The ECHR awarded 12.5 thousand euros to a Muscovite whose children were held in Ingushetia by relatives of her ex-husband for several years

The European Court of Human Rights awarded compensation of 12.5 thousand euros to Leila Muruzheva, whose children were detained by her ex-husband’s relatives in Ingushetia for several years. The decision was published on the ECHR website.

In March 2014, Muruzheva officially divorced her husband and went to court to determine the place of residence of her two children - son Imran, 4.5 years old, and daughter Sofia, one and a half years old. In June 2014, the Izmailovsky District Court of Moscow ruled that the children should live with their mother.

In October 2014, the decision came into force, but the bailiffs in Ingushetia were still unable to pick up the children under various pretexts. The woman appealed to the ECHR. The court ruled that the bailiffs had not taken any preparatory measures to implement the court's decision and had violated Article 8 of the Human Rights Convention (the right to respect for private and family life).

“As a result, in two cases the children could not be returned forcibly, since they were outside the territory of Ingushetia, and in another two cases due to their emotional state. In addition, the court notes that the actions of the bailiffs during the attempt to return the children on April 16, 2015 were declared illegal by national courts,” the ECHR decision says.

“Mediazona” told the story of Leila Muruzheva, whose relationship with her husband, an FSKN employee originally from Ingushetia, deteriorated in 2014. Shortly before the divorce, the husband asked to take the children with him for the day, since his mother came to Moscow specially and wanted to meet her grandchildren.

The next day, Muruzheva came to her husband’s home and did not find the children there. As the woman said, for several months she tried to no avail to negotiate the return of the children, after which she filed for divorce and went to court. In September 2017, the woman was able to take her daughter; her son remained with her ex-husband’s relatives, contrary to the court’s decision.
