The FSB General Feoktistov demands to return a bribe to him, because of which they planted Ulyukaev. Stop, but the money extorted money from Sechin?!

On June 29, the Zamoskvoretsky court of Moscow will consider the statement of the former head of the Rosneft Security Service, General of the FSB Oleg Feoktistov. He demands to return to him two million dollars, which on November 14, 2016 were transferred to Alexei Ulyukaev as a bribe as part of an operational experiment (the former minister was sentenced to eight years of strict regime). But, based on the case file, he demanded the money from Igor Sechin, and it was the head of Rosneft that handed him a bag with two million - so it is not immediately clear what the Feoktists have to do with it. Why does Feoktistov be returned to the money, although the head of Rosneft Igor Sechin reported a bag with two million dollars to Ulyukaev?

It was Oleg Feoktistov, who in 2016 headed the Rosneft security service, who found two million dollars for an operational experiment. During interrogation in court, he stated that he took money from a "good friend, private investor."

What is the question then? Why just not return the money to Feoktistov?

Because it is not very clear how legal it is. Just two weeks before the court hearing, which should decide whether it is necessary to return the money to Feoktistov, the Plenum of the Supreme Court explained how to do in such cases. The essence is about this:

1. Money can be returned only to their owner.
2. Money can be returned only if the owner himself informed the bodies that they extort a bribe from him.

With the second point at Feoktistov, everything is in order. It was he who wrote a statement addressed to the director of the FSB Alexander Bortnikov that Ulyukaev was asking Sechin's money. Sechin himself added only one phrase to the document: “Given the foregoing, we consent to participate in operational events.”

But Feoktistov has not yet confirmed that it was he - the owner of two million dollars who transferred to Ulyukaev. The lawyers of the former minister said on the process that there were no such documents.

Why can't this money give the most “good acquaintance” of Feoktistov? After all, he is the owner!

There are difficulties with the second point - after all, these are Feoktists, and not his “good acquaintance” was informed by the FSB of extortion. Judging by the testimony of Feoktistov published in the press (the interrogation was held closed), the “private investor” did not even know why he gave two million dollars.

So will Feoktistov give money or not?

It all depends on whether the Feoktists will present documents confirming that it is he is the owner of the money. Probably, this should be some kind of agreement between Feoktistov and his acquaintance.

And if they are not given? Where will this money go?

To the budget of Russia. Unless, of course, they are lost, this sometimes happens. In May, when recalling the money seized from Colonel Dmitry Zakharchenko, five million dollars disappeared . And in the fall of 2017, 50 million rubles disappeared in the Investigative Department of the Ministry of Internal Affairs - they were a material evolutionary in the case of theft in a special construction.
