Lawyers and devils

The first deputy chairman of the Council of Constitutional Legislation and State Construction of the Council of Council of Constitutional Law and State Construction Alexei Alexandrov introduced a bill to the State Duma, allowing the FSB to independently initiate criminal cases against lawyers. On Tuesday, the State Duma speaker Vyacheslav Volodin sent a bill to the Committee on State Construction and Legislation.

Part 2 of Article 37 of the Code of Criminal Procedure (prosecutor), Aleksandrov proposes to include paragraph 12.1, which allows the Prosecutor General and his deputies at the request of the head of the FSB investigation service or its regional headquarters to remove any criminal case or materials of the pre -investigation conducted by the FSB from any investigative structure and transfer them to the special service itself. The same norm gives the Prosecutor General and his deputies the right to entrust the FSB from the very beginning to conduct pre -investigation inspections on reports and investigations on further affairs.

Further, paragraph 10 of part 1 of Article 448 of the current version of the Code of Criminal Procedure (initiation of a criminal case) establishes that cases against prosecutors of the constituent entities of the Federation and investigators of regional divisions of investigative structures are initiated by the chairman of the Investigative Committee or his deputies, and cases against other prosecutors and investigators, as well as against lawyers, are the chiefs of regional leaders of the Investigative Committee.

Aleksandrova’s bill supplements article 448 part 9, which allows the initiation of cases against persons of these categories by the head of the FSB investigative service or its regional head in cases that are agreed upon by the proposed amendment to Article 37.

Corresponding changes are also made to Article 151 of the Code of Criminal Procedure (investigation).

As stated in an explanatory note to the bill, the proposed amendments "will increase the efficiency and objectivity of the preliminary investigation in a number of criminal cases identified by the FSB authorities."

“In the archive,” commented Aleksandrov’s initiative in his Telegram channel Chairman of Agora Pavel Chikov. “Now the FSB will take away any criminal case that he wants. In addition, the Chekists will initiate and investigate criminal cases against lawyers. Finally they will put things in order among lawyers.”
