Mockery of the prisoner Makarov was shot to the registrar to report to the authorities: we publish the testimony of the arrested FSINESS

On July 20, New Gazeta published a video provided to us by lawyers of the Public Verdict human rights fund. This strict, naturalistic shooting was a ten-minute torture record, which 18 employees of the Yaroslavl IK-1 were carried out in relation to a prisoner crucified on the table in the class of educational work. The lawyers of the "public verdict" have been working in this colony for a long time, and "new" has been writing about it for a long time. We knew for sure that the event was recorded in these frames: this is “educational work”, which, a year ago, June 29, 2017, was subjected to prisoner Evgeny Makarov.

A few days after the incident, he described in detail all the circumstances of what happened to him by his lawyer Irina Biryukova, and they filed an application with the prosecutor’s office, the Investigative Committee, as well as the regional Federal Penitentiary Service. All departments then refused to believe in the picture that Makarov described: he was refused to initiate a criminal case, the violence applied to him was recognized as “legitimate”.

Remaining unpunished, it was repeated more than once over the past year - in relation to Makarov, as well as in relation to other people who also decided to complain about torture in the colony. The case was opened only after the video was published - here the prosecutor’s office, and the Investigative Committee opened his eyes, and even the prison leadership admitted that they had torture.

At the disposal of “New” there are protocols of the first interrogations of the arrested participants in the torture events.

They were transferred to us by the Public Verdict Foundation - the testimony is contained in the materials of the arrest cases, which were presented by the investigator at the open court. These documents surprising with their cold -blooded cruelty give us the opportunity to recreate the chronology of the events of that day, and also offer answers to many obvious questions that this record gave rise to.

• Why are they so?

• Did the authorities know what was happening here?

• Finally, why did they shoot all this on the DVR?

On the morning of June 29, an incident occurred in the IK-1 penalty area: the convicted Makarov rude to the operatives. We can even name the approximate time of this incident: as follows from the testimonies of most interrogated jailers, this happened in the road, and the shift of the operatives ends at 9.30 in the morning. Here's how one of the arrested, senior inspector of the Zablokov Security Department describes this conflict:

“ In the morning, IK-1 employees were searched for the camera, which contained convicted Makarov E. A. Employee IK-1 Morozov A.V. and the second employee (perhaps Brovkin A. N., perhaps Zybin A. a) brought the convicted Makarov E.A. for a walk. While the convict was on a walk, these employees conducted an unscheduled search in his cell. After the convict returned back, he noticed that the IK-1 employees dropped one of the envelopes belonging to him from the table to the floor. Then the convicted Makarov E. A. began to express insults, namely, he cursed with obscene abuse of A. Morozov . ”

This conflict was described by Makarov himself in a statement to law enforcement agencies, which he made shortly after beating: that day, returning to the cell, he saw that the jailers were trampled on the floor from his mother, which he had not seen for almost a year at that time. And besides her, he has no one. And, indeed, Makarov flew off the coils.

The arrested jailers testify to: Makarov’s reputation was not so hot, he committed regular violations of the regime.

" Appeal to" you "to the colony staff, refusal to carry out daily events, smoking in the wrong places, insulting the colony staff ."

But this is not the worst.

“ In addition, the convicted Makarov E. A. repeatedly wrote all kinds of complaints to the Office of the Federal Penitentiary Service of Russia in the Yaroslavl Region, and therefore it was known that the administration was also unhappy with the behavior of this convicted person .”

This is what determined the further course of events:

What we saw in the record that shocked the whole of Russia (and not only) is not an affect, not the explosive reaction of the FSINITS to the sounding insults. This is a clearly planned work, the report on it was presented not only by the leadership of the colony, which, in fact, authorized Makarov’s torture, but also further - to the FSIN Office in the Yaroslavl Region.

Because there, as we now know, "were also unhappy with the behavior of the specified convicted person."

That morning, the DVR was fixed on the lapel from the operative Morozov , and it was turned on at the time of the skirmish about the letter. As follows from the testimony of one of the jailers, “the indicated behavior of the convicted Makarov E. A. was the last straw” : the investigator Morozov attributed this record to the IK-1 security department.

In the security department, the video was viewed by the operatives of Yablokov and Morozov, the head of the security department Zagrebny and the deputy head of the Skorokhod security department . Then the video was taken to the office to the acting chief IK-1 Nikolaev .

“ The video of Nikolaev D. A. watched in the office of the deputy chief of the colony for safety and operational work by Mikhailov I.V. in the presence of the latter. While Zagrekalny I.V. attached a video, the news that E. Makarov again made a violation of the regime, and, perhaps, the IK-1 leadership will allow us to apply physical force, has already been transferred to many IK-1 employees . <...> Further, Zagrebny I.V. returned to our department and said that from the leadership, that is, Nikolaev D.A., it was received to carry out "educational work" with the convicted Makarov E. A. That is, it was meant that E. A. Makarov "will definitely resist", in connection with which we will have to use physical force to him. "

One of the FSINESS, Yablokov, describes the enormous enthusiasm, with whom the jailers met the news that the authorities would allow to apply torture to Makarov:

“ Since Makarov E. A. was a malicious violator of the regime, many employees of the institution expressed a desire to participate in“ educational work ”in relation to him. There were also employees who worked out their shift . ”

Others say that participation in "educational work" was voluntary-rendering in nature:

“ On 06/29/2017, in the morning, when the convicted person E. A. Makarov again violated the regime of the institution, and also insulted the employees, my shift was already over, and I already managed to pass special equipment <...>.

From Yablokova M. D. we received a decree not to leave anyone. Therefore, we stood and were waiting for his return. When Yablokov M. D. returned, it became clear from his words (literally) that the leadership of the institution gave the good to carry out the so -called "educational" work with the convicted Makarov E. A ".

“ Operations with prisoners during their location in the institution have a special, rather normal relationship. The operative is not an employee of the regime who checks the camera and distributes food, but the one who constantly communicates with the prisoners solves their problems . ”

“ From the inspector of the Yablokov security department, it was instructed to arm with special sticks and advance to the schizo, PKT, EPTC IK-1 due to the fact that the convicted Makarov E.A. allegedly threatened to commit suicide. In connection with the signal received, our change, including I, armed with special sticks, advanced to the convicted Makarov E. A., to prevent its suicide. At that moment, I still did not know that the use of physical strength was planned to Makarov. I’ll clarify that I didn’t receive a special stick, as it was reported that not everyone to take sticks . ”

“ Yablokov M. D. instructed the entire shift to go to the premises for searches, where“ educational ”work will be carried out with E. Makarov. I did not want to go there and understood that the “educational” work was understood to mean the application of physical force to the convicted Makarov E. A. However, since I was instructed by M. D. Yablokov, and everyone else went there, I understood that I could not refuse, so I went with everyone. I was afraid that I would be fired for refusal . "

“ In fact, they (bosses) gave a conscious order to provoke Makarov and apply power in relation to him .”

Many arrested jailers describe how they pulled the convicted Makarov from his camera with the whole world. Makarov did not give in to any persuasion:

“ Mamoyan (an operational worker who has not yet been detained - ed. ) Said to one of the employees:“ Try to withdraw it yourself, say that I came and call him to talk to my conversation. ” He still refused to go out, explained that he did not believe. Further, Mamoyan independently proceeded to the camera and, through a cutting bars, said: “Makarov, go out, your actions related to the refusal to leave the camera, unlawful.” Makarov said that they would kill him. Mamoyan replied that no one was going to kill him . ”

“ Makarov E. A. shouted something, I did not hear, since music played loudly in a schizo. <...> not having time to bring E. A. Makarov to the office of the operatives, bringing it only to the duty unit, one of the employees noticed that Makarov E. A. had a prohibited object in the hand, namely a sharp piece of metal. After that, I, Bogdanov, Brother Bogdanov and another employee, while in form -like unioning, holding special sticks in his hands, ran to the convicted Makarov E. A., knocked out the prohibited object from his hand and then applied a special technique to Makarov - the bend of both hands behind his back, that is, carried out detention. <...> Further from Mamoyan S. R., an indication of the news of the convicted Makarov E.A.V. The class of educational work was received . ”

What happened in the class of educational work, we can see on the video. But how the torture participants themselves evaluate their participation in torture:

“ I did not strike these strikes much, since from Kalashnikov (deputy head of personnel and educational work) it was indicated that everyone was beaten by E. A. Makarova, Makarov E. A. with a special stick about 10 strokes.

<...> At that moment I realized that these orders were illegal, but I was afraid not to fulfill them. I also understood that, obeying illegal orders, my actions are criminal. I realized all this, but at that moment I could not do anything about it.

I saw how Makarov E. A. wound a terry towel so that he would have to breathe poorly, and periodically pour it with cold water so that he does not lose consciousness. It was unpleasant for me to look at what was happening, as I saw that E. A. Makarov was experiencing severe physical pain. <...> How many time this torture lasted, I can’t say for sure, about 20 minutes . ”

“ At the very end, I went to Makarov, shook off the remnants of the water from his back of his head and said to him:“ Makarov, stop violating the maintenance regime, you don’t need to behave defiantly, insult employees, so that no one treats you like that in the future. ” At this moment, Makarov continued to pretend that he did not hear me. They continued to hold it. In order for him to react to me, I patted him with an open palm of his left hand (“lost it”) to draw his attention to himself. I did not want to cause him physical pain. This is important. "

“ In the future, I wrote a dismissal report, because I did not agree with such principles of influence on convicts. However, I was persuaded to stay. "

Interrogations of the arrested FSINESS shed light at the most intriguing moment of this whole story:

• Where did the record come from?

• How did it happen that the crime was openly recorded on the video?

The answer is terribly simple: the jailers shot torture, because they had to report to the authorities.

Suspect apples:

“ During the strike by one of the employees - S. P. Drachev - a portable video recorder was fixed on the chest. The video was included because Nikolaev D. A. instructed to conduct “educational work” under the video to check the implementation of his instructions. <...> Next, the video recording from the DVR, on which the use of violence against E. A. Makarov was recorded, was redesigned by me to the flash drive. I took this flash drive with a video to the office of Mikhailov I.V., where I handed it to him, and in the same place this video was viewed by Nikolaev D. A. I also know that in the future this video was transferred to the first deputy head of the Federal Penitentiary Service in the Yaroslavl Region Barinov G.A., who also looked at it. This is known, since at the moment when I was with this entry in the office of Mikhailov on 06/29/2017, on the cell phone of the chief of IK-1 Nikolaev D. A. called just Barinov G.A. and talked with him on this fact . "

“According to Mikhailov, I know that this video recording from the DVR was transferred to the deputy chief of the FSIN Office in the Yaroslavl Region for educational work Stepanishchev, who later had to transfer it to the first deputy head of the Department of Barinov.”

Today, 12 out of 18 people present in the video have been arrested. The fate of the remaining six leaves space for thought. Like the question of why the leaders of the colony, where this was happening, the investigation still has no interest.

The lawyers of the “public verdict” by mail filed a petition for the investigation of the interrogation of Dmitry Nikolaev, who at that time acting as the head of IK-1, Igit Mikhailov, the then deputy head of the colony on security , the deputy head of the Federal Penitentiary Service in the Yaroslavl Region Yuri Barinov, Alexander Stepanishchev, the deputy head of the regional Federal Penitentiary Service, as well as The Commissioner for Human Rights in the Russian Federation Tatyana Moskalkova and her representative in the Yaroslavl region Sergei Baburkin , who visited Makarov in the first days after the torture he had experienced.
