Telegram continues to fight the FSB in the courts
Telegram lawyers appealed the decision of the Supreme Court of Russia, which refused to satisfy the claim to invalidate the order of the FSB, according to which the messenger must transfer user encryption keys to the department.
The complaint, in which Telegram representatives ask to completely cancel the decision of the RF Armed Forces of March 20, was filed with the Supreme Court of Appeal, Interfax reports .
According to Dmitry Kolbasin, a spokesman for the Agora human rights group, in an appeal, Telegram representatives ask “to recognize the FSB order of July 19, 2016 as invalid and inconsistent with five federal laws and the Code of Criminal Procedure of the Russian Federation.” The order was adopted by an unauthorized body in excess of authority; it establishes an extrajudicial way of obtaining control over the correspondence of an indefinite circle of persons; contains a wide margin of discretion for the law enforcer, threatening the safety of citizens.
On March 20, the Supreme Court of the Russian Federation refused to satisfy Telegram's claim and recognized the FSB's demands to provide encryption keys as legitimate. On April 13, the Tagansky Court of Moscow, at the request of Roskomnadzor, ruled to restrict access to Telegram.
