
Senior Lieutenant Oleg Leontyev, sentenced to three years conditionally in the case of the death of the 19-year-old conscript of Ilya Gorbunov, went to the war in Syria until the verdict was sentenced, thereby violating the subscription of the lower right to leave. This was reported by the Foundation "The Law of the Mother", whose lawyer Nadezhda Kuzina represents the interests of the sister of the deceased - Maria Pupchenkova.
The flight of Leontiev became known at a meeting on the appeal of Kuzina in the Moscow District Military Court. The prosecutor Nikolai Vinokurov said that the hearing is impossible, since the convict "left on a business trip."
At the same time, the official could not explain who allowed to send the convicted person under the subscription about the wizard to Syria. He also found it difficult to answer what information Leontyev himself presented to resolve the issue of his departure, if the command was known about his criminal prosecution.
Kuzin’s lawyer filed a petition for the absentee arrest of the convict.
However, the board of Igor Beldzeyko (Judge-Rosaver), Mikhail Kudashkin and Viktor Elfimova limited herself to putting aside the hearing for an indefinite period and obliged the prosecutor to find Leontiev and ensure his appearance to the court.
Leontyev is an officer of the military unit No. 32010 located in the city of Naro-Fominsk. This is the base of the 13th regiment of the 4th (Kantemirov) tank division. Gorbunov, a resident of the Bryansk region, died in February 2017, three months after the draft in the army. Leontyev ordered the soldier to overtake the tank, despite the fact that Gorbunov was not trained in driving and did not have appropriate tolerance, and the tank itself did not undergo operation. The car turned over and fell into a stream; Gorbunov, who was in the compartment of the mechanic driver with an open hatch, was not able to get out.
Leontiev was charged with paragraph "in" part 3 of Article 286 of the Criminal Code (abuse of authority with the causing consequences). The hearing in the case continued in the Naro-Fominsk garrison military court. In the debate of the parties, the prosecutor Semyon Legashev asked for the defendant 3 and a half years of the colony. Kuzina, in turn, demanded a maximum 10-year period. The lawyer of the accused Chasechalov asked to limit himself to a fine.
Leontiev himself did not plead guilty. At the same time, on July 4, speaking with the last word, he asked not about the acquittal, but about making a decision "in such a way as to continue the service." During the investigation, the defendant noted, he was selection for war in Syria. “With a positive decision of the court, I immediately fly there by the next side,” Leontyev assured. “This will allow you to bring some benefit for the state.”
Then he added: "I already participated in one of these events, but the only thing was in the territory of an adjacent country, on which we seemed to be."
As the “mother’s right” noted, this was probably the first public and official one - since it was made in court - a statement by a Russian officer confirming the direct part of Moscow in the war in Ukraine.
On July 6, Judge Dmitry Balabanov, on his own initiative, re -qualified Leontyev’s accusation of a less difficult part 2 of Article 350 of the Criminal Code (violation of the rules of operation of a combat vehicle, which entailed by negligence of the death of a person) and condemned him conventionally with a two -year test term. Such a decision indicated the “mother’s right”, was a surprise to all participants in the process.
Human rights activists also noted that although one Leontiev was accused of the death of Gorbunov, five more officers of the units were involved in the incident: Bashun, Rempers, Goncharov, Begs and Nikolaev. Nevertheless, they took place in the case only as witnesses. In the debate of Kuzin, she demanded that the head of the garrison department of the TFR private resolution on attracting these five under Articles 286, as well as 285 (abuse of official powers) and 293 Criminal Code (negligence).
Judge Balabanov did not satisfy this petition. He issued only a private resolution to the command of the unit on bringing officers to disciplinary liability.
