
The experts of the forensic center of the Ministry of Internal Affairs during the computer-technical expertise did not find any evidence of the involvement of the mathematician Dmitry Bogatov in the calls for terrorism and an attempt to organize riots. This was reported by TASS with reference to a source close to the investigation.
"Investigators on the eve of introducing protection with the results of a computer-technical examination, which lasted eight months. As a result of a study by the Mathematics of Bogatov’s laptop and flash cards, the Ministry of Internal Affairs experts confirmed that no illegal materials and evidence that binding it to the incriminated crimes were found on any of the personal devices found in the Bogatov apartment," the source said. Thus, he noted, in the near future the investigation should withdraw all the accusations from him.
Confirmation of the innocence of Bogatov "was just a matter of time, and the results of a computer-technical examination for protection are obvious," said the lawyer of mathematics, leading lawyer of the Roskomsvobod public organization, Sarkis Darbinyan. "It is quite sad that I had to keep a man in a pre -trial detention center for more than three months and for another five months under house arrest, in order to find out the complete non -involvement of Bogatov to the posted posts and the incriminated crimes. And this is despite the fact that he had reinforced concrete alibi," the lawyer said.
According to Darbinyan, he will seek the rehabilitation of Bogatov after the accusations withdraw from him. “After the experts of the institution authoritative for the Russian investigation confirmed at least any digital evidence of his involvement in committed acts, we will insist on the speedy withdrawal of all the accusations from our client and its full rehabilitation in a rather difficult time that he had to survive due to the incompetence of those who excited this case against him,” the lawyer emphasized. Darbinyan refused further comments in connection with the subscription of non -disclosure.
The 25-year-old Bogatov, a teacher of mathematics at the Moscow Financial and Legal Academy, is charged with calls to participate in protests on April 2. According to the plot of the case, on March 29, a mathematician from an account, led by Ayrat Bashirov, published on VKontakte the following message: "April 2 on Red Square. On a dick of approval. Rags, bottles, gasoline, turpentine, foam, acetone - if possible." It was claimed that the record was made from the IP address of the accused's apartment.
Bogatov himself insists that at the time of the publication he was not at home, he was not at home. His lawyers indicated that publications on behalf of Ayrat Bashirov were distributed from several IP addresses and only one of them corresponds to the apartment of the accused. In addition, the defense noted, this IP address belonged to the output node of the Tor network, so any user of an anonymous network that connected to the node could write a message.
At the same time, after the detention of Bogatov, a user who has access to the Irat Bashirov account took responsibility for publishing a post -imputed post. The user said that he lives in the United States, he was not familiar with Bogatov, but he can document that he was not involved in the publication.
On the night of April 6, Bogatov was detained. Mathematics was charged with part 3 of Article 212 of the Criminal Code (calls to riots), which provides for up to two years of the colony. However, on April 7, the judge of the Presnensky district court of Moscow Evgeny Naydenov refused the arrest of the detainee. He indicated that according to Part 1 of Article 108 of the Code of Criminal Procedure (detention), the arrest of suspects in cases of crimes of small gravity - that is, those for which the Criminal Code provides for no more than three years - is not allowed.
Despite this decision, the detainee was not released. Instead, Bogatov’s case was retrained by submitting mathematics to the charge under Part 1 of Article 30 - Part 1 of Article 212 (preparation for the organization of riots) and part 2 of Article 205.2 of the Criminal Code (public calls for terrorism via the Internet). The maximum punishment on the first prosecution is seven and a half years of the colony, the second - seven years. On April 10, the same judge Naydenov sent Bogatov to a pre -trial detention center .
On July 24, Bogatov was transferred under house arrest . The last time this preventive measure was extended until January 31, 2018.
