The investigation asked to extend the period of detention of the former secretary of the St. Petersburg court and member of United Russia, Alexander Eyvazov, accused of obstruction of justice (Part 3 of Article 294 of the Criminal Code) and defamation of a judge (Article 298 of the Criminal Code), the human rights association “Team” told Mediazona 29".
A message on the organization’s website states that Eyvazov has been in pre-trial detention for six months. According to Article 109 of the Code of Criminal Procedure, a preventive measure can be extended for a period of more than six months at the preliminary investigation stage only in cases of serious or especially serious crimes - Eyvazov is accused only of crimes of minor and medium gravity.
“This means that Eyvazov must be released from custody after 6 months—until February 22,” Team 29 emphasizes.
The meeting to extend the preventive measure for Alexander Eyvazov will take place on February 19 in the Leninsky District Court of St. Petersburg.
In the fall of 2017, the former court secretary was detained in Sochi. According to investigators, “due to personal hostility towards the judge, wanting to cancel the verdict,” he did not make or sign part of the minutes of the meeting at the trial of municipal deputy Timofey Kungurov, accused of attempted fraud. Eyvazov himself claims that in mid-January 2016, two police officers and the deputy chairman of the Oktyabrsky District Court, Elvira Vaitekunas, burst into his apartment and demanded that he retroactively sign one of the protocols of the court hearing - he went on sick leave and resigned before the end of the trial.
According to Eyvazov, judge Irina Kerro made a decision without a protocol. He refused to sign the protocols. In February, Eyvazov’s defense reported that they had found documents in the case with signs of falsification.
