On August 17, the judge of the Bryansk Regional Court Victoria Zlotnikova rejected the appeal against the previous extension of the arrest to Baholdin. Meanwhile, Sidorkina’s lawyer at the hearing indicated that, since the episodes imputed by Baholdin date back to 2014-2015, the Criminal Code of Article 282.2 (participation in the activities of an extremist organization) should be applied to it in the editorial office operating for the period. Prior to the entry into force of the "Laws of Yarovo", the maximum term on such a prosecution was four years of colony - therefore, this composition belonged to the category of moderate crimes. Meanwhile, Article 109 of the Code of Criminal Procedure (terms of detention) establishes that persons accused of medium severity can be kept in the pre -trial detention center for no more than six months; In certain cases, an extension of this period is allowed for a maximum of a month. Bakholdin remains in prison for almost a year and a half.
Nevertheless, the investigator Konysh and the prosecutor N. Zablotskaya insisted on the legality of extension of the Politzeck arrest. Judge Zlotnikova took their side.
At the hearing on Friday, civil activist Ildar Dadin arrived from Moscow. He met the decision of the judge with exclamations "Shame! Retribution is inevitably!" The bailiffs detained Dadin and issued a protocol for it under part 2 of article 17.3 of the Code of Administrative Offenses (non -fulfillment of the legal order of the bailiff; a fine of 500 to 1000 rubles), after which they were released.
Sidorkina filed a complaint about the illegal retention of her client in a pre -trial detention center in the TFR and the prosecutor's office.
Baholdin is 37 years old. In the first half of the 2010s, he participated in a number of anti-Putin's actions in Moscow. At the end of 2014, he emigrated to Ukraine.
In March 2017, the opposition was detained in the border village in the Bryansk region, when he illegally entered Russia to visit his parents. According to the plot of the case, fabricated against Bakholdin, from July 4 to 12, 2015, the emigrant fought in the ATO zone in the Donbass as part of the 5th separate battalion of the Right Sector Volunteer Corps. It is known that just on July 12 this unit left the zone of military operations.
Among the evidence in the case there are materials with a flash drive seized from Politzek. This, in particular, is his photo in camouflage against the backdrop of a Ukrainian flag with an object resembling a Kalashnikov assault rifle, as well as a certain "guide on action in the field of a sniper."
The investigation was first conducted by an official of the 1st department for the investigation of especially important cases of the regional department of the Investigative Committee of the SCR Senior Lieutenant of Justice Sergey Gutorov, and then the head of the department Shpakov himself. Baholdin did not give any evidence and did not sign any documents.
At the end of last year, the case was sent to the Suzemsky District Court of the Bryansk region, however, on December 22, Judge Natalya Shpirko handed over materials to Moscow , at the place of registration of Politsek. Meanwhile, on April 20 of this year, the judge of the Nagatinsky district court of the capital Larisa Krutovskaya returned the case to the prosecutor , pointing out errors in the indictment. The prosecutor’s office, in turn, sent the case for the investigation.
