In 2011, Rakhaev, a former employee of the Department of Own Security of the Ministry of Internal Affairs in the North Caucasus, was appointed head of the criminal investigation department of Cherkessk. Three weeks later, the detained Dzhankinov died in the department. The subordinates of Rakhaev testified to their new leader, and formulated the “circular alibi”: to themselves:
They, they say, before delivering the detainee to the department, although they spent all night with Dzhankinov at the stronghold, but they didn’t beat, but “watched him asleep.”
But on the records from the surveillance cameras it is clear that Dzhankyozov entered the beaten -haired department and moved hard. The examination found that the cause of death was a pain shock: ten ribs were broken by the man and the internal organs were repaired. And this happened no earlier than four hours before his death - that is, when Jankozov was with operatives at the stronghold.

The judge in the first process (it ended in 2013) was not embarrassed, and he sentenced Rakhaev to 13 years in the colony. For the Ruslan family, this decision did not have a big surprise. Even before the hearing began, the colleague of Rakhaev directly informed his relatives: Ruslan will be “cleaned up”, because in Cherkessk they fear that the former “specialist” will not allow local cops to engage in the usual crime.
In the Supreme Court of Karachay-Cherkessia, they figured out better and canceled the verdict. Rakhaev was sent on a recognizance not to leave, and the materials were sent to the investigation.
The second process began in 2015. Its tonality has not changed. It seemed to Rakhaev that Judge Rustam Ataev did not care about procedural violations, the destruction of evidence and investigative sabotage. Imagine:
Inspection of the stronghold, where the subordinates of Rakhaev allegedly beat the detained Dzhankyozov, was carried out eleven months after the events,
14 of the investigative actions were performed with the participation of the witness, who was the investigator of the cousin, and the investigation agreed to request the data of the telephone formations of Rakhaev and Dzhankoyzov in five years - when the shelf life expired.
At that time, Rakhaev came to the verdict with things, but Judge Ataev suddenly returned the case to the prosecutor's office. He drew attention to the kinship of the investigator and the witness, recognized the testimonies of the operatives inaccurate and even ventured that they themselves could be involved in the murder. Ataev’s decision stood in an appeal, but the deputy prosecutor of Karachay-Cherkessia Mikhail Shabunin filed a cassation performance, and the case was returned to the City Court, and without the demand to pretend-that is, in the same form.
The third process began a year ago. As before, Rakhaev was defended by lawyers hired by the Public Verdict human rights fund. We did not learn anything new about Russian justice for this year. Judge Rasul Izhaev refused to exclude from the case the protocols of investigative actions, to which investigator Ruslan Golubnichy attracted his brother Valery Golubnichy.
In addition to documentary evidence in favor of the accused, the circumstances of his detention are indicated. Rakhaev, who lay and watched the TV that evening, was taken as an action movie: the police cordoned off the entire district, the high -rise building surrounded the armored vehicles, the rest of the residents were expelled from the apartments. “I saw on the street how they followed me,” the ex-police told Novaya Gazeta. “They could have detained me without any problems at that time.” They did not need me alive. "
He was brewed the front door and began to break the ceiling to throw grenades. Relatives called all the acquaintances of the security forces. When Rakhaev was already thinking of jumping from the sixth floor, they stopped hammering-probably someone stood in time.
An application for a similar liquidation in the Caucasian republics may agree to a limited circle of high -ranking persons.
Perhaps one of them decided to use the death of the detainee to take revenge on Rakhaev in a fair service and non-participation in torture rare for the local latitudes.
“Lawyers call this matter an example that must be added to the textbooks for legal faces, so that they receive a full and clear sample of an illiterate and engaged investigation. I am sure that the participants of this, the third, in a row, the courts do not doubt me in my innocence, ”said Rakhaev at the meeting on May 24 (.pdf). Over the years of criminal prosecution, his wife and child left him, out of fear of the police he is not risked to hire, he is forced to live on his mother’s pension.
The prosecutor's office requires 13 years in prison for Rakhaev. The verdict will be announced on June 7.
