According to the Decree of the Russian government, since 1994, each child is under three years old (and in large families under six) has the right to receive free drugs from a special list approved by the Ministry of Health, but in Arseniev this resolution does not work.

But we all know that this is not so simple, even if you are a beneficiary, not to mention an ordinary person who does not apply to social benefits. Please explain this idea.
Alexander Saversky: The Constitution guarantees us free medical care in state municipal institutions. The concept of "medical care" is revealed in the standard of medical care (that is, what exactly I can get), and there are medicines. 37th article 323 of the Law "On the Basics of Protection of Citizens' Health" clearly says that the structure of the standard includes drugs. Then we are already watching the law of the 326th "On Compulsory Medical Insurance"-it says that drug security is included in the structure of the compulsory medical insurance tariff.
Maryana Torocheshnikova: That is, we have already paid for our medicines when we gave taxes.
Alexander Saversky: That's not even that. In the legal structure, even in its economic part, there are already medicines. And the question arises: why is the law not implemented? We began to ask this question two and a half years ago at our Congress "Rights to Medicines". There was Deputy Chairman of the Federal Fund of MHI, and at first she did not understand at all what I was talking about. But what does it look like? Everything that is in the standards should provide me, and what is outside the standards? Abroad-the decision of the medical commission, and this is also the norm of the law, directly the same 37th article: a drug that is not included in the standard for life indications, in the case of individual intolerance, is prescribed by the medical commission. It turns out that any drug I have the right to get free - either so or otherwise.

Alexander Saversky: Absolutely. Therefore, we are moving towards this gradually and first accustom the authorities of power to this simple thought. Maryana Torocheshnikova: The right to free medicines, which is guaranteed by the Constitution of the Russian Federation, is not required to implement ordinary owners of the pharmacy network at all, because they are not altruists, they should not give medications left and right to everyone. For this you need to receive some compensation.
I am interested in drugs that beneficiaries should receive. Here is a story from our plot: a free medicine laid by law costs a family of five thousand rubles. This issue is solved by pharmacy networks, or should it be regulated by the state, and the state should give money to the existence of production pharmacies, which are not in the city of Arseniev?
Nelly Ignatieva: In our country, from the 90s, production pharmacies really began to close. Today, throughout the territory of the Russian Federation, only two thousand pharmacy organizations that are engaged in production. There are quite a few cities where they are not at all. This is due to the fact that the 61st Federal Law "On the Condition of Medicines", having entered into force in 2010, somewhere missed the regulation of the production, extemporary activities of pharmacy organizations (these are drugs that are carried out directly by production pharmacies).
But this is not the main reason. In Soviet times, municipal, state pharmacy organizations were engaged in production and were profitable at the expense of revolutions, as the hospitals were served. But already from the 90s, when we began to build market relations, it turns out that, in fact, every medical organization, every pharmacy organization is a completely independent subject from the point of view of providing himself: both activities and purchases. And production in pharmacies has become simply unprofitable, unprofitable.

Of course, it is nice that among private business there are still representatives with these production pharmacies. But in the specific example that you brought, this, alas, is not a solution to the problem. There may be settlements where there is no pharmacy organization at all in which you can get preferential medicines! And people are forced to go to the district centers.
Today we are offered to increase the availability of drugs by releasing all the drugs on the Internet. Another completely incomprehensible solution that can generally ruin all the quality of drugs and treatment is the sale of drugs in grocery stores, and this supposedly will not affect the preferential categories of citizens. This is a deep misconception and even the deception of our patients.
Maryana Torocheshnikova: We can talk about the possibility of ordering drugs via the Internet, not to leave home if you are more or difficult for you to go down the stairs. You can call the online store, order the necessary drug-the courier will come and bring everything. Why not solve the problem in this way, including remote territories, where there will be delivery not the next day, but at least within a week?
Nelly Ignatieva: First of all, today there are no online stores that can sell drugs. The sphere of treatment of drugs is a licensed area of activity. We have no Internet apoptees in the law. The only legal option is when patients, resorting to Internet sites, are booking drugs, but they must come to the pharmacy organization for them. Those mechanisms that are offered today for the benefit of our patients are associated so that they can order these drugs on the Internet only from a pharmacy license, so that it is responsible for the medicine that will release the patient. And delivery should be carried out by a pharmaceutical specialist, and not just a courier.

All that patients buy on the Internet today are pseudo -elections that do not undergo any quality control and permits for circulation in the market of the Russian Federation. It is dangerous! It is not known on the Internet that it is unknown. It can be just a deception.
Alexander Saversky: No one interferes with the appropriately licensed Internet pharmacies and Internet scalams that will meet all the requirements. But I agree that selling medications in stores is very bad, because the medicines are already too affordable with us, many are served without a prescription, and it is difficult to distinguish where the medicine is, and where the dietary supplement is a food supplement.

Alexander Saversky: And if medicines begin to be sold in food stores, there will be definitely even more harm.

Alexander Saversky: The problem of our state is that it is increasingly leaving the social sector. The growth of paid services, the disappearance of components such as production pharmacies, cheap medicines are all the result of the state departure from these markets. Although actually this is not a market sphere, because health is an invaluable product. It only seems that this is a tablet, but in fact the price is health, and sometimes human life. And since vital medicines have to be bought at our own expense, at the same time say that we already have almost European medicine. In Europe, vital medicines are free, and cannot be otherwise!
Maryana Torocheshnikova: In front of me, the report of the General Prosecutor's Office of the Russian Federation, published in March this year, on the supervision of compliance with the rights of citizens to health protection. In particular, it states that throughout 2016, prosecutors in almost all regions identified and took measures in connection with the overstatement of pharmaceutical organizations of the maximum sizes of allowances to selling manufacturers for drugs included in the list of vital and most important. There are up to 30% of the premium for paracetamol, and there were allowances and in the amount of up to 55%. How in general in pharmacies they decide that “here we will sell this drug at such a price, we will make such a premium for it”?
Nelly Ignatieva: We have vital drugs belong to that segment, pricing for which is regulated by the state. For manufacturers, this is the maximum vacation price, which is recorded, and they cannot bring the drug above this price to the market at all. Subsequently, both pharmacies and wholesale have its own level of maximum allowances, it has its own in each region, but the pharmacy organization already begins to consider the price, and, determining the level of trading allowances, it adds a certain amount to the price of the manufacturer. Not a single pharmacy organization, and even more so the pharmacy network, is of interest to overstat prices. What is 30% from 50 rubles, when a pharmacy network can lose a license?

Nelly Ignatieva: The pharmacist will sell what he has.

Maryana Torocheshnikova: In addition, people who come to pharmacies to buy drugs turn to the pharmacist or pharmacist, and not to the doctor who gives them the prescription.
Nelly Ignatieva: We must work very seriously with this situation. The problem is that our doctors stopped prescribing prescriptions. On the one hand, pharmacies are accused and more and more called for responsibility for the release of prescription drugs without a prescription, and when our patients come with the scraps of paper from doctors, how to resolve this situation? Of course, this is possible only when the whole system will work in aggregate: this is a patient, doctors and a pharmacist. And the main thing here is the patient.

Марьяна Торочешникова: Но часто бывает, что есть и настоящий рецепт от врача, и пациент, которому нужны лекарства, но нет никакой возможности их приобрести.
У Рустама Хоршакова из Ярославля редкое заболевание – синдром короткой кишки. Ежедневно на поддержание его здоровья уходят примерно четыре тысячи рублей. Департамент здравоохранения отказывается бесплатно выдавать Хоршаковым все необходимые лекарственные препараты и питательные средства, ссылаясь на дефицит в бюджете. Не помогло даже решение суда, обязывающее местные больницы обеспечить мальчика всем необходимым.
Корреспондент: Рустам Хоршаков не может нормально питаться, не получает нужных витаминов, сильно худеет и быстро устает. Чтобы поддерживать работу организма, нужны дорогие лекарства.
Рустам Хоршаков: Тауролок – дорогой препарат. Он работает как замок (ну, чтобы гулять спокойно), и он мне нужен. А его как раз не хотят обеспечивать. А пачка стоит 10–15 тысяч. Витамин – вот и все, что у нас есть.

Рустам Хоршаков: (играет в компьютерную игру) Это игра на выживание. Находишь припасы и отбиваешься...
Елена Хоршакова: В 2016 году, когда мы приехали из РДКБ, мы сдавали анализы, и у нас понизился калий – они настояли, чтобы мы легли в стационар. И нам там подняли калий буквально за два-три дня, но занесли через катетер инфекцию, потому что младший медперсонал не обрабатывал руки антисептиком и был без перчаток. Наш ЦВК-порт они вообще первый раз в жизни увидели, даже не знали, как с ним работать. В итоге у нас развился сепсис и двусторонняя пневмония, ребенок уже задыхался, неделю был на ИВЛ.
Корреспондент: Даже в больнице Рустаму не выдавали все необходимые препараты. Теперь департамент оспаривает первое решение суда, и Елене приходится покупать все самостоятельно.
Елена Хоршакова: Натуральное питание: коробочка, где почти два литра, четыре пакета – это десять тысяч. Хватает на четыре дня. Это не считая того, что я должна добавить туда саувит, виталипид и аддамель, а они тоже дорого стоят, вот одна такая штучка – 2500. Если раньше мы могли купить спирт, которым я все обрабатываю, то в последнее время его в аптеках не продают, требуют рецепт. В поликлинике даже не могут выписать нам рецепт. Заказываем в Москве.
Марьяна Торочешникова: Я думаю, та история, которая происходит сейчас в Ярославле, – не единичная для России. И это абсолютно патовая ситуация.
Александр Саверский: Мы сейчас проводим очередной опрос, и если в прошлом году 76% опрошенных считали, что цена на лекарства – это барьер, то в этом году это уже 86%, на 10% больше среди той же самой аудитории. Процентов 40 говорят: "Мы не можем купить и не применяем те препараты, которые нам назначает врач", а какая-то часть – ну, как в этой ситуации (видно, что мальчик на грани выживания), люди отдают последнее на лекарства.
Государство себя ведет неумно и цинично. Ведь это же ребенок, и это вообще должно быть святое, все надо выдавать бесплатно.

Теперь возьмем трудоспособных людей среднего возраста, у которых повышается давление. От скачков давления бывают инсульты и инфаркты. Для того чтобы этого не происходило, есть достаточно дешевые лекарства, но принимать их надо каждый день, и тогда давление держится, нет ни инсульта, ни инфаркта, и человек продолжает работать. Это значит, что он не вызывает скорую помощь, ему не понадобился ни стационар, ни реабилитация, он не стал инвалидом, и государство не платит ему пожизненно пенсию по инвалидности. То есть один вложенный в амбулаторные лекарства рубль дает семь рублей экономического эффекта.
Если этот мальчик будет нормально получать свои препараты, то годам к 40–50 он отработает все, что в него вложено, и потом еще даст доход (есть определенные расчеты ВОЗ ). Известно, что гибель пятнадцатилетнего человека – это абсолютный убыток, потому что все, что вложили, он не успел отработать, а люди, дожившие до 40 лет, возвращают все, что в них вложено; дожившие до 60 лет возвращают в двойном размере.
Экономика только учится все это считать. Но если вообще отнестись к здоровью как к способности трудиться, то получается, что здоровье – это самая выгодная инвестиционная сфера, ведь без труда нет вообще никакой экономики. Но пока такого отношения нет, кто угодно может оказаться в ситуации, когда нужны лекарства, и социальное государство должно решать за нас эти вопросы. У нас, к сожалению, мальчика посылают в стационар, и понятно, почему: амбулаторное лечение – это все за свои деньги, хотя он наверняка инвалид, и, вообще говоря, ему все должны предоставить бесплатно. Это вопрос к прокуратуре.
Марьяна Торочешникова: Так даже решение суда уже есть! Вопрос – к бюджету, потому что никто не исполняет это решение.
Александр Саверский: Идет реальная война субъектов Федерации со своими пациентами. Не ставятся диагнозы, не назначаются дорогие лекарства, а назначается какая-то фигня пятидесятилетней давности – типа сделали вид, что что-то там лечим. То в аптеке нет, то рецепт не выписан, – в общем, куча всяких отговорок.
Но в правовом споре экономические доводы не прокатывают, и довод об отсутствии средств в субъекте Федерации имеет неправовую природу. Есть и соответствующие решения судов. В прокуратуре мы задаем вопрос: почему вы не возбуждаете уголовные дела? Ведь это уголовный состав! Если мама завтра не купит этому ребенку этот препарат за десять тысяч, то он умрет, и кто будет виноват? Это должностное преступление, 293-я статья УК.
Марьяна Торочешникова: В прошлом году прокуратура возбудила 148 уголовных дел.

Александр Саверский: Эти цифры впервые звучат в публичном пространстве, и это очень важно. This is a huge figure! И сейчас очень важно донести эту информацию до чиновников, принимающих решения. Оказывается, уголовные дела есть, их немало, и за то, что мы сейчас увидели, можно сесть! Я думаю, когда это станет широко известно, ситуация начнет меняться.
Марьяна Торочешникова: У меня вопрос к Нелли Валентиновне как к представителю Российской ассоциации аптечных сетей. Когда семьи оказываются в таких ситуациях, как правило, начинаются сборы, обращения в благотворительные фонды, и если заболел ребенок, а не взрослый, то родителям даже легче собрать на него деньги. А если речь идет о длительном или пожизненном лечении, то взрослому человеку точно не обойтись без благотворительной помощи. Ваша ассоциация выступает как один из таких благотворителей в отношении тех людей, у которых лечение очень дорого, и на него ни один регион никогда не наскребет денег, даже если пересажают всех чиновников?
Александр Саверский: Я занимаю принципиальную позицию по поводу лекарств за благотворительный счет. Я задаю фондам простой вопрос: вы готовы взять на себя ответственность за здоровье людей в масштабах страны? No? Тогда не надо делать вид, что вы это делаете.
Марьяна Торочешникова: Но они же помогают!
Александр Саверский: Они на одного вылеченного ребенка угробили трех, потому что как бы снимают эту функцию с государства. Начальники департаментов Минздрава, субъектов Федерации пишут таким детям: "Обратитесь в благотворительный фонд". Но ведь именно государство допустило все это, и это не снимает с него ответственности.
Тогда эти фонды, прежде чем начать собирать деньги, должны сделать все для того, чтобы государство обеспечило пациентов лекарствами. Но они этого не делают, потому что им это невыгодно, на что они тогда будут жить? Здесь прямой конфликт интересов! И это не решение проблемы в масштабах государства.
Нелли Игнатьева: Моя человеческая, гражданская позиция: конечно, помогать нужно. Вот сегодня я пришла сюда с мероприятия, где звучали жесткие цифры: есть дети, которые уже просто на пороге последних дней своей жизни. Когда человека нельзя спасти, ему все равно нужно помогать, и если государство сегодня этого не делает, то мой человеческий долг – как-то помочь.
Благотворительные фонды, прежде чем собирать деньги, должны сделать все для того, чтобы государство обеспечило пациентов лекарствами
Александр Саверский: О чем вы говорите? Эти люди идут к вам просить денег, а ко мне десятками, сотнями идут те, кто не может получить помощь, и им никто не поможет! Прежде всего вы должны были пойти к прокурорам по поводу всех этих детей и заставить их возбудить уголовные дела. Не дать ребенку лекарство – это преступление!
Нелли Игнатьева: Давайте будет каждый заниматься своим делом! Я не пройду мимо умирающего человека – это моя гражданская позиция. Что касается того, чтобы ходить к прокурору, то есть Лига защиты прав пациентов – вы себя так назвали, и это ваша функция. Аптечные организации не несут такой функции. Мне больно и стыдно, что есть люди, которые нуждаются в помощи, и когда государство должно гарантировать им эту помощь, они ее не получают! И в этой ситуации я выберу путь помощи.
Марьяна Торочешникова: А работникам аптек дают какой-то инструктаж о том, как им общаться с людьми, когда к ним приходит человек, а ему говорят: "Мы не можем вам выдать бесплатный инсулин по вашему льготному рецепту, потому что у нас нет лекарств"? Я сама становилась свидетелем таких конфликтов, когда пенсионеры говорят: "Деточка, милая, дай мне лекарство". Она говорит: "Нет, мы можем только продать, у нас нет для вас бесплатных лекарств". И никто не объясняет этому пенсионеру, что делать дальше.
Нелли Игнатьева: Аптечная организации не играет никакой роли в системе льготного обеспечения, кроме одной: она выдает те лекарства, которые закупило государство. Если государство закупило, то это лекарство есть, а если государство не закупило, то закупает аптечная организация, чтобы лекарство было в свободной продаже, пусть даже за собственные средства. Из двух зол нужно выбирать меньшее.
Инсулин должен бесплатно отпускаться абсолютно всем. Каким образом и зачем он появляется у нас в обращении за полную стоимость? Это говорит только об одном: государство не справляется с объемами проблемы. И те примеры, которые вы сегодня приводили, говорят тоже только об одном: нет нужного финансирования, деньги уходят совершенно в другую сторону, а не на лечение наших пациентов.
Александр Саверский: Каждый чиновник, который принимает решение, в частности, о выделении бюджетов, должен понимать, что за это он может получить реальный срок. Люди умирают без лекарств!

Прежде всего, нужно получить доказательства того, что вам отказали в лекарственном обеспечении, затем написать заявление главному врачу с жалобой на то, что лекарство не дают, и получить на него ответ. Ответ может быть получен не только от главного врача, но и от субъекта Федерации, Министерства здравоохранения.
Как только вам отказали, у вас появляется право жаловаться в прокуратуру на неоказание вам медицинской помощи, не обеспечение лекарствами. А там механизм сейчас уже отлажен.
Марьяна Торочешникова: Через обращения в суды или достаточно вынесения представления?
Александр Саверский: У них разные есть формы: есть вынесение представления об устранении нарушенного права, есть протесты, есть обращения в суд по 45-й статье Гражданско-процессуального кодекса на стороне незащищенных групп населения.
У меня на руках есть письмо прокуратуры по Ульяновской области, в котором содержатся сведения о том, что в отношении министра здравоохранения этой области возбуждено уголовное дело за невыполнение решения суда. Все это работает и подстегивает чиновников. Другого пути просто нет!
