Judge of the Moscow City Court Igor Alisov refused to satisfy the request of the prosecutor's office to extend the house arrest of the ex-head of "RUSNANO" Leonid Melamed and the former financial director of the organization Svyatoslav Ponurov accused of embezzlement.
"The court did not speak out at our request to extend the preventive measure that expires today. It turns out that they will be released," the prosecutor said. According to lawyers, Melamed and Ponurov will be released from house arrest by the upcoming night.
Judge Alisov also refused to satisfy the prosecutor’s submission to the court decision on the return of the criminal case by the criminal case Melamed and Ponurov. "The decision of the Cheryomushkinsky court of Moscow on the return of the criminal case to the prosecutor general in relation to the accused Melamed and Ponurov to be left unchanged, and the appeal representation of the prosecutor’s office is not satisfied," the judge announced the decision.
On December 8, 2017, the Cheremushkinsky court of Moscow, after several months of consideration of the case, returned it to the prosecutor due to gross violations and contradictions that impede the proceedings on the merits.
In July 2015, it became known about the case against the top managers of Rusnano . Melamed and Ponurov Part 4 of Article 160 of the Criminal Code (embezzlement of entrusted property on an especially large scale using an official position), which provides for up to 10 years of the colony. The same accusation was in absentia to the third person involved in the case - the former deputy chairman of the board of the state corporation Andrei Malyshev, who disappeared abroad.
According to the plot of the case, in 2008, Ponurov, who headed the Rusnano tender committee, ensured a victory in the competition of the Alemar consulting company, whose co -owner was Melamed. The service was signed by Malyshev. Alemaru was paid 220 million rubles, however, approved in the case, this company did not complete the work for which it was hired, and submitted the re -registered investment projects in violation of the deadlines. Thus, according to the investigation, Rusnano caused damage totaling more than 220 million rubles.
At the same time, Rusnano itself stated that the state corporation did not suffer damage, and the actions of top managers were legal. The state corporations expressed the hope that accusations from Melamed, Ponurov and Malyshev would be removed.
On May 11, 2017 , Melamed was released from house arrest , and Ponurov, from a pre -trial detention center. This was explained by the fact that the Prosecutor General returned the case for the investigation, and the marginal terms of pre -trial deprivation of the accused of freedom expired.
However, on the same day, Prosecutor General Yuri Chaika abolished the decision of his deputy Viktor Grin to return the embezzlement case to Rusnano for investigation. The head of the supervisory authority personally approved the indictment in the case and sent him to court. On May 22, the Cheremushkinsky court of Moscow refused to terminate the case and again sent Melamed and Ponurov under house arrest.
