magomed Dukuzovs, Musa Vakhaev, Magomed Edilsultanov and other suspects were established by the consequence, led by General of Justice Petros Garibyan. However, only two were in the dock, the rest - hid and, apparently, just in Ukraine.

The fact is that all the suspects had a definite attitude to one of the leaders of the Lazan criminal group Loma Ali Gaitukaev, who died this year in the Russian colony. Gaitukaev and his fighters were involved not only in the murder of Paul Khlebnikov and Yana Sergunin, but also to the murder of Anna Politkovskaya, as well as the attempt on the murder of Ukrainian businessman Gennady Corban (over the last two crimes of Gaitukaev was convicted). The convicted organizer of the murder of Anna Politkovskaya - Dmitry Pavlyuchenkov, lieutenant colonel of the secret department of the Moscow Central Internal Affairs Directorate of the Moscow Central Internal Affairs Directorate could be related to all these events.

As far as Novaya Gazeta is known, at least, our source suggests that - after the acquittal of Kazbek Dukuzov, employees of the Moscow police allegedly helped to hide in Belarus.

Then Kazbek Dukuzov at a fake passport, issued to the name Balaev, moved to the Arab Emirates, where he was convicted of robbery. Russian law enforcement agencies knew about his whereabouts, but no attempts to extradite the alleged killer to Russia were made even after the entry into force of the bilateral agreement with the UAE on the issuance of criminals.

Dukuzov-Balaev safely freed himself from the Arab prison and, according to some reports, with the help of the same fake documents was able to get to Chechnya.

As for the investigation of the case of the murder of Paul Khlebnikov, then, as in the case of the murder of Politkovskaya, after the retirement of General Garibyan, it is practically not underway. The case was lowered into the lower administration of the UK, and, despite the obvious intersections with the affair of Anna Politkovskaya, no one wished to unite them into one production.

So, it seems, the capture of the accomplice of the murder is not a very pleasant gift for the Russian investigation, which does not seek to investigate the murders of journalists in full. However, the fear of giving a suspect to the Americans is likely to be stronger.
