The lawsuit will begin to be considered on July 11 in the 242nd court of the Nagatinsky Zaton district. This unit of the Ministry of Internal Affairs sent a request to compensate for the damage only to Sergey Udaltsov, Leonid Razvoszhaev, Ilya Gushchin, Elena Kokhtareva, Alexander Margolin and Alexei Gaskarov. There is a text of the statement of claim at the disposal of the ATS . It does not mention other convicts in the “swamp business” - there are more than thirty of them - and it does not explain why the lawsuit was filed right now.
OVD-Info failed to get through to the press service of the Department of Transport of the Ministry of Internal Affairs for the Central Federal District. For the previously convicts on the “swamp case”, the lawsuit was a surprise.
Alexey Gaskarov told the OVD-Info that he did not know the details of the situation yet. He notes that the process was on six people who were filed a lawsuit in the framework of the “swamp case” later passed later most of the others. And thus, "closer to the statute of limitations."
However, Gaskarov assumes that with the statute of limitations this claim is clearly not everything in order. It is also unclear why it is precisely these six convicts that should be responsible for five sticks and two radio stations.
Leonid Razvoszhaev does not exclude that this claim will be followed by claims from other structures that were, according to the court sentence, damage on May 6. Razvoszhaev assumes that this was directed against him and Sergei Udaltsov - in order to neutralize their political activity and, possibly, make a disorder from Russia. After the liberation of the daring and the Razvozhaev returned to the “Left Front”.
The total damage from the clashes on May 6, recorded in the "Swamp business", is 28 million rubles. Of these, several hundred thousand rubles falls on the equipment and special equipment of law enforcement officers, and the main damage is recorded for the Asphalt allegedly spoiled at the site of the confrontation and the police.
Sergei Udaltsov noted in a conversation with the OVD-info , which did not exclude such actions of law enforcement officers. By education, Udaltsov is a lawyer, he specifically calculated when the deadline for a possible filing of a claim for compensation for damage in his case would end.
The Supreme Court approved the verdict Udaltsov and Razvozhaev on March 18, 2015. Thus, a civil lawsuit against the leaders of the “Left Front” could be filed until March 2018. Udaltsov says that in May 2018 he appealed to the Investigative Committee with a request to return the property that was seized during the investigation. These are the cars of Udaltsov and Razvoszhaev, as well as 140 thousand rubles seized from Udaltsov. (According to the OVD-Info , the car has not yet been returned to Margolin).
He believes that the current lawsuit is a reaction of the Investigative Committee to his demand, a way to tighten the return of cars and money. At the same time, Udaltsov does not exclude that the statute of limitations could be observed. The paper sent by the “swamps” is called the “updated claim”. That is, perhaps there was a certain “initial” statement: either submitted on time, or recorded retroactively in March 2018.
The coordinator of Rus Sitting Sergey Sharov-Delon in a court in the “Swamp case” was a public defender of Andrei Barabanov, one of the defendants in the case. Sharov-Delone explained to the OVD-Info that 28 millionaire damage was recorded during the “Twelve case”, according to which the drums passed one of the defendants. In the affairs of those who were judged later, this amount was transferred automatically.
Sharov-Delon emphasizes that in the verdict in the “Twelve case” 28 millionth damage was designated as one of the signs that allowed the article “Mass riots”. At the same time, the court noted that organizations that are damaged can recover this money through civil lawsuits.
According to Sharov-Velon , no one wanted to collect damage in 2012-2014, because there were a lot of questions to this amount. For allegedly spoiled asphalt, public utilities could not provide almost any documents. With the lost property of police officers, the problem was that units that had lost their proper accounting during the confrontation with citizens of clubs, helmets or walkie -talkies.
The lost objects were previously issued by the police and stored in their personal cabinets along with the uniform. Inventory in police units, which were on Bolotnaya Square on May 6, 2012, did not spend from three years to six months before clashes. Thus, it is virtually impossible to prove that all this lost precisely in the square.
