The Senator from the Krasnoyarsk Territory, the chairman of the Constitutional Committee Andrei Klishas, made a substantiation of the need to adopt the law. He reported that the relevant committee had previously received the conclusion of the Constitutional Court, which recognized the adoption of this law. He also noted that on November 21, a discussion of the law with members of the Council under the President of Human Rights (HRC) took place.
“The law does not introduce censorship, but fixes additional duties at the media. This is a response to steps against our media, a mirror measure ( see more NT ). At the same time, I would like to emphasize that Russian measures are much softer than American. Nevertheless, we considered that at the moment this is enough, ”said Klishas, presenting the law.
During the debate, only Lyudmila Narusova expressed dissatisfaction with the innovation. In particular, she noted that not all the arguments of the HRC were allotted. To this, Klisas answered her that the objections concerned the inconsistency of the Russian law of the American, but this is not significant, since Russian lawmakers are not faced with the task of harmonizing legal acts with the English legal tradition. He also explained why Article 6 of the Media Law was not used, which allows to limit the work of foreign media. According to Klishas, the law on the media-foreign agents "introduces new regulation, not restrictions."
Senator Evgeny Bushmin asked Klishas to explain to those present that this law could apply only to foreign media. “I saw an interview (member of the HRC of Nikolai) Svanidze Ekhu Moscow, in which he says that this law can be applied to the Russian media. Explain, please, or someone or someone does not understand, or this is a provocation, ”said Bushmin.
Klishas confirmed that the law was directed only against foreign media, since Russians cannot belong to foreigners. He noted that the measures prescribed in the law can (he emphasized that it is “they can,” and not by all means) will be applied “in relation to certain media”. “Application will be determined by the situation in which the Russian media will be located. We give the opportunity to take measures if it is needed, ”Klishas said.

She criticized the haste with which the law was passed. “We must give adequate mirror measures, and we know very well that the president gave the assignment. But that is why the law should be especially carefully prepared. Unfortunately, the haste with which it was prepared is reflected in the sloppiness of the formulations used in it and the absence of terms, ”Narusova complained.
The authors of the law do not explain what is meant by one or another action, forwarding to the law on NGOs, Narusova noted. The conflict came from here, which will create complexity in law enforcement practice, because the criteria that will need to be guided to make a decision are unclear.
Earlier, the State Duma deputies on the terms of anonymity were recognized by NT that the law does not prescribe liability measures for its failure to fulfill, sanctions to the media-and-holders, for this it is necessary to accept amendments to the Code of Administrative Offenses and the Criminal Code, but they have not yet been prepared.

And Alexei Pushkov was criticized by the HRC himself, who called on the Council not to adopt the law on media-foreign agents. Pushkov is perplexed why the council did not make a sharp condemnation of the application to Russia Today and Sputnik the norms of the Law on Foreign Agents. He called the commentary of the head of the HRI of Mikhail Fedotov on this topic not tough enough.
