Judge of the Primorsky Chief of Cradual Yevgeny Gavrilov satisfied the petition of the prosecutor Lina Chernyavskaya for the arrest of Vadim Kovtun, the last person involved in the case of the Primorsky partisans, who remained at large. It is reported by Primamedia.
Kovtun was taken into custody in the courtroom. He was sent under arrest until July 16.
The defendant was under the subscription about the loss after an excuse in 2016.
As the Primorsky partisans.info, the FB page, was specified , on Tuesday Kovtun handed over to the relatives of drug dealers, whose murder was charged with the defendants in the case, 10 thousand rubles each. “I do not admit my guilt, but I consider it necessary to compensate for the moral harm to the victim. At least partially,” he explained.
The prosecutor Chernyavskaya filed a request for the arrest of Kovtun the day before. What she motivated the need to tighten his preventive measure was not reported.
Previously, in addition to Kovtun, under the non -departure, another person was also contained, justified by the results of the previous trial, Alexei Nikitin. However, in mid -March, Judge Gavrilov sent Nikitin to a pre -trial detention center . He stated that the accused persuaded his wife not to let the bailiffs into the house when they would come to deliver her for interrogation. Meanwhile, the Nikitins have a three -month -old child, and his wife has no one to leave with him.
From Monday, the discussion of the indictment verdict, issued by the jurors on April 10, has been continuing. All defendants were declared guilty of the murder of four drug dealers, and Nikitin was also in participation in an organized criminal group.
The collegium, however, recognized all the defendants with deserving. This means that life sentences can not be adopted to none of them.
Meanwhile, the defendants themselves, speaking on April 3 with the last word, announced their innocence and indicated the assessors to inconsistencies in the case.
The discussion of the consequences of the verdict will continue next week.
In the current process, only one episode of the case is considered. This is the murder of four drug dealers - Dmitry Makarenko, Vladimir Ponomarenko, Alexei Solovyov and Viktor Naumenko - committed in September 2009 in the Kirovsky district of Primorye. The Supreme Court first abolished the accusatory, and then an acquittal of this episode. The verdict on other episodes entered into force.
Nikitin and Vadim Kovtun, which other episodes were not charged, were released after the acquittal of the verdict, issued according to the results of the second process. They took them from a non-departure on February 16, 2017 after preliminary hearings as part of the third proceedings.
The remaining three of the accused - Alexander Kovtun (younger brother Vadim), Vladimir Ilyutikov and Maxim Kirillov - have remained in the pre -trial detention center since 2010, since they had previously received deadlines for other episodes and the verdict was confirmed in terms of these episodes.
The sixth person involved in the case - Roman Savchenko - the murder of drug dealers was not charged. The proceedings against him have been completed, and since the fall of 2015 it has been contained in LIU -1 in Barnaul - the FSINA hospital for alcoholics, drug addicts and convicts with tuberculosis and AIDS.
The first verdict in the case of the partisans was issued on April 28, 2014 , the Judgment of the Primorsky Kraisud Dmitry Grishchenko - also on the basis of the jury verdict. Kovtun Jr., Ilyutikov and Nikitin were sentenced to life sentences, Savchenko - to 25 years of strict regime, Kirillov - to 22 years, and Kovtun Sr. - by 8 years 2 months of a strict regime.
However, on May 21, 2015, the Supreme Court canceled the sentences regarding the episode of the murder of drug addicts and sent this episode for a new consideration. Accordingly, the deadlines were reduced: Kovtunu -Jr. - up to 25 years of strict regime, Ilyutikov and Savchenko - up to 24 years old, Kirillov - up to 19 years.
On July 20, 2016, the jury, following the results of a second consideration of the episode , issued an acquittal verdict to all the defendants. The assessors with seven votes against five found the crime event unproven. On July 28, Judge Marina Karakuyan announced the acquittal to the defendants.
However, the prosecutor Andrei Cambolin, who supported the charge in both the first and second processes, appealed the sentence in the Armed Forces , referring to a number of procedural violations. Meanwhile, the seizure by the judge Karakuyan from the case of the confession of the defendants was completely legal, since the investigation received these testimonies with a violation of the Code of Criminal Procedure. Regarding the inclusion in the college of citizens who, by law, could not be jury, the lawyers of the defendants noted that they participated in the process at the direction of Camboline himself. This was explained by the defenders, the usual trick of the prosecutor's office, used in case the verdict is required.
Despite the objections of the defense, on December 26, 2016 , the acquittal of the defendants in the case was canceled .
