As an entrepreneur who declared the theft of the money of the Ministry of Defense, he turned from the victim into the prisoner and was found in a pre -trial detention center

The cause of the death of the entrepreneur Valery Pshenichniki is the first riddle in this story. He stayed with a person involved in a criminal case for only three weeks. Moreover, he himself once initiated this investigation, because he wanted to open theft. As from the victim, he became a prisoner to die in prison later, the second riddle. The third - why the complaints of the accused against illegal arrest were lying in the pre -trial detention center for three weeks, not reaching the trial. And most importantly: why did this matter be needed, which consisted of riddles.

According to the Investigative Committee, in the SIZO-4 camera on Lebedev Street in St. Petersburg, on February 5, the entrepreneur Valery Pshenichnik, the former general director and co-owner of the company “Novit Pro”, was found hanged on February 5. He was charged with group fraud on an especially large scale: the theft of 100 million rubles in the execution of the state defense order for the Admiralty shipyard plant. The criminal case was opened on December 12, 2017, and the investigation of the Main Directorate of the Ministry of Internal Affairs in St. Petersburg is conducted. The alleged accomplice of wheat is called the deputy chief engineer of the "Admiralty shipyard" Gleb Emeelchenkov. Now he remains in custody in the very pre-trial detention center where Pshenichny died, and expects that the court will still consider his arrest complaint.

Increased pressure

Valery Pshenichichny sat in a cell with three neighbors. It so happened that on February 5, three cellmates took. Two - to the courts, the third - to meet with a lawyer. Wheat was left alone and, according to the employees of the insulator, took advantage of this to commit suicide. They say that he developed depression. At about 16 o’clock in the afternoon, the convoy turned into the camera of one of the prisoners - and found wheat in a loop.

“According to my data, wheat could die from a stroke,” says another version of the lawyer Nikolai Maryankov, who defends Emelchenkova. - In court and then in the insulator, he complained about increased pressure, it went off scale for 220.

The company, which until recently headed wheat, “new” confirmed that he really suffered from severe hypertension, drank a lot of drugs, and had already suffered a stroke about two years ago. As for depression, people who knew the businessman do not represent him in this state.

“He was a very positive person, with strategic thinking, all the time looked at tomorrow,” says the employee “NEVTOT PRO”, who asked not to name his name. - I went to the new Porsche. For the holidays he went somewhere to rest, returned to the refresher.

After the vacation, wheat managed to spend one day at work. At 6 a.m. January 16, several groups, accompanied by machine gunners, rushed with fan searches to the Office of the “NOTS OPA” and to apartments to employees. Pshenichnik and Emelychenkov was detained, on January 18 the court decided to take them into custody.

In the pre -trial detention center, Pshenichichnaya spent three weeks. And almost all this time in the isolator, complaints of lawyers against illegal arrest were dusting.

“We wrote appeals immediately after the arrest,” says lawyer Alexander Semchenkov. - But it was Thursday, then the accused was transported from the IVS to the pre -trial detention center, so lawyers were able to get to them only on Monday. This was the last day to file complaints. They are registered in jail, but they lay there, although their court should consider within three days. As they explained to us, the court did not send a courier behind them.

Valery Pshenichny was 56 years old. Whether he really broke in prison and committed suicide, or died because he did not receive medical care, the Investigative Committee understands.

In November 2017, the Plenum of the Supreme Court forbade the arrest of entrepreneurs under economic articles.

Judge of the Oktyabrsky District Court Elena Sergeyeva, authorizing the arrest of Pshenichnik, referred to the fact that he was not a businessman, but the performer of the state defense order.

The appeal instance could take into account the state of health. But the wheat did not wait for this.

At a hard price

“NETS PRO” specializes in design documentation and other developments by order of the Ministry of Defense. According to investigators, back in 2012, the company wanted to take part in work on the project 636.3 - Submarine Barshawank. The head contractor of the Ministry of Defense for this order is the St. Petersburg Plant "Admiralty shipyards", the performer of the work-the 51st Central Design and Technological Institute of Ship Repair (51 Center). Wheat was known that the project involves the development of a three -dimensional computer model of the vessel, it is needed for post -sales service and repair. And such models - just the horse “NOTS OF”.

The investigation claims that in May 2013 the Ministry of Defense set a firm price for the mentioned work: 300.6 million rubles. Wheat and his partner Andrei Petrov (at that time - the general director of the company), according to investigators, as if they had entered into a criminal conspiracy with the deputy chief engineer of the Admiralty Shipyard Emelchenkov in order to artificially overestimate the cost of developing the model. And in December 2015, 51 CCTS concluded with “NEVT PRO” for an agreement for 967.6 million rubles. The investigation calls the price that has grown up “economically, technologically and otherwise unreasonable” (the investigation did not conduct examinations on this score).

In the period from February 10 to September 29, 2016, the investigation believes, the defendants received an advance-400 million rubles. A quarter of the amount seemed to cash out Petrov: 50 million traveled in two tranches to the territory of the Admiralty shipyards and handed Emelchenkov.

Employees of "Night pro" justify the price of the specifics of the order. In 2013, military acceptance really tried to set a firm price: to fix all the parameters of the future computer model of Warsaw. But it turned out that this is technically impossible, because the work is completely new and the parameters are unknown. How much percent should the "live" boat should be reproduced? With what accuracy to detail-“to the bolt” or can any nodes skip? No one dared to take responsibility: suddenly, when repairing the boat, it turns out that some detail was “unorgered”? Therefore, the solid price to which the investigation appeals was not established, and the project participants decided to go from the opposite: to determine the maximum “bar” and, as the parameters clarify during the work, adjust the price. The amount of 967.6 million rubles has become such a "bar" that cannot be crossed. The customer and the contractor coordinated it in 2015, closer to the conclusion of the contract.

The contract for “Development of a three -dimensional model of the case, general sector systems and equipment of the project 636 and the creation of a structural connection between a three -dimensional model and repair documentation” can be found on the public procurement website. Among the accompanying documents there is a protocol of approval of the price between the customer and the contractor. It affixed the amount: 967.6 million rubles. On December 24, 2015, the protocol was signed by both parties - the general director and chief economist 51 Central Center, and after 4 days - the head of “Novit pro” Petrov and Glavbukh Sergeyev.

In 2016, the OFAS in St. Petersburg conducted checks in the framework of “control in the field of state defense order”. The participants in this transaction were also checked: 51 centers and “NOTS OF”. The website of the department says that "facts of unreasonable overstatement of prices ... in 2016, like 2015, was not established." According to the "New", the final act of the OFAS was taken by the investigation during a search in the company's office on January 16.

The investigation did not find money (these same 100 million supposedly cashed rubles). Emelchenkov, who, according to investigators, took money from the enterprise, did not even find traces of this amount. He lives in a small apartment that survived after the divorce.

Then why on earth did this criminal case appear and became the cause of the death of a 56-year-old man?

The nasty role in this could play, oddly enough, the mentioned divorce of Emeelchenkov. The drama unfolded in his life just in the fall of 2015. When the story of the ill -fated state defense order began.

In November 2015, the Leninsky District Court of St. Petersburg received a statement by a citizen Emelychenkov about a divorce. The motive was that life together is impossible, since the wife "has long been living with another man." This “other” was the general director (at that time) “NOT WHO” Andrei Petrov. Love, apparently, happened big, because Olga Emeelchenkova, without even waiting for the divorce of his first marriage, began to call herself Petrova. The parting of the spouses was accompanied by an exhausting and very angry weight on the division of property.

“The relationship between my principal and his wife developed acutely conflicting,” says lawyer Nikolai Maryankov. - Gleb Anatolyevich even had to give gifts to her daughter through a neighbor.

Fights for property in the courts continued until the fall of 2017. In parallel with the development of the story of the alleged theft of one hundred million. In the most acute period, Petrov was present next to Emelychenkov’s ex -wife. It was as if he even moved to an apartment in the center of St. Petersburg, which his beloved sued with her ex -husband.

Meanwhile, in the life of Petrov himself, too, everything was not easy. A chair of the company's general director went from under him. Worse than that: a criminal prosecution hung over him. A longtime partner and friend became an enemy.

Deal

According to SPARK, Valery Pshenichny and Andrei Petrov established three companies together. In the “NEVT PRO”, Pshenichnya belonged to 75 percent of the shares, Petrov - a quarter of the package. He has been the general director since 2007.

“In September 2016, a common acquaintance brought Valery Pshenichniki to my office,” says lawyer Maryankov. - The entrepreneur complained that the partner was robbing him, using the post of general director. It was, if not mistaken, about 55 million. He asked how the director could be shifted through the court.

The lawyer helped to shift Petrov without a trial through the tax inspectorate. The indefatigable wheat nevertheless turned to the arbitration, where he confirmed the procedure for expelling an ex-friend from the leading post. Petrov ceased to be the head of “NEVTIT PRO” in September 2016. But the advance for the “Warsaw”, apparently, acted with him - judging by how the investigation dates this event. And the execution of the order now was to ensure the execution of a wheat, who had risen at the head of his company.

“After a while, wheat came again,” the lawyer continues. - He wanted to get stolen money from the former general director.

The entrepreneur complained that due to the fact that the money was gone, he may not be enough for the implementation of the state order. He was angry at Petrov and longed for a criminal case. The lawyer advised another way: the search for money using an audit.

“I understood that there was a criminal case - only one could have a protection line for Petrov: yes, they say, I sent the money to the side, but the owner himself told me to do this,” the lawyer explains. - Therefore, I advised to solve everything in the civil process.

Wheat did not listen to the lawyer. And soon, the "new" sources in the company told the police, turned to the police. In April 2017, our source recalls, Petrov was arrested. He sat in the isolator until August, then he was suddenly softened by the preventive measure to house arrest, and in November - even before the subscription about the wizard. Four months in a pre -trial detention center, apparently, they had a great effect on Petrov. As stated in the case, he “fully promotes the investigation authorities”, “exposes the accomplices in the commission of a crime” and “directly indicates” the new defendants.

In December, the investigation opened a second criminal case of fraud.

The defendants were those to whom Petrov gave “complete and consistent testimonies”: the ex -husband of his beloved woman and a longtime partner, who had previously taken him to a pre -trial detention center.

We cannot completely exclude that wheat and Emelychenkov participated in the embezzlement of defense money. But in the materials of the case, at the disposal of the “new”, there are only links to one proof: Petrov’s words, who he said after four months in prison.

The appearance of the second case in the same facts tells the likely tactics of the investigation. Apparently, the calculation was that Petrov, who pleaded guilty, would agree to a deal, and he would be condemned in a special manner: without a judicial investigation, the presentation of evidence, debate and other unnecessary tinsel, but only on the basis of recognition. In exchange for "complete and consistent testimonies" he will receive a punishment "below the lower limit." After that, the guilt of the accomplices can not be proven. They will go to the prejudice zone - in connection with the circumstances proved in court earlier.

This is a standard scenario. It allows you to plant people without bothering to prove their guilt. The main thing in this scenario is to carefully withstand the accused in jail.
