
A repeated examination conducted in the case of the chairman of the Karelian "Memorial" Yuri Dmitrieva, recognized the photos of his adopted daughter not pornographic. The conclusions of the study at a meeting of the Petrozavodsky City Court were announced by Judge Marina Nosova, reports New Gazeta.
Experts of the Federal Department of Independent Forensic Examination of St. Petersburg came to the conclusion that Dmitriev photographed his adopted daughter without clothes to control her physical development.
Politsek’s lawyer Viktor Anufriev called the results of a re -examination "Big Victory". He asked to free Dmitriev from custody. However, the prosecutor of Petrozavodsk Elena Askurova, personally supporting the accusation in the process, demanded a third study - in the Mais intellectual property agency.
As “7 × 7” clarifies , askerov insisted on choosing this agency in September, when she filed a request for a second examination, but Judge Nosov decided to send pictures in the FDNSE. The lawyer Anufriev noticed the magazine: "Mais is such an office - also an LLC - which, I am sure, works to order. I watched their examinations - they are completely illiterate. Apparently, there are not many offices that are ready to fulfill the desires of the prosecutor's office in Russia."
Later, at the hearing on Tuesday, Askerova filed a request for the sending of Dmitriev to a stationary psychoexpertise to find out whether the political investigation was needed to send forced treatment. At the same time, Dmitriev was already undergoing an outpatient examination, which did not find sexual perversions from him.
Anufriev asked for time to prepare objections to the petition of the prosecutor. Nosova announced a break until 14:30 of Wednesday, December 27.
Dmitriev was detained on December 13, 2016 and arrested two days later . In the final version of the prosecution, the 61-year-old activist is charged with paragraph 2 of Article 242.2 (the use of a person under the age of 14 for the manufacture of pornographic materials), which provides from 8 to 15 years of the colony, as well as Article 135 (depraved actions) and 222 Criminal Code (illegal turnover of weapons).
According to the plot of the case, Dmitriev took pictures of the naked 11-year-old adopted daughter of Natalia, and also kept a cut around the house. In fact, the lawyer Viktor Anufriev noted, Dmitriev adopted a child with slow development and he was recommended to periodically photograph the girl to fix her condition. These pictures, the lawyer emphasized, were stored on Dmitriev’s home computer; The activist did not print them, did not publish and didn’t send them to anyone. As for the circumcision, Dmitriev took it away from the children in the yard several years ago. At the same time, the weapons are no longer suitable for shooting.
Hearing on the merits began on June 1 in the Petrozavodsk City Court. The process takes place in closed mode. Politzek does not plead guilty.
On September 15, Judge Nosova at the request of the prosecution and defense appointed a second examination . Hundreds of photos of the girl appear in the case. The first study conducted a year ago at the Center for Sociocultural Expertise recognized only nine pictures in which the child’s genitals are visible pornography. On June 22, one of the leading Russian sexologists Lev Shcheglov spoke at the process. He gave a devastating assessment of the examination conducted at the request of the investigation. Nosova introduced the review of Shcheglov to the matter.
At a meeting on October 11, Judge Nosov extended the arrest of Dmitriev until January 28. The judge also rejected all the defense petitions, including the withdrawal of the prosecutor Pavel Gravchenkov. Nosova did not allow Anufriev’s lawyer before the procedure for re -examination of photographs, did not call him the names of new experts.
Dmitriev - secretary of Petrozavodskaya and member of the regional commissions to restore the rights of victims of political repression. Since 1997, the NPO has been headed by the "Academy of Social and Legal Protection". It was Dmitriev in the late 1990s who led the expeditions who discovered places of mass executions of political prisoners in the tracts of Sandarmokh and Red Bor, located respectively in the Medvezhyegorsky in the Prionezhsky districts of Karelia. He acted as one of the founders of the Sandarmokh memorial complex. In this tract in the 1930s, more than 9.5 thousand political zyes were shot, including the largest figures of Ukrainian culture. During the process, hundreds of people spoke in support of Dmitriev: writers, scientists, social activists, human rights activists, journalists, musicians, artists, Orthodox priests and participants in international days of memory of victims of great terror. The petition with the request to free the historian was signed by more than 30 thousand people.
