Eskerkhanov’s case of insulting the investigator was received by the court

The second case of the former Chechen policeman Temirlan Eskerkhanov, previously convicted of 14 years in a maximum regime on charges of murder of the Council of RPR-Parnas Boris Nemtsov, was transferred to the Basmanny District Court of Moscow. This was reported by Interfax with reference to the lawyer of the prisoner Anna Burchieva.

Eskerkhanov is charged with an insulting statement at the address of the investigator of the TFR Alexander Kamashev. The case is qualified under part 1 of Article 297 of the Criminal Code (disrespect for the court, expressed in insulting participants in the trial), which provides for a fine, mandatory work or up to four months of arrest. If Eskerkhanov is imposed a different punishment than a fine, it will be replaced by a short additional period in the colony according to part 1 of Article 71 of the Criminal Code.

As part of the process, the judge will also consider a civil lawsuit about the protection of honor and dignity filed by Eskerkhanov Kamashev. The official requires 100 thousand rubles from the convict.

TASS writes that the new case of Eskerkhanov has already been received by court. Information about the date of hearings has not yet appeared.

In connection with the initiation of the second case, Eskerkhanov remains in Moscow, Burchieva added. Other convicts in the case of the murder of Nemtsov have already been sent to the colony. In particular, RIA Novosti reports , Kadyrovets Zaur Dadaev, announced by the direct executor of the crime, is transferred to the colony. Where exactly the convict was taken, his lawyer Shamsuddin Tsakaev added, while there was no information.

The second case of Eskerkhanov became known on October 11 , the next day after the Supreme Court confirmed the deadlines to him and other defendants in the case of the murder of Nemtsov. The reason was the statements of Eskerkhanov made in the Moscow District Military Court on April 6 during the interrogation of Kamashev. The prisoner told the judge to Yuri Zhitnikov: "Your honor, this six, this bitch threatened my family." The judge made Eskerkhanov a remark. He, however, several times called Kamashev a six. After that, Zhitnikov warned the defendant that he "could say for another article."

As Burchieva said in October, a linguistic examination conducted in the case did not see the corpus delicti in Eskerkhanov’s statements, however, the Investigative Committee demanded that the Federal Bailiff Service order a new study so that according to its results a conclusion was concluded about the offensive nature of the applications of the prisoner.

In the conclusion of a new examination, it was confirmed that the characteristic of the "bitch" was offensive. At the same time, the definition of "six" was not considered an insult this time. Meanwhile, Burchieva noted that it was this definition that Kamashev especially hurt.

In appeal, the Supreme Court canceled only 100,000th fines appointed to each of the convicts. Meanwhile, the involvement of the 37-year-old Eskerkhanov in the crime is serious doubts. Among other things, from the very beginning he denied guilt, despite the torture that he was subjected to in March 2015, in the first days after he was detained in Moscow.

On July 25 of this year, the ECHR ordered Russia to pay Eskerkhanov 6 thousand euros for unacceptable conditions for detention in jail and transportation from the insulator and vice versa. The Russian authorities were found guilty of violation of Article 3 of the European Convention (prohibition of torture).
