
The Supreme Court of the Chechen Republic rejected the complaints of defense of the head of the Grozny “memorial” Oyub Titiev to extend the arrest and the refusal to initiate the case against the police who detained Titiev. Titiev, who is accused of storing drugs (Article 228 of the Criminal Code), says that the drugs were thrown by the police during the detention. His lawyers submitted an application for a crime committed by police officers, but the criminal case was refused.
At the court hearing, which took place on June 25 and 26, Titiev stated that the audit on the fact of a possible crime was carried out “by 5%”. The prosecutor's office mentions the response of the police who were related to the second detention, and the drugs Titiev, according to him, were thrown during the first. However, the court sided with the prosecutor's office and approved the decision to refuse to initiate the case on the police.
At the same time, the judge refused to introduce the decision of the Human Rights Council under the President (HRC), which states that the test on the application of Titiev was carried out inappropriately. Lawyers of the HRC decided that the investigation did not check the circumstances, the establishment of which could lead to the conclusion about the falsification of the case. For example, the investigator refused to withdraw videos from surveillance cameras, referring to their malfunction. In addition, the investigation was not examined by other camcorders, which were on the buildings neighboring from the road, did not seek eyewitnesses to the police examination by the Titieva car. The HRC also believes that the investigation conducted a check for too long.
In addition, the court rejected the arrest of Titiev before July 9. The human rights activist will remain in custody.
