
The judge of the Supreme Court of the annexed Crimea Mikhail Soboluk canceled the decision to extend the Ukrainian activist Vladimir Balukh the arrest period until January 16, 2018. It is reported by QHA.
As the Crimean human rights group clarifies , the complaint of Taras Omelchenko’s lawyer was considered about the decision made by the judge of the Razdolnensky district court of Crimea Elena Tedeeeva on October 24 at the preliminary hearings in the framework of the repeated process of storage of cartridges and Trotilic checkers against the activist.
Before the decision of Tedeeeva, the arrest of Baluh was extended until December 4. In accordance with the appeal definition of Soboluk after this period, the political zyta must be freed from the pre-trial detention center-1 in Simferopol.
Later on Wednesday, another judge of the Supreme Court of Crimea, Alexei Kozyrev, opened a hearing on the complaint filed by another lawyer Balukh - Olga Dinze. However, Dinze could not arrive at the meeting, which the court notified in advance, asking to postpone the hearing. Baluh himself also objected to the consideration of a complaint in the absence of a lawyer. The prosecutor Bogdan Gorb, against whom the case of state treason is opened in continental Ukraine, insisted on holding a hearing without the participation of Dinze. Nevertheless, Kozyrev suffered a meeting.
Dinze appears the refusal of Judge Tedeeeva in the application declared at the hearing on November 16 on the immediate liberation of the Baluha from the pre -trial detention center. As the lawyer previously noted , the activist was imputed by moderate crimes, therefore, in accordance with Part 2 of Article 255 of the Russian Code of Criminal Procedure (resolving the issue of restraint), he cannot be detained for more than six months from the moment the case was received to the court. Meanwhile, the first process in the case of Baluha started in March, that is, eight months ago.
In addition, the health of the 74-year-old mother of activist Natalia Balukh sharply worsened. Recently it turned out that it was blinded to one eye and needs constant care.

Baluhu is 46 years old, he is a farmer from the village of Serebryanka of the Razdolnensky district. In December 2013, in the first weeks of the revolution of dignity, the activist hung over his house the red-black flag of the Ukrainian rebel army. After some time at night, this flag was secretly disrupted, and the farmer replaced it with the national flag of Ukraine. After Russian citizenship after the annexation of Crimea, the activist did not apply.
In 2015, the Baluha twice took searches. In addition, he was arrested for 15 days according to the fabricated protocol on the disobedience of the police. The case was also fabricated against him about the insult of the TSPE operative (Article 319 of the Russian Criminal Code). On June 10, 2016, the judge of the Razdolnensky District Court, Maria Bedritskaya, sentenced the Baluha to 320 hours of compulsory work . The activist refused to serve his work, and he was replaced by a 40-day arrest.
On November 29, 2016, Baluh attached a plate on the wall of his house "Wulitz heroes of heavenly, 18". The authorities demanded the sign to remove, threatening the persecution, but the activist ignored the demand.
On December 8, FSB operatives held another search with the Baluha, as a result of which they announced the discovery of several dozen rounds and several TNT checkers. The activist was detained and sent to a pre -trial detention center . He was charged with part 1 of article 222 (illegal circulation of ammunition) and part 1 of Article 222.1 of the Russian Criminal Code (illegal turnover of explosives).
The first process in the new case of Balukh was also led by Judge Bedritskaya. On August 4 of this year, she sentenced the activist to 3 years 7 months of a general regime with a fine of 10 thousand rubles. Prosecutor Dmitry Korolev in the debate requested 5 years for the political prisoner for a political prisoner.
The activist himself consistently denied the guilt, insisting that the ammunition was thrown by the FSB operatives during the search. In the last word, Balukh regarded his persecution as a political order, calling the actual reason for the initiation of the case rejection of his annexation of Crimea.
On October 2, the Supreme Court of Crimea canceled the verdict to Baluh , sending the case to a second judge. The reason was named that previously Balukh had already judged the Baluha in the case of insulting the operative, therefore, from the consideration of the new case of the activist, he was supposed to cease, recognizing his interest.
Hearing on the merits of the case within the framework of the repeated process began on November 7 . The prosecution is again supported by the Korolev prosecutor.
In conclusion, the health of the Baluha seriously worsened: bronchitis exacerbated, bouts of urolithiasis and hypertensive crises occurred, digestive problems began.
On November 10, during the next hearings, the Baluha became bad. “Pain in the back, almost cannot stand, twisted,” reported journalist Anton Naumluk. The arrived ambulance made the Baluha an onset of an anesthetic, but even the prosecutor Korolev announced the need to send a political prisoner to the district hospital.
In the hospital, Baluha was diagnosed with osteochondrosis of the lumbar region. Doctors indicated that the political zyt could not take part in the hearings and needs outpatient treatment. At the same time, they did not find obstacles to the further maintenance of the defendant in the IVS of the Razdolnensky regional police department, where he was transferred during the hearing from the Simferopol pre -trial detention center.
In winter, Balukh was subjected to beatings in jail , and in the summer - insults and beatings from the head of the Razdolnensky IVS Valery Tkachenko.
On August 13, it became known that one of the lawyers of Politzek filed a complaint against Tkachenko to the police. However, in the end, the Investigative Committee opened the case against the Balukh himself , having charged him with the beating of the head of the IVS. Politzeku was charged with part 1 of Article 318 of the Russian Criminal Code (the application of non -hazardous violence to a representative of the authorities), which provides for up to five years of the colony.
Tkachenko refused to appear on the confrontation with Balukh. Meanwhile, the lawyer Dinze noted, the Russian law does not provide for the victims of the rights to refuse confrontation.
