The main person involved in the first Sevastopol case Hizb Ut-Tahrir Ruslan Zeitullaev, who was serving a 15-year term in the Bashkir IK-2 in Salavat, refused to testify against Enver Seitosmanov, arrested in the third Sevastopol case of the International Islamic Party. This evening, on Tuesday, journalist Anton Naumluk, citing Emil Kurbedinov, lawyer Zeitullaev, informed his FB page.
The security forces from the Bashkir UFSB tried to interrogate the Politzek, who received the relevant order from the Crimean headquarters of the special services. In case of refusal to testify to Zeitullaev, they threatened the initiation of the case under Article 308 of the Russian Criminal Code (the witness’s refusal to testify), which provides for up to three months of arrest. However, the political prisoner did not succumb to threats. He substantiated his refusal with a reference to Article 51 of the Constitution of Russia.
Article 51 admits the right not to testify only against himself and the closest relatives. However, Kurbedinov noted that the FSB calls Seitosmanov a member of the same cell Hizb Ut-Tahrir, who was supposedly led by Zeitullaev. Therefore, the lawyer continued, the testimony against Seitosmanov would indirectly affect Zeitullaev himself (as well as Rustem Vaitov, Nuri Primov and Ferat Saifullaeva convicted with him). Thus, the Politzeck link to the 51st article is legally fully justified, Kurbedinov concluded.
Zeytullaev’s refusal to testify was recorded by witnesses. Politsyk himself did not sign any papers.
The lawyer was not invited to participate in interrogation.
The 33 -year -old Zeytullaev - a worker worker from the village of Orliny (Baydar) within Sevastopol - has been in prison since January 2015. He was convicted under part 1 of Article 205.5 of the Russian Criminal Code (organization of activities of a terrorist organization). According to the plot of the case, after the annexation of Crimea, Zeytullaev organized in Sevastopol the Hizb Ut-Tairer cell for the creation in the city of Crimean Vilayat as an administrative unit of the World Caliphate.
Neither Zeitullaev, nor other defendants in the case, who received 5 years of the general regime under part 2 of Article 205.5 of the Code (participation in the activities of a terrorist organization) did not find guilty.
Since April last year, Zeytullaev himself kept a hunger strike three times in a pre -trial detention center.
The arrival of Politzek in IK-2 in Salavat became known in September 2017. In April of this year, it was reported that the FSINITS sent ZETULLAEV to the schizo , accusing of a certain violation of the regime.
31 -year -old Seitosmanov, a second cousin of Primov, is a resident of Sevastopol village of Tylovaya (Highto). He is the only person involved in the Third Sevastopol case by Hizb Ut-Tahrir today. According to the current version of part 2 of Article 205.5 of the Russian Criminal Code, he faces from 10 to 20 years in a colony.
Seitosmanov was detained on May 10 this year and the next day was sent to the pre -trial detention center. Subsequently, his arrest was extended until September 7 . In conclusion, Politzeck had health problems.
