The government criticized the initiative of the Ministry of Communications on the extrajudicial blocking of sites for the "justification and justification" of terrorism and extremism. This was reported by "Kommersant" with reference to the review of the work group "Communications and IT" of the expert council under the government.
According to government experts, the amendments proposed by the ministry in part 1 of Article 15.3 of the Law on Information may fall into 19 million sites. "Blocking of such a number of resources can lead to a significant increase in route tables, which can have a great impact on the quality of data transfer services to users of communication networks in the Russian Federation, including access to state information systems," the review said.
In addition, experts note, the use of the concepts of “justification” and “justification” in the proposed context “does not withstand criticism”. These concepts are uncleaned, and this can lead to wide interpretations and abuses.
In particular, under the definitions of “justification” and “excuses”, textbooks of law and publications on criminology devoted to terrorism and extremism can fall. In addition, experts indicate "as justifying extremism or terrorism can be qualified by many well -known works of Marx, Lenin and their associates, greater part of both Soviet literature and the works of Soviet historians, as well as modern and foreign journalism and fiction", as well as any criticism of Russian reality.
The lawyer of the Agora Damir Gainutdinov in a commentary to the newspaper agreed that the concepts of "justification" and "justification" are uncomplicated. However, he added, the whole article 15.3 of the Law "On Information", which allows extrajudicial blocking of sites, also contradicts the law "On countering extremist activities." “Therefore,” the lawyer concluded, “it is more likely to lead about the complete abolition of Article 15.3, and not about the amendments to it.”
The bill of the Ministry of Communications was published on August 7 on the official portal of legal information for public discussion.
Moreover, if the “justification of terrorism” in Russia is now persecuted under Article 205.2 of the Criminal Code, then the “justification of extremism” is not prohibited.
According to Article 15.3, which was included in the Law Lugovoi Law in 2013, and later tightened, now the Prosecutor General or its deputy may require blocking sites for calls for inconsistent shares, calls for "extremist activity", publishing materials of "undesirable" organizations and "information that allow access to these information or materials."
The decision on blocking can be made on the denunciations of federal and regional authorities, local governments, organizations and individuals.
The “facets” were among the first publications blocked according to the Lugovo Law. Access to the resource was closed on March 13, 2014, on the eve of the annexation of Crimea. According to officials, the "set of content" of the site allegedly encourages the reader to participate in "promotions conducted in violation of public order." Before Russian users, an “non-closed” mirror was created https://grani-ru-org.appspot.com/ , RKN brought more than 700 mirrors of our site to the register of prohibited resources.
