
The Tver District Court of Moscow repeatedly refused Alena Dudal, who suffered during the execution, which was arranged in the supermarket by the head of the Tsaritsyno Department of Internal Affairs, Denis Evsyukov, in a lawsuit filed to the Ministry of Finance on the payment of 1 million rubles of compensation for moral damage. This was reported by "Mediazona" with reference to the lawyer "Agora" Ilnur Sharapov, who represented the interests of the plaintiff.
The judge, whose name is not specified in the publication, announced only the motivating part of the decision, so the reasons for the refusal Sharapov are not yet known. A refusal resolution was achieved by an official of the Ministry of Finance, representing the defendant at the hearing.
This is the second refusal to claim Dudal. The first time she lost the trial six years ago, on December 7, 2011. The Ministry of Finance then insisted that Evsyukov committed a crime while not under execution, and therefore there is no reason to argue that Dudal suffered from the illegal actions of the law enforcement officer. On April 16, 2012, the Moscow City Court confirmed this decision.
Meanwhile, on December 1, 2016, the ECHR awarded Dudal and two more victims - Ilya Gerasimenko and Louise Salikhova - 12 thousand euros of compensation, recognizing that Russia violated Article 2 of the European Convention (the right to life).
After that, Dudal filed a new lawsuit in the Russian court. Sharapov stated the position of his principal: "The state lies part of his (Evsyukova. - Ed.) Crimes, since it hired Evsyukov without a proper verification of mental health, entrusted him with firearms and without subsequent proper supervision of his mental state promoted the service."
On the night of April 27, 2009, a drunken Evsyukov fired at the Ostrov supermarket in the South Moscow district of Zyablikovo. Before that, he shot the driver who brought him the driver Sergei Evteev. In the supermarket itself, Evsyukov killed Kassir Elmir Tourdaev, and also made an assassination attempt on another 22 citizens - store workers and buyers. At the same time, he seriously wounded several people.
On February 19, 2010, the Moscow City Court sentenced Evsyukov to a life sentence. The killer is contained in the "Polar Ivas" - IK -18 of a special regime in the Yamal village of HARP, intended for life -sentenced.
