The case of ex-mayor Yoshkar-Ola Plotnikov. What happened in court in the last days of 2017

Since September, the former mayor of the city Pavel Plotnikov has been in the Yoshkar-Olinsky City Court. He is accused of illegal participation in entrepreneurial activity and receiving three garages in the form of a bribe. Plotnikov does not recognize the prosecution. More than 90 witnesses of the declared 120 performed in the court, the interrogation of the remaining will continue in 2018. The 7x7 correspondent monitors the process and tells how the last meetings of the outgoing year have passed.

About garages and public hearings

In December, eight meetings took place in the court in Plotnikov’s case - two per week. At the last four meetings, witnesses performed related to garages on the streets of Krasnoarmeyskaya and Volkov and public hearings on permission to their construction. Garages were built by entrepreneur Alexander Turuev, convicted of trying to attempt Plotnikov, he testified against the ex-mayor. Most of the witnesses performed at meetings for several minutes, the prosecution, defense and the judge did not ask them additional questions.

The employee of the Mingosimature Mari El Nail Sando answered the court’s question whether the practice is normal when the administration submits the applicant’s documents - in this case it was a question of documents on the site on ul. Krasnoarmeyskaya, 6, where Turuev built several garages. According to her, "this issue is not adjusted by law - either the administration or the applicant itself is submitted, this is not prohibited." Pavel Plotnikov did not turn to her with a request to solve the issue positively.

Another former employee of the Ministry of State Property Vladimir Mikheev said that all documents regarding garages on the street. Krasnoarmeyskaya, were compiled correctly.

The chief architect of the Artel design workshop Damir Shaidullin and the chief project engineer in the Parus design department Eduard Govorkov answered in detail the questions of representatives of the state prosecution about public hearings. Shaidullin was asked if the explanatory note was needed for the project for the construction of garages, he replied that in 2010 it was not yet required. Govorkov said that public hearings on garages on the street. Eshpaya "definitely was not." According to him, residents of houses and courtyards who concerned the issues of building changes, "came in all cases."

The head of the legal department of the professional union of Mari El Lyudmila Colin as a representative of a public organization was often part of the commission on public hearings. She told how the hearings were held, how they presented questions on them, how they summed up.

Deputy Head of Rostekhinventarization - Federal BTI Elena Shemakhina spoke about permits for the construction of garages on ul. Red Army. The prosecutors asked Shemakhin why there was no data on buildings in the act of coordination of the land plot (there was an old building on the site of the garages). The witness replied that this act was not constituted. She signed a document, but expressed a special opinion - entered the data on the building on the site. After the construction of the garages, an inventory of the territory was carried out, a record appeared in the documents that the old structure was demolished.

The builders talked about the construction of garages of Turuev on the streets of Volkov and Krasnoarmeyskaya. According to them, the carpenters did not come to the construction site.

Dispute on the return of the pledge to the winner of the auction

The state prosecution was interrogated by the deputy chairman of Yoshkar-Olya, Stanislav Matveev, according to the episode with the victory of Alexander Turuev at the auction in 2012 for the rental of a land plot for the construction of an apartment building on Bulvar Bulvar. According to the witness, the Yoshkar-Ola Municipal Property Committee did not have any legal grounds for returning the amount of pledge (each participant in auctions contributed a cash deposit, after the trading was completed, the deposit of the winner was counted as a rent for the site). The witness said that he believes that this contradicts the Civil Code.

After the return of the collateral, the company of Turuyev “Capital-Stroy” stopped paying the rent, the debt grew, said the witness.

Plotnikov’s lawyer Igor Komarov brought Matveev as an example the letter of the Mingosimature Mari El, in which there was an explanation of this situation. The ministry referred to the fact that such rules are regulated by the Land Code. Judge Fyodor Artyushov said that the court is a specialist in the field of substantive law and it is he who will give the assessment, and not the parties to the process.

The witness answered the question of Pavel Plotnikov that the deposit was returned to the winner at least one more time. He named the name of the entrepreneur Dmitry Miroshin. Stanislav Matveev could not recall other similar cases.

Igor Komarov requested the announcement of the balance of debt of the Capital-Stroy company. From this document it follows that the organization of entrepreneur Turuyev by the spring of 2014 paid off the debt for rent in the amount of 10.4 million rubles, the overpayment amounted to more than 600 thousand rubles.

“The debt in this section was repaid,” Summed Komarov.

The witness could not answer Plotnikov’s question about whether Kumi and the city administration worked to recover debts from the “capital-Stroy”.

Plans for 2018

In the case of Pavel Plotnikov, a break for the New Year holidays was announced. For three months, the court did not manage to interrogate all 120 witnesses of the state prosecution. According to the lawyer, ex-mayor Igor Komarov, more than 90 people performed (or the protocols of interrogations) at the process. Several witnesses did not appear at the court: the ex-head of the administration of the head of Mari El Dmitry Turchin, the former head of the architecture and urban planning department of the city administration Andrei wives, an employee of the architecture department of Nadezhda Andrianova.

In 2018, the interrogation of witnesses will continue. It is expected that at the end the main one will be interrogated, on whose testimony the charge is being built. Entrepreneur Alexander Turuev was convicted of trying to attempt on Pavel Plotnikov for eight years in prison. He is serving a sentence in a general regime in Yoshkar-Ola.

The judge said that in January four meetings will take place in the Plotnikov case. The lawyer of the ex-mayor asked him to increase the number of meetings-he is busy in other processes that go outside Yoshkar-Ola. The judge promised to take into account the request of the defender when drawing up a meeting plan for February.
