
The collegium of the North Caucasus District Military Court (Rostov-on-Don), chaired by Roman Saprunova, sentenced Badruddy Daudov to 14 years in general regime without a fine in the case of the participation of the Shamil Basayev detachment in Budennovsk in 1995. It is reported by Interfax-South.
The 46-year-old Daudov, a native of the Chechen village of Nohia-Yurt, was announced guilty under part 2 of Article 126.1 of the Criminal Code of the RSFSR (hostage capture, which entailed grave consequences), as well as part 2 of article 209 (participation in the gang) and part 3 of Article 205 of the Criminal Code of the Russian Federation (probably refers to the item "B" of this part, which entailed intentional infliction of death to a person).
In the debate of the parties that passed on June 8, the prosecutor requested 15 years of general regime for the defendant .
In turn, Daudov’s lawyer, by agreement, Alexander Gurov demanded to justify his client or at least stop his persecution on an non -rehabilitating basis - the expiration of the statute of limitations. He pointed out that the accusation is largely based on the testimony of secret witnesses, who claimed that they saw Daudov in Budennovsk during the attack. Meanwhile, Gurov recalled, he presented in the process of evidence that during this attack the defendant lived in the village of Shelkovskaya and worked there a line master at a power plant.
Daudov himself, after the arrest in October 2015, also stated that he lived in Silkovskaya as a refugee .
Alibi Daudova, Gurov emphasized, is confirmed by the testimony of 48 witnesses. Meanwhile, witnesses of the accusations in their testimony diverge to the mass of details, including in the description of the appearance of the defendant, as well as the clothes that he allegedly wore in Budennovsk.
Gurov also indicated that five witnesses previously convicted in the case of a raid to Budennovsk: Khabaev, Vasaitov, Dudushev, Taimashanov, as well as Askhab Mutalibov , said that they did not know the defendant and he did not participate in the attack with them.
In any case, Gurov concluded, the statute of limitations of the persecution of Daudov - for such accusations he is 15 years - expired in June 2010. The lawyer noted that the statute of limitations may not be applied if the accused was hiding from the investigation. However, Daudov lived completely openly, had a permanent place of residence, work and family.
In turn, as an appointment, Julia Redkin noted in her speech that the key witnesses of the accusations - Oksana Kurilova, Vyacheslav Voronkov and the classified witness under the pseudonym Pliev - were testified for several months in the process in another similar case, the accused of which were a mechanic Ramzan Belyalov and the driver Magomed Mazdaev. In December 2017, they received 15 and 13 years of general regime. In April of this year, the Supreme Court reduced the term of the 60th Belyalov by three months, and 42-year-old Mazdaev-by two.
Daudov himself never pleaded guilty. In the last word, he noted that none of the many photos and videos from Budennovsk has his image.
After the sentence was announced, the lawyer Redkin assured Interfax-Yug that the decision would be appealed.
Judge Saprunov, who was presiding in the collegium in the Daudov case, previously participated in the convictions of the Crimean prisoner Alexei Chirnia , a resident of Dagestan Abdurahmanov , the Makhachkala activist Hiramagomeda Magomedov , a citizen of Ukraine Alexei Sizonovich , accused of preparing the terrorist attack in Rostov Ukrainian Arthur Panov and local resident Maxim Smuslyaev , resident of Nalchik Alim Sultanov .
Daudov was detained on October 5, 2015 in the Istra district of the Moscow Region, where he constantly lived at that time. Two days later, on the 7th, the Essentuk City Court of Stavropol sent the detainee to the pre-trial detention center.
The case was received by the case on December 20, 2017. The process took more than 20 meetings.
The Chechen Ombudsman Nurdi Nukhazhiev previously opposed Daudov, indicating that his persecution is illegal. Before that, he made a similar statement in connection with the arrest of Belyalov. Nevertheless, representatives of Nukhazhiev did not appear at the Daudov’s debate on June 8.
On July 31 of last year, information appeared that another alleged participant in the raid on Budennovsk was detained in Grozny. His name was not revealed. It was reported that, unlike Belyalov, Mazdaev and Daudov, the detainee gave a confession.
On June 14, 1995, the Chechen detachment under the command of Shamil Basayev penetrated the city of Budennovsk at Stavropol and captured a number of buildings, including a city hospital. About 2 thousand citizens were hostage. 129 people died from the actions of the attackers, including nine children. Another 317 people were injured.
The Russian Prime Minister Viktor Chernomyrdin joined in negotiations with Basayev. An agreement was reached on the end of the war in Chechnya and the withdrawal of Russian troops from the country. On June 19, the attackers released the hostages and without hindrance returned to their homeland.
