The new case of Albert Begidov, who had served in the colony for 12 years for 1 month for the attack in 2005 of the armed underground on Nalchik, was sent to the prosecutor to approve the prosecution. This was reported on the website of the Movement "For Human Rights".
Begdov is accused of on October 25, he attacked the IK-6 operative of the Kirov Region, the captain of the internal service of Yevgeny Proshkin, causing a physical pain to the security forces.
Human rights activists ask the regional prosecutor Nikolai Zhurkov not to approve the charge, to return the case for the investigation, to oblige the investigation to satisfy the defense petitions and conduct an investigative experiment, interrogation using the polygraph of both Begidov and the victim, as well as a video technical examination. The movement also turned to the Commissioner for Human Rights of the Kirov Region Alexander Panov with a request to promote the protection of the rights of the prisoner.
The lawyer of the prisoner Timur Idalov considers medical documents fake, on the basis of which the case has been instituted. The certificate of the Omutninsky Central District Hospital, issued by the results of the medical examination of Proshkin, does not comply with the requirements for the Ministry of Health. It does not have a registration number, it does not have the details of the hospital and the personal seal of the surgeon examined by the FSINIT. The certificate itself speaks of an abrasion on the left lower leg of Proshkin, although the diagnosis is formulated as a "abrasion of the right lower leg." In addition, there is no information about Proshkin’s appeal to the reception department of this hospital.
The lawyer Idalov sent a statement to the police about the crime on the fact of falsification of medical documents. However, the answer has not yet been received.
On November 10, Begidov was supposed to be released from the EPCT (internal prison) IK -6 in the village of Vostochny Omutninsky district, having completely served his term - 12 years 1 month of strict regime. However, on October 29, the senior investigator of the Omutnin interdistrict department of the TFR Office in the Kirov region Major of Justice Mikhail Telicin opened a new case against the prisoner . Begdov was charged with part 2 of Article 321 of the Criminal Code (disorganization of the colony with the use of non -hazardous violence to the fsinovtsa), which provides for up to five years of imprisonment.
On November 9, the court in the Kirov region arrested Begidov and sent him to the pre -trial detention center.
The prisoner did not plead guilty. He suggested viewing the recordings of video surveillance cameras, but the FSINITS said that the camera did not work at the moment when the incident allegedly occurred. Meanwhile, the Kirov UFSIN, in the message of the new business of Begidov, published on November 8, claimed that "the incident was recorded by video surveillance cameras."
On November 6, Telicin interrogated Begidov in the presence of lawyer Ilhom Yakhyaev. The prisoner said that around November 2016, when he was in IK-27 in the village of Lesnaya Verkhnekamsk district of the Kirov region, two FSB operatives came to him, one of which was called Alexei. They stated that Begidov should "urgently make" a malicious violator of the regime.
About a month later, the prisoner was accused of violating the rules of the internal routine and sent to the PCT (another type of internal prison) IK-27 for six months.
On May 23-24, 2017, Begidova was taken to a pre-trial detention center-1 in Kirov. There, the same operative Alexei invited the prisoner to cooperate, in particular, testify against a certain citizen. Begidov refused. Then Alexei made another proposal to the prisoner: to confess to the crime, get another two years, and then go free. For 2018, the operative explained, the World Cup was scheduled, and before its end Begdov will not be released anyway. The prisoner also rejected this proposal. At the same time, he expressed his readiness to leave with his family to Vladivostok after the liberation so that during the championship he would be as far away from the cities where the competitions should be held. Alexey promised to think and give an answer later.
In June, the same operative again appeared to Begidov - this time, accompanied by two more security officials from the FSB, as well as the head of the operational department of the SIZO -1. They interrogated the prisoner as a witness in a certain criminal case. Leaving, Alexey assured that everything would be fine.
Meanwhile, the next day, the FSINITS said that they had found two blades from Begidov: in the cell and in the bag. After that, the prisoner was sent to the EPTC IK-6.
Regarding the events of October 25, Begidov on interrogation at Telicin told the following. On that day, he was taken to the shower, where he was supposed to wash in 15 minutes. The prisoner was washed in 5 minutes and began to wait for the escort to return to the camera. The FSINovets looked into the booth and ordered not to turn off the water. A few minutes later, the “victim” Proshkin came to Begidov and asked if the prisoner finished washing. He answered in the affirmative. At the same time, noted the prisoner, he himself remained in the booth, and the FSINovets was outside its borders; The distance between them was a meter and a half.
Proshkin turned around and left; Begidov was left to wait. After about 20 minutes, five or six FSINCITS ran into the shower. One asked the prisoner what happened. He replied that he was waiting for him to be taken to the camera. The Fsinites came out, and in the corridor of Begidov saw about 10 more security officials. Then the prisoner was handcuffed, photographed and announced that he attacked an employee of the colony, and did not specify who exactly.
Begdov emphasized that named Proshkin did not know and, perhaps, had not previously intersected with him in the colony.
On November 8, also in the presence of a lawyer Yahyaev - held a confrontation of Begidov with Proshkin. The Fsinovets said that the prisoner washed longer than the due for 15 minutes. Proshkin allegedly approached Begidov about this, and he attacked him. The prisoner in response stated that the FSINovets was lying.
35 -year -old Begidov is a resident of the village of Kenzhe in the line of Nalchik. In 2005, he worked in a kiosk of mobile communications; He visited the mosque, but did not express radical views. On the eve of the attack on Nalchik, on October 12, he called his mother and said that he would spend the night with her sister living in the city itself.
Under what circumstances, Begidov joined the participants in the attack and which object went to, was not explained. However, it was said, that the eldest brother of the prisoner, Arthur Begidov, who also received a deadline for the case, the acquaintance suggested helping on “showdowns with some people”, and when he arrived at the named address, the assembled began to distribute weapons. Arthur Begidov tried to refuse, but the detachment commander to threaten to kill him and deal with his whole family. The group went to the border guard; Arthur Begidov, who controlled the car, intentionally made it stuck. When the detachment moved to another car, the elder Begidov left the machine gun in a stuck car.
Meanwhile, Albert Begidov in his testimony in court noted that he did not manage to take any actions during the attack. Only when he got out of the car, he immediately fell under the automatic queue, having received an through wound of his shoulder, wound in the lip along the tangent, as well as wound to his finger. Begidov was taken to the hospital, but from there, right from under the dropper, they took the police into the 6th city town. Doctors tried to object, but the security forces insisted on their own. Taking Begidov, they threw him on the floor of the car naked and began to beat him.
The beating continued in the department. Begdov diverged the seams, and he began to lose blood. He was taken to a pre -trial detention center. The familiar doctor Begidova worked there. He wanted to help, but the security forces banned, saying that the wounded man should die. The doctor, however, put the seams by candlelight, and then Begidov was taken to the regional Federal Penitentiary Service hospital. There he spent a month, after which he was returned to a pre -trial detention center, where the beatings continued. At the same time, the security forces beat the prisoner in the face so that the seams on the lip spread, and the wound on the shoulder was borrowed by the gun of the machine gun. According to the prisoner’s mother, Begidov was beaten every day.
If the older brother, on the essence of the case, partially pleaded guilty, then Albert Begidov announced complete innocence . On December 19, 2013, speaking with the last word, he emphasized that he ended up at the place of attack "due to circumstances that are beyond him." “If something depended on me, I would have done everything that could not die, not a single mother to lose my son. But even if the court believes that I was to blame, I paid for this eight years in prison,” Begidov noted.
During the attack on Nalchik, held on October 13-14, 2005, 35 law enforcement officers and military, 15 civilians and 95 underground members were killed. The process in the Supreme Court of Kabardino-Balkaria lasted since 2008. Initially, there were 58 accused, but one of them - Muradin Kardanov - died of tuberculosis in 2010, before the end of the trial.
The verdict in the case was issued on December 23, 2014 . Five defendants received life sentences, three more gave up to 8 and a half years and released after the sentence is announced, since they have already left for these terms in the pre -trial detention center. The remaining 49 defendants received from 10 to 23 years of strict regime. Albert Begidov was given 12 and a half years, and Arthur Begidov was 15 years of strict regime.
On January 28, 2016, the Supreme Court of Russia slightly reduced the terms of most convicts . In particular, Albert Begidov was reduced by five months. All five sentences to life imprisonment were upheld.
In different years, a number of complaints about torture, an unfair trial and a number of other violations of rights were sent to the ECHR in the ECHR.
