The Moscow Regional Court moved to the stage of additions in the case of members of the GTA, who are accused of a series of murders of drivers on the M4 Don highway. According to the lawyers of the defendants, the debate of the parties will begin no earlier than mid -May. The court completed the consideration of all 15 episodes of crimes - 17 murders, illegal turnover of weapons and participation in the gang. At the very end of the process, one of the accused Khazrathon Dodokhonov refused to testify and now completely ignores any appeals of the judge. According to experts, so he is trying to simulate a mental disorder.
Currently, Five - Zafarjon Gulyamov, Khazrathon Dodokhonov, Sherjon Kodirov, Anvar Ulugmuradov, Umar Khasanov are currently in the case. The remaining four accused - Abdumukim Mamadchonov, Mirzomavlon Mirzosharipov, Kholikov and Fazlitin Hasanov - died after trying to escape from the court in August last year.
According to the investigation, in March 2012, Ibaidullo Subkhanov (liquidated during the detention - A.K. ) created an armed gang in the Moscow Region to commit robberies. The group members underwent hand -to -hand combat training, studied shooting and conspiracy. They made attacks mainly in the south of the Moscow Region. Putting the spikes on the road, they waited for the car to stop on the side of the road, they shot people, then they searched and robbed vehicles.
At one of the last meetings, Judge Natalia Valikova announced the results of a repeated psychological and psychiatric examination on the accused Khazrathon Dodokhonov. The fact is that in March, during the hearing, he suddenly stopped communicating with a lawyer, did not react to questions from the judge, and at the interrogations of other accused sat indifferently with a crooked smile on his face and looked at the floor.
On August 1, 2017, Dodokhonov, along with other four accused Mamadchonov, Mirzosharipov, Subkhanov and Fazlitdin Khasanov, tried to escape from the court. They attacked the escorts in the elevator during movement and arranged a shootout in the building of the Moscow Regional Council. As a result of an unsuccessful attempt to escape, only Dodokhonov survived. A criminal case was opened against him under Part 3 of Art. 313 (escape from custody), paragraph "b" of Part 4 of Art. 226 (theft of weapons with violence) and part 2 of Art. 317 of the Criminal Code (an encroachment on the life of a law enforcement officer).
An employee of the convoy service said that on the day of the attack, the defendants in the elevator “talked among themselves in their own language, at some point one of them said a word that sounds like a team, after which they began to beat a convoy, while the phrases sounded in Russian:“ We have nothing to lose, we will shoot everyone. Allah Akbar! "
During the interrogation of the investigator, Dodokhonov said that he did not participate in the attack on the convoy, he was ordered to leave the elevator first, he felt that he was injured and immediately lost consciousness. Later, he completely refused to testify to the investigation, explaining that due to headaches, he could no longer perceive the Russian language. Subsequently, he talked with the investigator only through the translator. Although the case file states that he read them "fluently and made comments in the documents in Russian."
For more than a month, Dodokhonov was in the hospital with a diagnosis of open traumatic brain injury, blind gunshot wound to the head and cerebral edema.
In the conclusion of the last psychological and psychiatric examination, which was carried out at the request of the judge, it is indicated that being in custody, Dodokhonov complained about headache, anxiety, nervousness. He was diagnosed with neurosis. Repeatedly in the pre -trial detention center he made violations of the internal routine, conflict with cellmates, was registered as a person prone to escape.
Since January 2018, Dodkhonov stopped contacting the pre -trial detention center, during the conversation he made a half -smile and ignored the claims of the convoy. According to experts from the Serbian Institute, during the examination, Dodokhonov resisted the examination of a neurologist, refused to communicate with a psychiatrist, smiled demonstratively, gritted his teeth, pretended that he could not use a spoon, refused to take food. Along with this, being in a cell alone, he watched himself, washed his things, cleaned up, his face took a natural look. Experts found that at present the defendant does not suffer from any mental disorder.
Dodokhonov does not need compulsory treatment, and "grimace, refusal to come into contact is administrative, such behavior should be regarded as a simulation of the disease."
“I ask Dodokhonov to get up,” the judge asked once again, but the defendant did not budge.
The translator translated the request of the judge.
- Dodokhonov, you are an adequate person. Experts said that you are simulating the disease. I now suggest you testify.
However, Dodokhonov continued to be silent, looked in front of him, slowly opening his eyes.
- We fix in the protocol that the defendant does not answer. The court regards this as a refusal to testify.
The prosecutor’s office requested to read out the testimony of Dodokhonov, which he gave at the preliminary investigation according to the last episode - “Participation in the gang”. Lawyers opposed this proposal, but the court supported the position of the prosecution. All this time, the defendant lay on a bench, closing his head with his hands.
According to Dodokhonov’s testimony, in 2007 he came to Russia from Tajikistan to work. In June 2013, he met with two participants in the gang, Murod Karimov, nicknamed “Man” and Abdumukim Mamajonov. Then they brought him to the leader of the gang Ibaidullo Subkhanov in a car service in the suburbs, almost immediately he was given the nickname Palon.
“During the first acquaintance, I found out that they attacked the African American and stole about 75 thousand rubles from him. Rustam then forbade robbing in Moscow because they could calculate us on video surveillance cameras, ”Dodokhonov added during interrogation.
He admitted that he took part in four attacks, played the role of a gang driver. He drove in Ibaidullo cars, which had Opel, Volkswagen Passat and Hyundai. The leader of the group left most of the loot money, as Dodokhonov explained to the investigation, he transferred this amount to Pakistan because "Muslims need to help." What this help was, the defendant did not specify.
In the car service, Ibaidullo forced everyone to read the prayer five times a day, told the subtleties of Islam. According to Dodokhonov’s observations, their leader always went to his jacket, watched himself. He scolded them that "gang members dressed like migrant workers, but should look solid."
According to Dodkhonov, no one in the gang knew where Ibaidullo got the weapon, if they asked him about something, then he was angry and refused to answer.
“Rustam is an authoritative person for my fellow countrymen and could help in everything,” Dodokhon said during interrogation.
Men -to -hand combat and shooting from weapons took place in a private house. The gang members, according to Dodokhonov, did not know where this house was located, at the entrance to the site they blindfolded with a medical bandage. For a week they learned to aim, collect and disassemble weapons, use self -defense techniques and studied conspiracy. To teach shooting from pistols, they specially went into the forest and shot at paper targets. Ibaidullo demanded that all the gang participants have several phones and regularly change the SIM card. As Dodokhonov said in the investigation, he bought a SIM card at the Savelovsky station, sometimes he took several cards at once without presenting a passport. Ibaidullo told them that training is carried out so that they could fight against the enemies of Uzbekistan. Although other accused during interrogation said that they were preparing for a military coup in the republic.
“I think that not all voluntarily were participants in the gang, Ibaidullo was afraid, he could kill any of us,” Dodkhonov explained at the investigation.
In June 2014, a split occurred in the gang, Dodokhonov and other group participants told Ibaidullo that they no longer wanted to make robberies and intend to leave. Subkhanov was anger, but in the end he released everyone. Dodokhonov returned to Novosibirsk to his family, the rest of the gang also left for relatives and friends, where specifically the accused could not clarify the investigation. In November of the same year, Dodokhonov was detained by law enforcement officers.
After the study of all the case materials, 15 episodes, the court moved to the stage of additions. On May 3, the prosecutor's office intends to present additional materials. Also, relatives of the defendants will be called to the court, who will give a personal characteristic of the accused.
