
The Judge of the Suzemsky District Court of the Bryansk Region Natalya Shpirko extended until December 3 the arrest to the opposition Denis Baholdin, accused of participating in the ATO as a volunteer of the Right Sector. This was reported to the "Franes" by the lawyer of the political prisoner Svetlana Sidorkina.
The political prisoner was transferred to a temporary detention center in Suzemka from the Bryansk SIZO-1. On Friday, he should be sent to Novozybkovsky pre-trial detention center-2. Despite the fact that the Bakholdin case has already been transferred to the Suzemsky District Court, it is still unknown when and which judge will consider it.
The prosecutor N. N. Prudnikov participated in the hearings on the preventive measure.
On Wednesday in Kyiv on Independence Square, an action was held in support of Bakholdin.

The previous time, the Politsyk was extended on August 20, by the decision of the judge of the Soviet district court of Bryansk Andrei Shalnev - the previous duration of the preventive measure expired on September 15. The end of the investigation in the case became known at the hearing to extend the arrest that took place on August 7 . To participate in court in Moscow, Bakholdin was transferred to the metropolitan pre-trial detention center-1 "sailor silence", and after returning the case to the prosecutor's office, they returned to the Bryansk region.
On September 5, Sidorkina announced the sending of the Bakholdin case for consideration to the Suzemsky district court.
On April 20, the judge of the Nagatinsky district court of the capital Larisa Krutovskaya returned Bakholdin’s case to the prosecutor’s office , citing errors made in the indictment. On June 6, the Moscow City Court rejected the prosecutor's complaint about the return of the case.
According to Article 36 of the Code of Criminal Procedure, disputes between courts on the jurisdiction of criminal cases are prohibited, and any case transferred from one court to another is "is subject to unconditional accepting the court to which it is transferred."
The 37-year-old Baholdin was charged with part 2 of Article 282.2 of the Criminal Code (participation in an extremist organization), which provides for from 2 to 6 years of the colony.
The final accusations to Politzek were brought out twice - in November last year, in July and August of the present. The latest edition of the decision to attract the Politzek as the accused was signed by the head of the 1st department for the investigation of especially important cases of the regional department of the Investigative Committee of Justice Alexander Shpakov on August 18. According to her, Bakholdin on October 23, 2014 went through Belarus to Ukraine, then in the period from October 23, 2014 to July 4, 2015 he turned to "unidentified persons" from among the representatives of the PS with a statement of joining the organization. Then, according to the investigation, in the period from July 4 to 12, 2015, the emigrant participated in the hostilities in the Lugansk region as part of the 5th separate battalion of the Volunteer Ukrainian Corps of the Right Sector (DUK PS).
The case states that on one of these days, Baholdin was in the suburbs of Lisichansk Lugansk region with a “rifle weapon of an unknown model” and a gun consisting of “combat intelligence group from 8 unidentified persons armed with an unidentified model” - upon approval of the prosecution, Bakholdin led this group. The armed group, led by Bakholdin, said in the case, “carried out a hidden reconnaissance raid” to the positions of LPR militants in the suburbs of Lisichansk, and then after the “execution of the combat mission”, allegedly set by the detachment by the leadership of the PS, “Bakholdin D.I. and the unit led by it left the direction that was unidentified by the investigation authority”.
There is an testimony of a secret witness who recognized Bakholdin, - it is claimed, this is a machine gunner of the military unit 2950 (this number was assigned to the volunteer battalion "Aidar") of the Armed Forces of Ukraine (later arrested in Russia - in which case, it was unknown), whose group of 11 people accompanied the Bakholdin detachment to the neutral zone between the controlled ones Ukraine and LPR militants territories. According to the witness, Bakholdin had a Kalashnikov assault rifle and Stechkin's gun with him. The witness claims that all participants in this detachment were worn by Balaklava, but he remembered Bakholdin's face, since his Balaklava was "wrapped upstairs." The witness does not call a political prisoner by name, mentioning only the calling of him - "deaf" allegedly available to him. According to the witness, in September 2015 he saw a photo of Bakholdin "on the board missing" Ukrainian military and volunteers.
In fact, the 5th battalion DUK PS was not near Lisichansky at that time.
Among the evidence in the case there are materials with a flash drive seized from the political prisoner. This, in particular, is his photo in camouflage against the backdrop of a Ukrainian flag with an object resembling a Kalashnikov assault rifle, as well as a certain "guide on action in the field of a sniper."
The investigation was first conducted by an official of the 1st department for the investigation of the particularly important cases of the Bryansk administration of the Investigative Committee of the Investigative Committee of the Senior Lieutenant of Justice Sergey Gutorov, and then the head of the department Shpakov himself.
Baholdin is 37 years old. In the first half of the 2010s, he participated in a number of anti-Putin's actions in Moscow. At the end of 2014, he emigrated to Ukraine.
In March 2017, the opposition was detained in the border village in the Bryansk region, when he illegally entered Russia to visit his parents. Before the arrest, the FSB officers tortured him: they beat him and kept 12 hours fastened handcuffs to the battery, demanding to confess to the “right sector”, and in the car on the way to the Bryansk Directorate of the TFR, they threw a down jacket on his head, after which Baholdin lost consciousness due to lack of air.
Sidorkin’s lawyer insists that Baholdin is detained illegally: the episodes, sane by the Politzek, date back to 2014-2015, and therefore the incriminated part 2 of Article 282.2 of the Criminal Code should be applied to the editorial office operating for the period. Prior to the entry into force of the "Laws of Yarovo", the maximum term on such a prosecution was four years of colony - therefore, this composition belonged to the category of moderate crimes. Meanwhile, Article 109 of the Code of Criminal Procedure (terms of detention) establishes that persons accused of medium severity can be kept in the pre -trial detention center for no more than six months; In certain cases, an extension of this period is allowed for a maximum of a month. Bakholdin remains in prison for almost a year and a half.
