The Investigative Committee completed the checks on statements about the torture of the accused in the "case of the anti -fascists" Viktor Filinkov and the witness Ilya Kapustin. In both cases, the criminal case against the FSB officers was refused. According to their version, the stun gun was used to suppress attempts to escape and for the safety of the applicants themselves: they poked a couple times so that they would not be broken down, having thought of jumping out of the car on the move. And the remaining four dozen marks on the body of a witness - this bugs bit. Which, presumably, learned to move exclusively in pairs and marching no worse than the presidential regiment - strictly kept a distance of four centimeters.

Sabotage and destruction of evidence

Viktor Filinkov announced the beatings and torture of the FSB and the Leningrad region of the FSB and the Leningrad region on January 27, Ilya Kapustin - February 9.

Among the evidence that was to be requested during the audit, the defense called the certificate of the Filinkov medical examination when entering the SIZO-3 on trellis (with hematoma fixation, abrasions and damage to the skin-marked "electric shocker?"); Acts of visits and inspections of the members of the PMC (including those conducted in the presence of the institution of the institution). They also asked to seize and introduce Victor’s bloodied clothes (a hat that was entered the trellis, and the jeans that remained in the rented apartment after the search - when, according to Filinkov, the operatives ordered him to remove and put on others), as well as recordings of cameras and video recorders at Pulkovo Airport, where the actual detention was held in the evening of January 23; In the 54th police department, where the FSB officers brought it twice on the night on the 24th; And in the SIZO-3, where the examinations of Filinkov were recorded by the PMC members and other events.

But the month of the first check was launched-it was led by the deputy head of the military investigation department of the RF IC of the Russian Federation for the St. Petersburg garrison, Major Pavel Suchkov.

By March 20, the materials of this audit went to the Military Investigative Department of the SK for the Western Military District, for a new check. For another month, captain Sergey Valentov led it. And he came to the predictable conclusion: the FSB officers acted within the framework of the law, the criminal case was refused. Lawyer Vitaly Cherkasov appreciated the results of both checks as “frank sabotage and intentional inaction”, resulting in the “loss and destruction of evidence and evidence in the case”.

Pavel Sychkov generally ignored the defense of the defense to introduce videos from stationary cameras and DVR of the employee of the SIZO-3, who recorded the inspection and survey of Filinkov. Sergei Valentov made an appropriate request only after two months - and received the expected answer too: the records have already been destroyed, the established shelf life of their storage has come out. Although earlier, responding to the request of the window member Yana Teplitskaya, the head of the SIZO-3, Colonel S.V. Chabanyuk, reported: "The shelf life of video recordings is not regulated."

Filinkov did not drop on the trellis cap. And only on March 30-by the time, as another tenant, all the things of Victor, including the “something dark,” jeans, explained to his rented apartment-explained to his rented apartment-he threw it into the garbage tank.

Two conclusions are also attached to the decision to refuse to initiate a criminal case, dated March 6 and 2, a certain “specialist” in terms of medicine (without indicating the name), which stated: “it is not possible” to evaluate the damage caused by Filinkov more than a month ago. And as for the presented medical documents, they do not prove anything-because there are "no information about the morphological features of damage."

But the “specialist” easily shared a four -hour torture described by Victor (“at least 10 blows with a palm on the back of the head, at least 50 strokes by a stamp in the right thigh, inguinal region, breasts, wrists and neck, as well as at least 20 fists in the chest and back, back of the face”). Having unequivocally excluding that this was the case - for "the points of application of power and their number do not coincide with the anatomical arrangement of bodily harm."

Also, the “specialist” concludes that the acts of the PMC cannot be taken into account - they say, compiled by “ordinary language” and in general “are not medical documents”.

At the same time, the explanations of the FSB officers by the inspectors were accepted on faith. Everything recorded with their words is not doubted and substantiates Valentov’s conclusion that “Filinkov V.S. reported false information about the circumstances of the application of violence by him from the UFSB”.

The raven will not turn the eyes of the eye

According to the senior operative officer of the Federal Security Service of the Federal Security Service, K. A. Bondarev, in Pulkovo, the already registered and passport control of Filinkov agreed to refuse him to refuse to refuse and "take part in operational investigative events." After that, Bondarev with a colleague S.E. Filinkov, to use the physical impact on the FSB officer and an attempt to hide, as well as to prevent other consequences associated with the loss of a person from moving vehicles ... Twice applied to Filinkov a special remedy - an electric skill (1 time to the right thigh, 1 time to the area of ​​the trunk).”

For some reason, the story with an attempt to escape did not appear before, including at the hearing to election to Filinkov a preventive measure. And it arose only after the verification torture begun on his statement.

Then, probably, the plot of Ilya Kapustin’s escape was also the plot (he left Russia and asked for refuge in Finland). Explanations of the operatives in places seemed to be written under a carbon copy.

Kapustin, recall, was involved only as a witness. At the same time, the form of “invitation” to the dacha explained more reminiscent of a special operation to capture a particularly dangerous criminal. As Ilya stated in his statement, on January 25 at about 21.30 on the way to the house (rented housing on the 7th Sovetskaya, 18), several people in black masks and dark uniform attacked him from the back. They knocked to the ground and began to beat with their feet, after which they loaded it into a minibus with tinted glasses.

The abductors introduced themselves to the employees of the special services (which ones did not specify). After that, at least one of the employees stood on me, crushing me to the floor in the knees.

My body was exposed from the top of the abdomen to the middle of the hip and began to strike with electric shows of the electric shocker (turning me onto the left side), in the area of ​​the right side of the abdomen, the upper thigh and groin, as well as several times into the penis (in total at least 40 strokes were inflicted) ...

They asked about my friends and those people who I don’t know ... About three hours later, one of the abductors said that they could break my legs and throw me in the forest where no one would help me, they “asked me” a little more and then left me alone, after that the car rode for a long time (according to the sensations, half an hour) at high speed.

But we did not come to the forest, but to the FSB building, we stopped on Shpalelena Street and they took me to the investigator for interrogation. ”

According to Kapustin, during interrogation, some people entered the office-one of them (Ilya expressed his readiness to identify him) threatened torture with a continuation of torture. Having compiled a protocol of interrogation, they took a search of a rented apartment.

On the same day, Kapustin will take off his beatings in the city clinic No. 3. The doctor K. M. Saidov examined his doctor, who examined him in the certificate of the soft tissues of the face, nose, lower lip, both shoulder joints and the right half of the chest, as well as an “electric burner (surface) of the right half of the abdomen, the right hip and right inguinal region” and "Linear bruises of both radiant joints."

Three days later, Ilya will turn to the Bureau of the forensic medical examination, in the act of conducted examination the bruises of the upper eyelid will be described, in the area of ​​both shoulder and knee joints, abrasions of the upper extremities, abdomen, the right hip joint, the right minories and penis. And it will be concluded that these abrasions “could be formed from the action of an electric loading device (electric shocker), which is confirmed by their morphological features: mostly round or oval shape, sizes, the presence of rims of hyperemia (redness) around abrasions, reddish, swollen,“ lifted ”edges.”

Valentov, probably at some point, was bored with rewriting explanations from the materials of one check to another. I wanted to show a creative approach, so to speak.

A strange company visited the apartment, which Kapustin rented with a neighbor Diaz: an investigator of the military investigative department of the SK at the Pskov garrison Ivan Kabanets, a specialist in the city disinfection station Lyubov China, an employee of Rospotrebnadzor Anastasia Oloptseva and district police officer Arsen Magomedov. Lawyers representing the interests of Viktor Filinkov and Ilya Kapustin intend to appeal the decisions issued by Valentov to refuse to institute criminal proceedings and apply to the ECHR.
