Judge of the Basmann District Court of Moscow Arthur Karpov arrested Mikhail Ustyantsev - the defendant of the Aum Sinrikyo case until June 12. About the decision made on Thursday, then Interfax said .
Part 1, 2 of Article 205.4 of the Criminal Code (organization of activities of the terrorist community and participation in such) were imposed by Ustyantsev. The first of these norms provides for from 15 years to a life sentence, the second - from 5 to 10 years in a colony.
The case, which was arrested by Ustyantsev, was opened back in 2015 against “unidentified persons”, who, no later than 2011, formed in Moscow and St. Petersburg the “Aum Single-shaped association” in the form of a religious group, whose activities are associated with violence. ”
Why the case is still qualified under Article 205.4, not 205.5 of the Code, is not explained. As early as September 20, 2016, the Supreme Court banned Aum Sinrikyo , declaring it with a terrorist organization. In November of the same year, it became known that the FSB included this structure in the corresponding list . Persons accused of participating in organizations from this list are charged with article 205.5, while Article 205.4 is charged, if we are talking about structures in the list of absent.
In April 2016 , the Aum Sinrikyo case, which was qualified in part 1 of Article 239 of the Criminal Code (creation of an NPO that encroaching on the identity and rights of citizens) was already reported . This norm provides for up to four years in the colony. It was claimed that the followers of the organization held meetings in Moscow and St. Petersburg, from 2012 to 2014 collected donations via the Internet, and also exerted "physical and psychological pressure on citizens in order to obtain their property."
A day later, it turned out that about 30 residents of Moscow and St. Petersburg, detained on suspicion of belonging to Aum Sinrikyo, turned out to be only yoga lovers. All of them were freed without involvement as suspects .
However, in February of this year, the OTD-Info reported that some of the citizens detained during the then settings were later encountered persecutions. They were called for interrogations, terrorized and tortured.
Since the plots of this case and the case of Ustyantsev are similar, it can be assumed that we are talking about the same case, which, after the announcement of the Aum Sinrikyo, was re-qualified from the 239th article for article 205.4 of the Criminal Code.
Aum Sinrikyo is a syncretic sect founded by the Japanese Syko Asahara. She gained wide fame after a series of five terrorist attacks undertaken in the Tokyo metro on March 20, 1995. The sectarians sprayed Zarin there. As a result of the attacks, 13 people died and about 6 thousand were injured. Asahara and another 12 members of the sect were condemned to the death penalty; Sentences are still not executed. In total, 188 sectarians were brought on the charges of the case.
