Ombudsman: In the Angara region, the regional court allowed to violate the constitution

The Irkutsk Regional Court allowed not to comply with the Constitution of Russia and violate the rights of citizens. This portal "Siberia. Realia" was stated by the Commissioner for Human Rights in the Irkutsk Region Valery Lukin, commenting on the decision of the regional court, which on December 19 considered his complaint to suspend the activities of the temporary detention center in the village of Zalari.

Lukin demanded to suspend the work of the insulator, since human rights are massively violated there. The institutions of the institution do not meet the established requirements, fire safety requirements are also violated. According to him, the conditions in the isolation ward in the Zalar are "torture" and "inhuman". They do not meet sanitary and hygienic requirements, since they do not have a sewage system, water supply, windows and ventilation, the human rights activist said.

According to Lukin, neither law enforcement agencies nor the prosecutor’s office took effective measures, so he was forced to go to court. He added that the European Court of Human Rights qualifies such violations as a cruel and inhuman appeal.

The Zalarinsky District Court, having examined the complaint of the Ombudsman, admitted that the activity of the temporary detention isolator does not comply with the Russian Constitution, as well as the federal law "On the content of the detention of suspects and accused of committing crimes" and violates the rights of persons contained in it. But he did not suspend the activities of the insulator.

According to Lukin, the defendants - the Office of the Ministry of Internal Affairs of Russia in the Irkutsk Region and the Ministry of Internal Affairs of Russia "Zalarinsky" - said in their defense that the Russian Ministry of Internal Affairs does not allocate funds for the construction of a new insulator, and it is impossible to bring the old room into proper state.

Lukin appealed the decision of the Zalarinsky court. But the Irkutsk regional court did not satisfy his complaint. The Ombudsman came to the conclusion that in fact this decision was recognized as the optional norms of the Constitution of the Russian Federation.

The Commissioner for Human Rights has the right to file a cassation appeal. Lukin planned to use, but today the deputies of the Legislative Assembly of the Angara region appointed a new Ombudsman. They became Victor Ignatenko. He promised not to ignore the situation with the insulator, but he has not yet studied documents in this case.
