
In the Shalinsky City Court there is a process in the case of the head of the Chechen Memorial 61-year-old Oyub Titiev, accused of storing 200 grams of marijuana. 29 out of 65 witnesses of the prosecution have already been interrogated. 28 of the interrogated - employees of the Ministry of Internal Affairs of the Russian Federation in the Kurchaloevsky district. Each interrogation begins with the fact that Judge Madina Zaynetdinova explains his rights to the witness and warns of responsibility for giving false testimony in accordance with Article 307 of the Criminal Code of the Russian Federation, which provides for up to 5 years in prison. Judge Zaynetdinova carefully looks at the witness and pedantically clarifies whether he understands everything. After that, he asks to put a signature in the protocol.
All 28 employees of the Kurchaloevsky police signed in the protocol, and then, answering Titiev’s lawyers' questions, gave the following indications:
In the Ministry of Internal Affairs in the Kurchaloevsky district, there was never a unit called “Quick Response Group” (GBR);
None of the OMVD employees wears a camouflage form of green with SHBR stripes;
In the AMVD car park in the Kurchaloevsky district there are no service cars of the UAZ Patriot brand and the Niva brand of camouflage color with the inscriptions of the GBR.
To understand why these certificates are so important for the charge, you need to return seven months ago - on the day when this case was born.

“In the morning of January 9, I left the yard and headed along the main street with. Curly towards s. May of. The time was 9 hours. I drove about 1.5-2 km, reached the bridge located between the villages of Kurchal and May of May of. At the end of the bridge, I saw a police officer ... He stopped me and told me to drive to the side of the inspection ... The employee did not introduce himself, but demanded that I present him documents.The police officer was in uniform camouflaged green clothes, there was an iron helmet on his head, covered, in my opinion, camouflaged material. On his back, I saw three large letters "GBR".
On the side of the road there was a car of the UAZ Patriot brand, also camouflaged green, on the side of the car there were also three large letters “GBR” ... At that time, the second employee came up, who was dressed in the same way ... The first employee gave my documents to the second employee, and he began to watch the trunk of my car ... The second police officer at this time headed towards the front right door. I took a step in his direction to see what he was going to do, but the first employee demanded that I stay with him ...
After about 1 minute, the second police officer called us both to him.
I saw that he leaned toward the front right sitting and took out a black plastic bag. He put this package on the right top of the hood of my car, untied, and I saw a green mass that looked like crushed leaves in shape ... ”
So, in fact, in the car of Oyub Titiev, drugs were “discovered”, however, completely different circumstances are set out in the official version of the prosecution. Namely: at 10.20 in the morning, the traffic police of the Kurchaloevsky OMVD senior patrol Garaev and the inspector of Khutaev stopped Titiev allegedly for the turned off of the nearby light and “saw a grain-bureau of grass and a suspicious package under the passenger seats on the rug of passenger seats”.
That's just from the photo table of the inspection of the scene (Titieva car) it follows that no package under the seat of the front passenger seat is visible. The package could only be seen in one case: if you throw off the case and push the seat back 10-15 centimeters. This is exactly what was recorded in the table in photographs 7 and 10. But at the court, Garayev and Khutaev categorically insisted that none of them touched the seat. And if they did not touch the seat, they did not push the cover on it, they did not push the sitting itself, which means they physically could not see the “suspicious bag”. How then did they learn about its existence? Actually, the answer to this question is very simple.
Employees of the GBR, who detained Titieva an hour earlier, delivered a human rights activist to the Kurchaloevsky police department. They fulfilled their part of the “special operation”: they stopped the car, they threw a bag of drugs. In 99.9%, this would be enough for the factory of the next case under the 228th article of the Criminal Code of the Russian Federation. Because the fight against drugs has long been replaced by the Chechen policeman, the exhausted "golden vein" of crimes on terrorism. There were very few militants objectively, and there are still a lot of police officers. And Ramzan Kadyrov declared a new war in Chechnya - with drugs. The scale of this war is amazing at the imagination: on August 22, speaking to the Chechen security officials, Kadyrov said that only this year 1502 drug addicts were detained in Chechnya. Absolutely everyone who is charged, admit their guilt, and they are judged "in a special order." That is, the defendant is simply brought to court and immediately, without a judicial investigation, is sentenced.
I believe that those who organized a “special operation” against Titiev did not even occur to the fact that some problems can arise with “sincere confessions”. And I roughly represent the degree of confusion of the Chechen policemen, when Oyub categorically abandoned a self -talk. Yes, he said (human rights activist!) That drugs do not have any evidence, as they were “found” in his car without witnesses.
They did not achieve recognition for only one reason: there was not enough time. The detention was seen by the acquaintance of Oyub and immediately called the Memorial office. Colleagues raised the noise, the leadership of the republic began to call the chairman of the HRC Fedotov and the Commissioner for Human Rights Moskalkov.
It was then that the decision was made to staging the re -detention of Titiev. In the second oak, the main role was already played by employees of the traffic police Garaev and Khutaev. Of course, they did not see any “suspicious package” in the car. Their task was completely technical: to stop Titiev’s car, call the investigative-operational group and bring understandable ones. So that everything is "according to the law."
Now, in order to refute the version of Titiev, who from the very beginning described in orderly and in detail the circumstances of his first detention, the investigation made almost the entire composition of the Kurchaloevsky Ministry of Internal Affairs. “Witnesses” had to unanimously deny the existence of a quick response group in the department. All of them had to say that in the Ministry of Internal Affairs in the Kurchaloevsky district there are no employees who would wear green camouflage, as well as camouflage cars with the inscription "GBR" aboard.
Of the 28 questioned witnesses of the accusations, the testimony of Khutaev, Garaev, as well as investigator Muratov, who went to the scene in the investigative-operational group and with Titiyev’s car, “suspicious package”, deserve special attention. It is on the testimony of these three witnesses that the whole charge is procedurally based. If these testimonies fall apart, it falls apart and the whole thing.

Lawyer Zaikin: Do you know this abbreviation - “GBR”?
Muratov (waves his head for persuasiveness): No.
Lawyer Zaikin: You told the court that you live in the OMVD of the Kurchaloevsky district in the hostel. So?
Muratov: Yes.
Lawyer Zaikin: So my colleague, lawyer Ilya Novikov, were repeatedly on the territory of the Ministry of Internal Affairs and watched employees in green camouflage clothing with “GBR” stripes on the sleeves and on the back. You have been living there for more than a year. Have you seen employees in this form?
Muratov: No.
Lawyer Dubrovin: You interrogated more than 10 employees of the Kurchaloevsky OMVD. For what purpose did you interrogate these police officers? What did you want to find out from them? What version did you check from them?
Muratov: Well, whether they were on some camouflaged cars there, whether they served in this “GBR” some ... as I remember, there was a version from Titiev’s words that it was stopped by the GBR officers, I checked this version.
Dubrovin's lawyer: Was this version confirmed?
Muratov: According to the testimony of witnesses - no.
Lawyer Zaikin: You live on the territory of the Ministry of Internal Affairs of the Kuraloevsky district. Have you walked around the Ministry of Internal Affairs past the parking lot of service cars?
Muratov: Maybe he walked.
Lawyer Zaikin: Have you ever seen a camouflage in the Khaki type car there?
Muratov: I have never seen it.

Lawyer Zaikin: You are now the head of the traffic police of the Kurchaloevsky OMVD. Tell me, are there any cars with the inscriptions of the GBR in this police department?
Khutaev: No.
Lawyer Zaikin: And in January 2018, were cars with the inscriptions of the GBR or the “quick response group”?
Khutaev: No, I haven't seen it.
Lawyer Zaikin: UAZ “Patriot” of green camouflage colors with the inscription on the rear window “GBR”?
Khutaev: No.
Lawyer Zaikin: Niva car of camouflage colors with R008VA numbers 95 of the region and with the inscription “Kurchal GBR” has any relation to the Kurchaloevsky OMVD?

Garaev (silent, quietly answers): Yes, I rode on it. She was assigned to me.
Lawyer Zaikin: Do you have raid events? Well, when, together with you, other units are serving on the road?
Garaev (after the next pause): There are.
Lawyer Zaikin: During raid events, you did not encounter units who wore green camouflage uniforms with stripes of the GBR?
Garaev (unexpectedly and somehow desperately loud): I told you that I don’t know what kind of service this is! What is the GBR - I do not know!
Lawyer Zaikin: Do you understand that you were warned of responsibility for giving false testimonies?
Garaev (gloomy): Of course.
Lawyer Zaikin: Do you insist on your testimony?
Garaev (he is silent for a long time, then he speaks with despair barely audibly): I do not know what the GBR is ...

After this interrogation, Alikhan Garayev will remove a collage of six photos from his account on Instagram, in which he, in the form of an traffic police officer in an official car with numbers M 0147 95, is conducting a joint raid with employees in army camouflage form with GBR stripes. The photo was posted on June 6, 2017.

Garayev will also delete two identical photos from his Instagram, in which he photographed with his colleague against the backdrop of the service parking lot of the OVMD of the Kurchaloevsky district. At this parking lot behind Garaev, three camouflage cars are clearly visible. Two cars of the UAZ Patriot brand and camouflaged Niva with V008RA numbers. Photos posted on October 12, 2017.

We made the screenshots of Instagram Garaev before he cleaned his account. But there is much more serious evidence that employees of the Ministry of Internal Affairs of the Kurchaloevsky district gave false testimony in court. And these evidence is no longer so simple. Because their source is not Instagram, but the official website of the head of Chechnya Ramzan Kadyrov, the official website of the Ministry of Internal Affairs in the Czech Republic and the state media. And we believe that
Our small investigation will refresh the memory of the remaining half of the witnesses of the prosecution and will help them avoid a criminal record for giving false testimony in court.
Let's start with the plot shown according to the Chechen TV channel "Terrible TV" and posted on the channel on April 4 of this year.
The plot is dedicated to the employment of the children of the dead police officers, it begins with the next ordered text of the correspondent:
“GBR is a quick response group. This is a detachment that is involved in all special matters. Yusup Khadaev ( son of the deceased policeman . - EM ) is assigned to them. Despite the lack of great experience, the young employee quickly joined the team and works on a par with colleagues. ” In the text Preambul of the plot, the TV channel website says: “GBR is a quick response group. Today its employees are involved in raid events. They check the documents from drivers and monitor compliance with the rules of the road. ”
On the website of the State Information Agency “Chechnya Today”, you can find a video for the search for “GBR” (it is also posted in YouTube).
In the lower left corner of the video, the GBR.MVD is written. The video is called: "In Chechnya, preventive raid measures of the Ministry of Internal Affairs for the Czech Republic continue." This plot shows how traffic police officers conduct inspections of cars together with employees of the GBR unit. (At the same time, next to the police, neither witnesses nor the investigator drawing up the protocol on the inspection of the vehicle, which is a gross violation of the law.)
On the official website of the Ministry of Internal Affairs for the Czech Republic, the search by “GBR Kurchali” issues a link to the official press release of February 08, 2017, reporting on a visit to the Minister of the Ministry of Internal Affairs of the Chechen Republic Ruslan Alkhanov Kurchaloevsky OMVD.
We quote the last paragraph: “Ruslan Alkhanov checked the readiness of the quick response group, which was in the police department around the clock in case of complication of the operational situation. The minister personally got acquainted with the staffing of the GBR employees, checked their equipment and weapons. ”
On the website of the Vainakh CGTRK, the search engine refers us to the plot of “Vesti Chechnya” of February 7, 2017.
The first shots of the plot: Ruslan Alkhanov holds a meeting with the full composition of the Kurchaloevsky police department. At 4 minutes 09 seconds of the plot, the correspondent says:
“Then Ruslan Alkhanov checked the readiness of the quick response group, which was in the police department around the clock in case of complication of the situation.”
Behind these words is a video sequence on which we see a group of quick response of the Ministry of Internal Affairs in the Kurchaloevsky district in full force and in combat readiness. All employees of the GBR unit are dressed in the form of an army -type Khaki color.
And from the news of October 12, 2017 (that is, three months before the detention of Oyub Titiev), posted on the website of the State Agency “Chechnya Today”, it follows that Minister Alkhanov again visited the Ministry of Internal Affairs in the Kurchaloevsky district. We quote the second paragraph:
“In the department of the Russian Ministry of Internal Affairs in the Kurchaloevsky district, which became the third among the best territorial internal affairs bodies of the republic ... The minister met with the personnel of the rapid response group. Ruslan Alkhanov checked the training of employees of the GBR, who are in constant round -the -clock combat readiness. The head of the Ministry of Internal Affairs personally got acquainted with the staffing of employees, checked their equipment and weapons. ”
Particular attention is deserved by the plot line associated with camouflaged police vehicles UAZ Patriot. It was not possible to find any traces of public procurement of “patriots” for the Chechen Ministry of Internal Affairs of the Czech Republic. But on the website of the head and government of the Chechen Republic, a press release was posted on November 18, 2015 that Ramzan Kadyrov transferred eight UAZ Patriot cars to the special purpose of the Grozny Ministry of Internal Affairs in Chechnya.
SUVs were acquired at the expense of the Hero of Russia Akhmat-Khadzhi Kadyrov.

Messages about the generous gift are posted not only on the website of the head of Chechnya, but also at the news agencies "Grozny-inform" and "Chechnya Today".
Judging by the photographs, these cars are exactly similar to those camouflage UAZs Patriot, which was captured and laid out on his Instagram, witness Alikhan Garayev. We can make a logical assumption that Kadyrov’s fund and personally his president Aimani Kadyrov made similar gifts to other divisions of the police of the Chechen Republic. Nevertheless, who exactly gave the camouflage “patriots” to the Kurchaloevsky OMVD - the question is now extremely fundamental. We will receive an answer to it in court in the case of Oyub Titiev, when lawyers request the documentation of the Fund. 22 августа, после серии нападений на полицейских, которые осуществили дети в возрасте от 11 до 17 лет, Кадыров публично обвинил правозащитников в пособничестве террористам, запретил им въезд на «свою территорию» и опять назвал Оюба Титиева наркоманом, в очередной раз удивившись, почему «правозащитника, которого в Чечне никто не знает, защищает так много людей со всего мира».
For reference. С 2009 год Оюб Титиев руководит чеченским отделением правозащитной организации «Мемориал», работающей на Кавказе 18 лет. Первое свое отделение «Мемориал» открыл в Ингушетии в 2000 году для помощи жителям Чечни, пострадавшим от чеченской войны. В первую очередь, от незаконных действий российских военнослужащих. «Мемориал» и «Гражданское содействие» оказывали гуманитарную помощь чеченским беженцам в лагерях на территории Ингушетии, а потом, когда Чечня начала восстанавливаться, чеченским школам.
К 2009 году «Мемориал» уже имел несколько отделений в Чечне, Оюб Титиев возглавлял гудермесское отделение. А в грозненском работала Наташа Эстемирова. 15 июля 2009 года она была похищена и расстреляна. Следствие так и не нашло ее убийц, но мотив убийства все-таки установило: Наташу убили за ее правозащитную работу. На тот момент «Мемориал» занимался уже не только жертвами военных преступлений, совершенных в ходе двух военных кампаний в Чечне. Он активно помогал новым жертвам, пострадавшим от рук чеченских силовиков, вчера еще — бывших боевиков, которых Россия амнистировала и привела к власти в Чечне.
Убийство Наташи стало огромной потерей для «Мемориала», от которой в полной мере он так и не оправился. Но коллеги Наташи во что бы то ни стало, в том числе ценой своей жизни, хотели продолжать свою работу и защищать своих сограждан. Для них это было еще и делом чести. Именно упорство Оюба Титиева стало ключевым для очень непростого решения — не закрывать «Мемориал» в Чечне. Ну и еще сыграл роль другой немаловажный факт: на тот момент президентом России был Дмитрий Медведев, у которого было несколько иное, чем у Владимира Путина, отношение к чеченской власти и лично к Рамзану Кадырову. Именно благодаря медведевской политике «нового курса» на Кавказе, нормализовавшей ситуацию в таких нестабильных регионах как Дагестан и Ингушетия, смертельно раненое правозащитное движение в Чечне получило «второе дыхание».
На сайте Кремля можно найти стенограмму доклада Оюба Титиева на встрече президента Медведева с Советом по правам человека в 2010 году. Эта стенограмма доступна, в общем, каждому, кто умеет читать. Поэтому все заявления чеченской власти о том, что «никто не знает правозащитника Титиева», мягко говоря, не соответствуют действительности.
Титиева знает в таком качестве, например, премьер-министр Дмитрий Анатольевич Медведев. Few?
Убийство Наташи Эстемировой, открыто и жестко критиковавшей Рамзана Кадырова и его силовиков, все-таки наложило ограничения на последующую работу «Мемориала» в Чечне. Публичная деятельность чеченских правозащитников была сведена к минимуму. Это было вынужденное решение, продиктованное соображениями безопасности. Чеченские власти безусловно знали про «Мемориал» все. Знали они, и кто такой Оюб Титиев. В 2015-м даже прислали черную метку в своем фирменном стиле: хлопцы в балаклавах напали тогда на гудермесский офис «Мемориала». Оюба в тот момент на работе не было, а ведь именно его искали налетчики, закидывая яйцами женщин. После этого нападения «Мемориал» закрыл отделение в Гудермесе.
9 января 2018 года, когда задержали Оюба, по чеченскому «Мемориалу» был нанесен очередной, на этот раз уже сокрушительный удар.
Глава Чечни неоднократно демонстрировал, что для него дело Титиева — вовсе не рядовое. Он много раз публично назвал Оюба преступником, грубо нарушая как представитель исполнительной власти 49 статью Конституции Российской Федерации,
гарантирующей всем гражданам страны презумпцию невиновности. «Каждый обвиняемый в совершении преступления считается невиновным, пока его виновность не будет доказана в предусмотренном федеральным законом порядке и установлена вступившим в законную силу приговором суда».
Совсем недавно, на похоронах осужденного за убийство полковника Буданова Юнуса Темирханова, Кадыров потребовал «относиться к чеченцам в соответствии с Конституцией Российской Федерации». Хотелось бы рекомендовать главе Чечни самому неукоснительно соблюдать ее в отношении всех чеченцев.
