"VKontakte" is convicted of illegal provision of CPE data on users

The VKontakte administration is convicted of the illegal provision of information about the supporters of Alexei Navalny in the region. Documents confirming such cooperation published on his twitter the functionary of the "Russian Future" Leonid Volkov.

The first of the documents is the request of January 18 of this year, signed by the deputy chief of the regional CPE Rustam Gazimullin, sent by the deputy director of the VK Nikolai Chernenko. Referring to the laws on the police and on operational-search activities, the security officer requested among other numbers of user mobile phones, the addresses of their email and IP addresses.

Volkov also published 3 out of 22 pages of the answer, which the VK security service sent to the CPE on January 30. As the functionary noted, the letter contained not only the data destroyed by the security forces, but also the information that they did not request.

The VK answer ends with such a remark: “The administration of the site of VKontakte LLC asks you to send (duplicate) the original queries (decisions) with all the details ... In case of systematic non -allowance of the original documents (requests, decisions), the execution of all subsequent requests (decisions) received from you by e -mail will be suspended before receiving the original documents of documents.”

VK, Volkov recalled, invariably assures that he is only responsible for legal requests by court decision, and does not notify the interests of the investigation about the interest of the investigation about the interest of them. In the last weeks of VK and its owner - Mail.ru Group - opposed the persecution of bloggers for publication on social networks. On Wednesday, Mail.ru sent to the State Duma a proposal to declare an amnesty to the convicts under Articles 148 (insulting the feelings of believers) and 282 of the Criminal Code (excitement of hatred or enmity) for "disseminating information and other activity on social networks (including likes, reposts, publication of images) in cases where such actions did not have socially dangerous consequences."

At the same time, the company appealed to the Supreme Court, asking, in particular, to “indicate the need for a detailed establishment of the motive of the committed act,” since “in the absence of a motive of action, they cannot form the composition of crimes for which responsibility for extremism is provided”. In cases where the imputed actions can really be considered representing a public danger, Mail.ru noted, the Armed Forces could recommend to the courts to replace the accused with a criminal liability with a judicial fine.

Another appeal to Mail.ru sent to the Ministry of Justice. The company asked this department to develop a unified methodology for conducting examinations in "extremist" cases, noting that now various experts are evaluating the same materials differently.

Finally, the fourth appeal was addressed to the Ombudsman Tatyana Moskalkova. She was called upon to submit to the Constitutional Court a request for the conformity of the provisions of Article 282 of the Criminal Code of the Basic Law.

Meanwhile, the VKontakte administration last week announced plans for a month to carry out a privacy reform , giving users the opportunity to make their profiles open only for friends. It was also reported that in the next two weeks, the display of information about users who reinstall posts will be disabled - this information will become visible only for the authors of publications themselves. As explained, in this way the social network intends to counteract the unreasonable criminal prosecution of users for publication.

It is known, however, that most criminal cases for reposts were instituted precisely with the assistance of the VK administration.
