The seventh year, the residents of the Petrozavodsk five -story building are fighting with the Nevsky Passage trading extension. Since 2014, the bailiffs cannot force the debtor to fulfill the court decision, veterans of the Great Patriotic War are handing over medals, regional officials, prosecutors and bailiffs, to which they call, have not advanced a step towards demolition of the extension in four years. The correspondent of Novaya Gazeta figured out why veterans of the Great Patriotic War declare a hunger strike and want to burn themselves, and only a person who is called the last political prisoner in Karelia is ready to solve their problem.

The veteran of the Great Patriotic War Nikolai Bakinov lives in a modest one -room apartment. In the hallway calendar - crossed out 11 months.

- The month has passed - I cross out. Here, the last month has remained, ”says Nikolai Bakinov, and it sounds ominously. - Now it would be a new year to celebrate without this extension, while I am still alive.

Dull yellow light. Yellow walls painted with paint, cheap TV, old Soviet furniture, a bedspread with an embroidered yellowed tiger on the wall. The window is triangular like the nose of the ship, and under the window there is a roof, on the roof - snowdrifts with small rat traces. At the opposite end of the room, a very sad in a pale green dressing gown is trying to sit on the bed Olga Bakinov's bed. Near the bed of the walker. Table with medicines.

- This is a correspondent! Correspondent! - shouts Bakinov in his wife's ear. “Can you say anything about this about everything?!”

- Why can't I say that? I will say. They, when everyone walks here, on the roof, oh what is going on, ”Olga Vasilievna explains confusedly.

Through their apartment, activists and residents of the house with the illegal trade extension "Nevsky Passage" tried to break through their apartment. Pensioners wanted to make out the extension themselves. As it is incomprehensible, and it was not possible to find out. The valiant “Chopovtsy” stood on the way, the police arrived at the scene - to inform that the extension could not be disassembled.

After the failed siege, the Nevsky Passage survived, they forgot about militant pensioners for a while. Nikolai Bakinov before and after he went out with a single picket, a couple of years ago he returned his orders and medals to the Karelian government in protest. His apartment fell greatly in price because of the story with the extension. From the roof covered with bitumen, in the summer there is evaporation, an unpleasant odor, it is hot in the apartment, Bakinov claims. Together with his wife, who is unlikely to solve something, on December 20 he announced a hunger strike.

- Where else to contact, to God? So he does not hear us. I suffered so much in these seven years. Not that they got tired, but boiled like that, - Bakinov runs his big strong finger along his neck,

- I do not want to say that, but if my wife dies, it doesn’t hold anything else here - I will burn myself at the government building.

"Nevsky passage"

From the side it seems that the Nevsky Passage is empty. Because of the black windows, the extension looks abandoned. The light is only at the entrance, on the door, the inscription: “In the lower underwear, a 30% discount on the bras,” the shopping rows are adjacent to the wall of the house, the opposite part of the extension is fenced with a red and white ribbon, it is empty.

Two displeased women sell women's clothes. They don’t want to answer questions - they tired of the story with the illegal extension, fighters with the Nevsky Passage pestered in the morning.

- They want to get money, so they do not allow us to work here. See how many jobs are lost, ”the saleswoman says and refuses to call his name. - They are fighting, but for what, they themselves do not know. We sit in a coat because it is cold without heating.

- Can't you say a name?

- Half of the fourth.

- The name, I say, say?

-Ah, name! - the saleswoman laughs. - No, I will not say the name.

- Oh, you are so interested in our opinion! - says the woman behind the neighboring counter. - I live in this area, people need this store - there are no more stores, they closed everything, made shopping complexes, and who will go there? Pensioners? The "sail" was closed, they all come here. The cross -country ability has become less while this is a hype, people think that the store is closed.

In theory, there should not be trading under the roof of the extension. Owners of the extension of the Tskugunov businessmen who like to trumped convenient Russian law, and they say - trade is under the roof of the house, and this is almost the truth.

In the store, mostly a female assortment is historically. The women's store was here for 35 years, only without an extension. Nevsky Passage was built in 2010. Some residents argue that in the protocol of the meetings on which the construction was allowed, there were dead souls and fake signatures, but this is no longer recognized. In 2013, the Petrozavodsk City Court decided to demolish the extension. The decision was fixed by the Supreme Court in 2014. Since then, bailiffs cannot force the owners of the Nevsky Passage, businessmen of the Tskugunovs, to demolish the extension. And people continue to go here for shopping.

“On the way from work, I constantly go here,” says Anna. - I think that you should no longer break, since they built it. Probably, it was necessary to sound the alarm in the early stages, but now it’s not clear why to break, and even spend money on it?

- Before, everything was here. Children's, school supplies, books, and now in order to buy something, you have to go to the city, ”says love, a resident of a neighboring Nevsky passage at home.

- Why are these areas not used reasonably? Is everything holding on to several shops? There used to be a basement, but now, look, empty squares, ”says Petrozavodska, Irina Zhigalova. - It was necessary to negotiate this Tsmugunov with tenants when they began to build. It was possible to make a winter garden on the roof, a greenhouse, these are not so high costs. They would glaze, put plants. Benches to people. And now it seems to be demolishing this is not rational, and it looks good from the street. But people can also be understood - they looked at the street, and now in the fall and winter these evaporation, and in front of the nose are a roof.

Let them talk

The next day, three wrestlers - Goshkiev, Bakinov and the oldest among them, Vladimir Dmtsov - entered the building of the Karelia Legislative Assembly. The old and already experienced fighter with an illegal extension Mikhail Goshkiev on December 20, 2017, the day before, also announced a hunger strike.

On the street is a blizzard, the old people sigh heavily, Goshkiyev wipes fogged glasses. The hunger strike is held steadfastly - it rumbles in the stomachs, go resolutely to the passing one.

“It is registered in New York, a US citizen,” Goshkiev jokes awkwardly, taking his passport from the guard.

And pensioners, veterans, and businessmen, as well as representatives of the government, prosecutor’s office, Karelian bailiff service, parliamentary deputies and journalists urgently gathered Alexander Sharapov in the small room. Everyone worries for the health of veterans, ask to cancel a hunger strike, think about health.

There is another reason that no one calls. On the eve of December 20, the former senator, the famous Karelian businessman and politician, Devlethan Alikhanov, now considered a political prisoner, whom the Petrozavodsk city court sentenced the six years of the colony for fraud, offered money to finally be dismantled. The money is considerable, fifteen million rubles.

It is easy to guess that a generous proposal significantly hits the reputation of the local government: with a problem that officials cannot solve for the fourth year, the prisoner is ready to figure out.

So at the meeting the faces of all the gathered preoccupied and serious, only the veterans have decisive and strict. The Ombudsman with its detachment resembles the leading popular talk show, and the meeting is the same-with mutual insults, baseless accusations, and to find out something to unwilling to no avail.

The main bailiff of Karelia, to which was the most questions, took the word the first. He said that they are now doing business in Moscow itself. I added that you need ten million to make out the extension, for this you need to find the contractor who will make the project, and for this you need to announce the competition, and then find the contractor who will analyze the extension, and for this you need another auction - in general, the matter of non -construction. And then Alikhanov is with his money. And, in general, he is late - and hastened to retire.

The deputy head of Karelia on domestic politics, Vladimir Lubarsky, was offended in response to the accusations of Goshkiyev, called on everyone to find the right decision - the attempt ended with the dispute and demonstrative departure of too busy to spend on this time a representative of the Karelian government.

The businessman Tskugunov said several times so that even those who did not understand: "Money is not a problem at all!" - This was said by Andrei Tskugunov, who, after the meeting, reluctantly admitted that he took an investment loan for the construction of the extension and still gives it, plus pays fines, which monthly write out the bailiffs - small fines, according to the law from 1 to 2.5 thousand rubles. The amount of the loan had to be dragged from Tsmugunov with tongs.

“The investment loan was taken, respectively, bank investments were invested, and not some personal funds,” said Tskugunov. - There was a credit line of 70 million.

The leader of the extension fighters Mikhail Goshkiev accused more in Starikovsky-some of deceit, others of corruption, the prosecutor's office and bailiffs in inaction. By the end of the meeting, it seemed that businessmen were right, and Goshkiev was just a stubborn old man.

And indeed, after all, there is a project of reconstruction, which paid for the Tskugunov, there are beautiful pictures on the table. There is another option - the representative of the Public Chamber of Karelia, lawyer Elena Paltseva proposed solving the issue without bailiffs - an individual does not even need to be carried out. Take it, do it. But veterans, as one, demand to return the house to the original appearance.

Tskugunov believes that someone is standing behind the Goshkiev, hints at politicization and, finally, as if an ace from the sleeve gets a question:

“But you, too, I asked me for a million dollars that everything remains like that,” he squints towards Goshkiev.

Finally, 88-year-old Dmetsov with the Order of Lenin on Latskan leans to the veteran of the Great Patriotic War Nikolai Bakinov:

- This meeting is empty. Empty, do you feel? He whispers.

Small, stocky Bakinov nods. In a strong fist, he tightly squeezes the newspaper, on pale skin the veins and the “Kolya” tattoo on the wrist are loosened with blue skin. Bakinov carefully listens, it seems, he understands little, namely, he feels, therefore, occasionally shouts: “The court decision must be executed!” - And the point.

Court decisions

Tskugunov is sure that the bailiffs, not an authorized person, but the debtor and the recoverer must agree on the project for the reconstruction of the extension and put a “legal point”. He is ready, and Goshkiev, supposedly, does not want to negotiate.

“I repeat once again,” the businessman Andrei Tsugunov says after the meeting, “he [Goshkiev] sent documents in 2016, in 2017, he does not receive or react.” At the meeting, he voiced: “I will not do anything,” thereby untie his hands, ”continues Tskugunov,“ in the fact of execution, he will be able to say that they did not do it. And again there will be risks, hunger strikes and so on.

The certification of Goshkiev under the reconstruction project needs businessmen - Goshkiev may understand this, but cannot explain this. Or does not want to. There is a version that then on this project you can get an independent extension, not related to the house, or start trading in the basement. To the question about trade in the basement of Tskugunov does not answer, or rather answers evasively-we must wait for decisions, projects and something else there.

Lawyer Anna Uthanova says that Mikhail Goshkiev should not approve the project. Then it should be approved by another resident of the house with the extension, which she represents in court - her claim was united with Goshkievsky, only now their struggle is going on in parallel.

“They believe that Goshkiyev interferes, and we are the same obstacle,” says Anna. - Our name is not called for one simple reason - we understand that no our consent is required and we will quickly wrap them in public discussion. And they do not need it. They know how to fight Goshkiev, to oppose him, they are very beautifully wrapped. They really violated the rights and could out of politeness, out of respect for age to endure it. I understand that he is unbearably based on his theses, but he is an elderly person, and they are in a woman’s room with him. He is simply stubborn, believes that this should be accepted as a fact and does not understand why this is not accepted as a fact. He is also sorry, he tries, worries, and these are nerves.

What Mikhail Andreevich does, the lawyer calls the collective farm. Anna Uthanova has long and in detail tells the background by phone - about several court cases and meetings that cannot be counted. The first thing - they decided to demolish the extension. On the second, it was recognized that it is impossible to bring it to the original appearance and it is necessary to do reconstruction. Then the St. Petersburg expert said that it was impossible to make out the extension without prejudice to the home and at the third court hearing the results of his examination were canceled. The sketch, which, at a meeting with the authorized, trumped Andrei Tsmugunov, and his embodiment was recognized as unlawful, the Petrozavodsk City Court decided on March 21, 2017. And the bailiffs suspiciously cannot force the debtor to execute the court decision and refer to one or to other reasons.

Now the lawyer and her principal are going to sue another lawsuit - the recognition of the inaction of the bailiffs illegal. They are sure that their rights are violated, and there are no objective reasons not to execute the court’s decision on the demolition of the extension.

Young and progressive

“My opinion is that the main problem of the house is not the Tskugunovs, but the Goshkiev,” snapped businessman Leonid.

Leonid [name changed] - one of the Petrozavodsk entrepreneurs, is engaged in real estate, made at least 20 projects for large Russian networks, fears the consequences for business and asks not to name his name. He is sure that no one will demolish the extension, the main task of surviving veterans, and most of the residents of the drum confrontation.

In 2014, Leonid learned that the Tskugunovs sell retail space under the house with the Nevsky Passage, where there was a store for many years, but they sold without an extension - it is impossible to sell the extension legally. The meaning is such that it was possible to buy a cheap retail space in a passage place with an encumbrance in the form of an extension.

- The object is built well, the place is good, a large cluster of people, trade is good at the intersection. It seemed to me that this is an interesting object. But I understood that if the issue is not resolved with the residents, then there would be no sense in this, ”says Leonid.

The entrepreneur went to Mikhail Goshkiev. I outlined a picture of a terrible future - by its free will this extension will not demolish, there will be a contractor who will take an advance, will demolish only half the extension and disappear, rats and homeless people will settle in the extension, and the other contractor will leave behind the destroyed walls and everything will drag out for another five years. The rats, by the way, are already there - but where they are not in the city, says the entrepreneur. Why wait for the apocalypse?

Then Leonid outlined the prospects of Goshkiev. By preserving the extension, the difference in price in the amount of 20 million rubles can be invested in the house - change all windows in the house, communications and risers, repair the entrances, get fun of the best courtyard in the city, and all through the comma. And replace smelly bitumen on the roof with a safe and reflective stone. The greenhouse cannot be, as plums are clogged. But you can, if desired, put pots with flowers, what is it.

Leonid came three times. The last time Goshkiev made it clear that the extension only needs to be demolished, and the communication on this is completed.

- Goshkiev is a former judge and prosecutor. His eyes are burning, ”says Leonid. - He lives in war, does not think about the well -being of the tenants, he just needs to fight, and he drags all this on himself. War veterans are old, it is difficult for them to make decisions, to understand the legal sides.

Leonid admitted that people, in fact, do not like people. Entrepreneurs, that is,, on the contrary, considers himself a blessing for the city and its appearance. Although with the Tskugunovs, he admits that many do not like to work. When the “young and progressive” residents of the house will take the situation with the “Nevsky passage”, they will agree. And not the young and not progressive Goshkiev will not retreat.

Not young and not progressive ...

... Goshkiev admitted that the truth is partly about a million dollars. It was he who, in the Supreme Court, the representative of the Tskugunovs jokingly answered the malicious question: “If you now throw us all a million, then we’ll think about it,” and you can guess which one.

Mikhail Goshkiyev has a spacious apartment, a large hallway and a kitchen. In the next small room there is a portrait of a son with a black ribbon in the corner. Рядом, на подоконнике, стопки бумаг — окно выходит на крышу «Невского пассажа», на синие сумеречные сугробы на ней.

На кухне за чашкой растворимого кофе Гошкиев рассказывает, как из-за его упертости изменяли даже решения Верховного суда — один вор хотел избежать наказания, но бывший прокурор задолбал письмами. За всю судейскую практику он вынес только пять оправдательных приговоров.
Глава Карелии Артур Парфенчиков, в котором Гошкиев видит причину многих бед, получал высшее образование там же, где учился Михаил Андреевич — в СПбГУ, где учился, например, Дмитрий Медведев. А в 1986 году будущий главный судебный пристав России проходил у Гошкиева практику в районной прокуратуре.

Гошкиев отвечает на вопросы охотно, кажется, даже старается найти в своем прошлом что-то, что может его хоть немного скомпрометировать — когда Парфенчиков проходил практику, Гошкиев попросил всех студентов самим себе написать характеристику, а он только подправил. И все написали — ребята были хорошие, а никаких личных мотивов у него нет.

Михаил Андреевич всю жизнь работал районным прокурором, в конце 80-х получил должность судьи, в 1998 году ушел на пенсию, а в конце 90-х избирался депутатом Законодательного собрания. По иронии судьбы поддерживал перестройку и говорит, что в советское время его противостояние было бы невозможно.

— Ради бога, пусть Цмугунов идет. Я завтра же извинюсь перед ним, даже публично, что человек обещал и сделал. Но он не де-ла-ет это-го, — по слогам разъясняет Гошкиев. — Он просто в очередной раз… И не нужно со мной никакого согласования проекта, это он лапшу вешает на уши. Я еще раз говорю: «Пусть все делают по закону». Пусть служба судебных приставов, только уже не Карелии, а Российской Федерации заключает договор о перечислении денег с Алихановым, — настаивает Гошкиев.

Идея сама по себе абсурдная, но, видимо, абсурдность эта не укладывается в голове старого законника. Вечером 21 декабря по телефону бывший прокурор отвечает уже эмоционально, нервничает, просит прощения, что нервничает и настаивает, что действовать нужно только по закону, никто из пенсионеров не сможет нанимать подрядчиков и руководить сносом пристройки, а о том, что нет проблемы в деньгах, Гошкиев услышал от Цмугунова впервые.

Недавно из Европейского суда по правам человека вернулось заявление с отказом — пропустили сроки подачи. Напоследок — самый наболевший вопрос:

— Зачем вам на старости лет все это?

— А для вас порядочность, принципиальность и законность должны существовать? — отвечает вопросом на вопрос Гошкиев.

Ветерану Великой Отечественной войны Николаю Бакинову 86. Бывшему прокурору Михаилу Гошкиеву 70. Владимиру Дмецову 88 лет. Глядя на этих стариков остается признать — это война не на жизнь, а на смерть. И побеждает в ней время.
