The head of Roskomnadzor intends to continue to break Runet

Alexander Zharov after a long silence, which lasted almost the entire period of intensive “carpet bombing” of IP addresses, finally began to give some comments-and they do not inspire optimism.

Speaking at the St. Petersburg International Forum, the head of Rosmkamnadzor, Alexander Zharov, finally violated the almost monthly vow of silence, making several statements that greatly surprised the Internet, their pretentiousness and some isolation from reality. In particular, Zharov quite optimistically appreciated the work of his department based on the results of the “carpet bombing of the IP addresses”, because of which, we recall, Runet's work was broken. Naturally, the actions of the selected “pursuit of Telegram” were not sounded - on the contrary, the actions of the RKN, Zharov, considers the confessions of the selected method of “pursuit of Telegram”.

The head of Roskomnadzor assures that the "degradation" of the messenger "is from 15% to 35-40% on various smartphones within a day." The outflow of advertising and users, according to Zharov, reaches 25%. Note, earlier, the M13 company, the creator of the Katyusha information and analytical system, which is used by the presidential administration to monitor social networks and the Internet, did not notice any “degradation” of Telegram.

Recall also, the data of the Telegram AnalyityCS service, a month after the Roskomnadzor by the decision of the Tagansky District Court of Moskvo, the losses of the popular Telegram messenger were incomparably smaller compared to the efforts attached by the supervisory authority, which led to noticeable failures in the work of Runet. The real decrease in activity in Russia was approximately 2%.

In addition, Alexander Zharov assured that large Internet companies stopped helping Telegram bypassing blocking. “The dialogue continues. Microsoft has ceased to provide Telegram with the opportunity to use the Microsoft Download configuration file, Google told us that the provision of Telegram IP addresses has been suspended. That is, the process is going on, ” said Zharov. It is worth noting that Alexander Alexandrovich has long taken the habit of making such statements that do not necessarily correspond to reality-after some time the head of the RKN word-word repeats the said previously said that his department is “in dialogue” with a particular company, which “is about to transfer the servers to Russia”, “will build the data centers”, “agree to take care of Telegram” etc.

According to Zharov, Telegram blocking is “the first experience of blocking not a site, but applications”, that “this is a process” and “interaction with international companies is also a process”, and RKN is “in constant contact”.

The theme of the Messenger created by Pavel Durov passes through the performances of the head of Roskomnadzor for the second day in a row. Today he announced the validity of the requirements for Telegram to provide encryption keys from user correspondence. The official called the Messenger’s philosophy “absolutely pirate,” since he has many illegal and extremist content. He added that there is irrefutable evidence, but which ones did not disclose which ones. It also does not specify what time period we are talking about.

“All the last terrorist acts that occurred in our country and abroad were coordinated through the Telegram messenger. Therefore, if you choose between comfort and safety, I personally choose security, ”said the head of the RKN.

But at the same time, neither Zharov himself nor the department guaranteed the safety of Internet resources, but even vice versa-they make an “invaluable contribution” to the process of violation of the work of hundreds and even thousands of sites, the owners of which suffer reputational and material losses, and millions of Russian citizens still experience a lot of inconvenience, abruptly plunged out of our time in the dociff, when they do not work, when they do not work Messengers, online cards, ticket services, cash desks, encyclopedias, training aids and other important services in our time.

According to Zharov, the founder of Telegram Pavel Durov acts as a pirate. Pirate, in his opinion, are all attempts to bypass the blocking of the messenger. VKontakte also went to piracy from Zharov: “Unfortunately, the philosophy of the creators of Telegram, as well as the creators of the VKontakte network, is in the absolutely pirate zone”, but also added that the situation with the VKontakte social network changed in the positive direction after the steps to legalize music and video under the control of Mailru Group were taken.

Talking about the struggle against piracy, Zharov assures-she allegedly contributed to the growth of the legal market of the online video. He brought TMT Consulting data, according to which the Russian market of online cinemas in 2017 increased by 60%, to 7.7 billion rubles, and the volume of a paying audience increased by 30%, to 2.6 million users.

In total, over the past year (April 2017-April 2018), Roskomnadzor received more than 1.6 thousand definitions of the Moscow City Court on the adoption of response measures in relation to about 4 thousand Internet resources that violate the legislation in the field of protection of exclusive rights. In this regard, access to 380 sites was limited, from the rest the pirate content was deleted. More than 900 pirate Internet resources are blocked on an ongoing basis.

As A. Zharov noted, the cross-border nature of violations of intellectual property rights in the digital environment dictates the need for close international cooperation between copyright holders, Internet companies, and regulator. At the same time, Roskomnadzor "considers his priority, first of all, the support and development of Russian markets."

His department does not leave an attempt to block Telegram in offers, first undertaken at the dawn of “carpet bombing”. “Roskomnadzor is conducting a dialogue with Google and Apple lawyers on the issue of deleting or restricting access to Telegram application in the company's online stores,” the head of the department said .

According to him, the lawyers of Roskomnadzor and companies "interpret the third point of the court decision differently, which suggests that Roskomnadzor and other legal entities must limit access to the application." Zharov said that Google and Apple do not want to admit themselves to “other persons”.

“They want a direct requirement for companies,” Zharov explained.

Alexander Alexandrovich returned to his favorite topic-promises to verify Facebook for the implementation of Russian laws (in particular, 242-ФЗ on the transfer of personal data of Russians to the Russian Federation), but so far the question of blocking the social network, according to him, is not worth it.

“Depending on the results of the audit, we can finish them, get legally significant documents from them when they intend to fulfill the laws of the Russian Federation. This is a process that will begin at the end of this year, ” said Zharov.

The head of the RKN noted that today the “sick theme” is the spread of inaccurate information in social networks. “False information is literally a scourge. Responsibility for fake news should be, but which, it requires discussion. Most often, such information spreads on social networks with encrypted traffic, ”said the head of Roskomnadzor.

He noted that it is impossible to block one account on Facebook, in this case, due to the features of its architecture, the entire social network is blocked. “Therefore, it is necessary to discuss other methods of censure - perhaps financial,” added Zharov.

In April, the State Duma adopted a bill in the first reading, introducing a fine of up to 50 million rubles for the refusal to delete the inaccurate and discrediting honor and dignity of information on social networks. The bill also equates social networks with the organizers of the dissemination of information (Ori) and implies quite serious sanctions in case of failure to fulfill it. The document imposes a number of responsibilities on the owners of social networks, such as the creation of a representative office in the Russian Federation, to delete inaccurate information described in the bill on demand, to comply with the appropriate prohibitions and restrictions during the election or holding referenda period, to establish a user calculation program that Roskomnadzor will indicate to them and so on.

Alexander Zharov, as we see, does not intend to bring any apologies for the clumsiness of his department, although not so much inevitable mistakes in the work are traced in the actions of the RKN, but the clearly manifested abuse of authority and violation of Russian legislation are already clearly manifested. Recall that the Internet Ombudsman Dmitry Marinichev said that the Prosecutor General’s Office should verify the legality of the actions of Roskomnadzor. Also, a lawsuit of 5 million rubles was filed with the “IP bombardment” by the “IP bombing”, which was left without movement until June 7, the AGORA human rights organization has previously filed a number of lawsuits, and, in addition to Roskomovoboda, appealed to business and ordinary users with a proposal to complain about the actions of the RKN to the relevant authorities. The blocking of the messenger and Roskomvoboda and Agora is also disputed, and the latter filed a complaint with the European Court of Human Rights (ECHR), where it was registered less than two weeks ago.
