
The Russian State Duma adopted in the second, mainly reading amendments to the Civil Code on the responsibility of persons who have seized other people's property. The bill, in particular, obliges car hijackers to compensate for the damage for damage to vehicles.
"A person who is unlawfully seized someone else's property, who was damaged or lost due to the actions of another person acting independently of the first, is responsible for the harm caused. This rule does not exempt from compensation for damage to the direct causer of harm," the document says.
This norm, according to the authors of the bill, will make it possible to submit requirements for compensation for harm caused to other people's property, to the person who created the conditions for damage, TASS reports. “This is especially important when the direct damage to the damage was not established. For example, in the event of the car theft and its subsequent damage,” explained Pavel Krasheninnikov, head of the relevant committee on state building and legislation.
“If the crime was committed by a group of persons, but the fact of damage to the car was not proved precisely with a stolen face, and other persons were not established by the investigation. Or if the person, having stolen the car, threw him on the sidelines, and the car left the car, in such cases, according to the bill, the hijacker will be compensated,” the deputy added.
Recall that the Constitutional Court of the Russian Federation drew attention to the existing contradiction in the laws in 2015, which recognized the number of provisions of the Civil Code of the Russian Federation and the Criminal Code of the Russian Federation to the extent that these provisions in their normative unity did not allow compensation for the guilty of property by a person of property damage.
As a result, a bill was developed that supplemented the Civil Code. Thus, the car hijacker will respond to the owner even in case of its repeated theft. If the person who has committed repeated theft of property will be established, then the damage should be compensated by the one who was the first to commit an offense and compensated the damage directly to the owner.
