Why do news about the arrest of PMC members not surprise those who are familiar with the procedure for their selection by the Public Chamber

Until recently, public observation commissions for the places of forced content (PMC) remained the only real and effective lever of public control in the country. But a little more than a year ago, the Public Chamber (OP) of Russia “professionally” approached the formation of the PMC in 42 regions of Russia, which in the supervisory commissions of human rights defenders did not virtually remain.

And in March of this year, OP already in the new composition continued the program for destroying the PMC: the appointment of 13 constituent entities of the Russian Federation in the commission went through the old, now the usual patterns - human rights activists in the PMC were not again allowed.

All this, of course, could not but affect the situation with the protection of the rights of prisoners. According to the “Committee for Civil Rights”, which is headed by a member of the HRC, the famous human rights activist Andrei Babushkin, only in his organization has increased over the past year

At the end of September, the OP finally informed the beginning of the Donastor procedure in the 30 regions that were not fully formed. And the other day, OP decided to hold a meeting of the working group on issues of the formation and interaction with the PMC of the constituent entities of the Russian Federation, which included representatives from the Public Chamber, the appet Ombudsman, the PMC and the Human Rights Council under the President of Russia.

Representatives of the HRC (Andrey Babushkin, Valentin Gifter, Mikhail Fedotov, Elena Masyuk) at meetings of the working group repeatedly raised the question of the inconsistency of the requirements of the OP apparatus from the members of the working group of receipt of personal data of candidates in the PMC.

There is fundamental information, without which it is impossible to assess the potential of the candidate. This, in particular, is the experience of human rights and the availability of recommendations. In addition, you need to know who and where the candidate works. This is important information, since people (not pensioners) fell into the last convocations in the members of the PMC, who have not been working anywhere for a long time, and, accordingly, have no legal earnings, but at the same time far from distinguished, and sometimes, on the contrary, showing a luxurious lifestyle. Some of these members of the PMC received repeated statements from prisoners and their relatives about the extortion of money. That is, it is quite rightful in such a situation to say that such members of the PMC did not come to observers in order to defend the rights of prisoners, but in order to earn money.

Here, for example, is one of the last messages. We are talking about a member of the PMC Irkutsk Region Marat Sarsenbaev , who was arrested on November 2, 2017 under article 159 of the Criminal Code of the Russian Federation (fraud). Sarsenbaev became a member of the PMC just in the fall of last year, when human rights defenders were not taken to the PMC. And before that, he, with the rank of lieutenant colonel due to discrediting circumstances, was fired from the police of Irkutsk. So the question arises to both the apparatus of the Public Chamber and its advice: how could such a person go through the sieve of your special control? And why, more than a month ago, the arrested member of the PMC Sarsenbaev was not devoid of the Public Chamber of the Russian Federation of the Member of the PMC? So it’s not for nothing that the head of the Irkutsk SIZO-1, Colonel of the V/s Igor Mokeev, is currently meeting members of the Irkutsk region, the words: “Now the members of the PMC can visit the prison one by one, since the second member of the PMC is constantly on the spot ( according to FZ-76“ On Public Control ”, the members of the PMC can visit the places of compulsory maintenance for at least two.-E. m .)”.

A similar situation recently developed in the Moscow PPC. Denis Nabiullin , who became a member of the observation commission, was also arrested last fall. Nabiullina was detained on suspicion of fraud. According to the investigation, a member of the Moscow PMS Nabiullin promised the banker Ildar Klebleev (for more than a year in the pre-trial detention center “sailor silence” for fraud) for half a million dollars to contribute to his transfer to the hospital, and then release from the guard. When transferring money in one of the Moscow cafes, Nabiullin was detained.

What is known about Denis Nabiullin? Before becoming a member of the PMC, he worked in the Civil Rights Committee for a year and a half for the human rights activist and member of the HRC Andrei Babushkin. In the PMC, he was recommended by the all -Russian public charitable organization "Union of Family of Russian Military Personnel", which is also headed by a member of the HRC and the proxy of President Putin Maria Bolshakova. According to the Unified State Register of Legal Entities, Nabiullin is the General Director of Strategy LLC, Sam-Technica LLC, in addition, he is the founder of LLC AMN-Stroy. These enterprises are engaged in construction and repair business. Judging by the financial reports, all these LLCs are unprofitable. Apparently, therefore, this summer, Denis Nabiulin became the director in the charitable foundation for assistance to persons in places of forced content and their families Dismas. Among the types of activity, the fund also includes activities on financial mutual assistance. Maybe the transfer of money in a cafe and was the same activity in financial mutual assistance?

However, we will return to the question of the recommendations in the PMC by members of the OP working group. When selecting candidates for PMC, it is extremely important to know the city in which the applicant lives. After all, there are huge regions in the territory, where correctional colonies are located in remote and inaccessible places, where sometimes for several years, members of the PMC living in regional capitals cannot be reached. There are also closed territories (but), where members of the PMC not living in these territories are simply not missing. Only one Moscow region is five such closed places. Or, for example, the candidate submitted documents to the PMC not his or even neighboring region. What are the motives of a person living 180 km from Moscow to go to the Moscow PPC? Or why does a resident of Moscow want to be a member of the PMC Mordovia?

We, members of the HRC, wanted to get answers to all these questions. But the OP apparatus gave the same answer to everything: they say, you will get everything only after signing the consent of the non -disclosure of personal data of the candidates ...

Despite the extreme scarcity of information provided to members of the working group, if you wish about candidates for the PMC, it was still possible to find out something. Take just for an example the first two surnames in alphabetical order from the list of candidates for the PMC. These are candidates for Moscow. Under the number one on the list is Vadim Gennadievich, Boronin . At number two - Andrey Igorevich Gulutin .

So, Boronin. In the PMC, it was recommended by the Poultry of Happiness Public Organization. There are no mention in the media about the human rights activity of Boronin. Although the experience of human rights is one of the mandatory requirements for candidates for the PMC. Where it works is unknown. According to information available to the members of the working group, Vadim Boronin is the brother of Evgeny Boronin, who, in the fall of this year, as a result of the rotation that had taken place, having no experience of human rights work, became a member of the PMC of the Moscow Region.

Well, now about the candidate for the Moscow PPC at number two - Andrey Viktorovich Gulutin. At the meeting of the working group, we were informed that he was a journalist from Ridus and that the chairman of the Moscow Peninsula Gorshenin (by the way, it was not clear how he ended up in the PMC, since he never engaged in human rights activity) gives him a recommendation.
