
These days in two Siberian regions, courts are held in similar cases. In Tuva, families of the Ministry of Emergencies Alexei Popov and Alexander Kynyra are evicted from service apartments. Popov has two children, Kynyra has three, the youngest is 9 months old. And in Transbaikalia, by the court decision, the court should “clean the premises”, that is, the departmental apartment of the Ministry of Defense, many children's mother Elena Miroshnichenko and three of her children.
In both cases, people are not offered in return and there is nowhere to go. And in both cases, in the departments, to which they had recently been related, they say: we are humanly sympathetic, but we can’t do anything.
"I live like on a powder barrel"
Elena Miroshnichenko - a soldier, used to live and worked in Orenburg. And two years ago, after her husband, also a military man, moved to Chita. At that time, Elena was on maternity leave - two sons were born in the family one by one. Now Bogdan is three, Seryozha - two years. The eldest daughter of Elena from her first marriage Katya (her father is not alive) this year she graduated from school, entered the medical academy.

At the end of last year, the marriage broke up. Elena’s ex -husband is now in another city. And in May 2018, the court ruled: Elena, together with the children from the service apartment of the Ministry of Defense. Departmental housing was provided to her ex -spouse, Elena herself is listed in the military unit of Orenburg, so she now does not have the right to reside in this apartment, they decided in court.
- In court, representatives of the guardianship authorities performed, asked to delay the execution of a court decision until the children are 18 years old. But they were refused, ”says Elena Miroshnichenko . - The delay was given to us only until September 1: then, they say, get out. I dispute this decision. I believe in the best, but everyone tells me that there is nothing to hope for.

The youngest son of Elena Seryozha at the same time crossed out from the line to the kindergarten at the military unit - the family was waiting for the place in it for about two years. True, the military prosecutor’s office and the children's ombudsman in Transbaikal - Seryozha in the queue, according to the order of the military prosecutor, were restored, and Ivan Katanaev, the Commissioner for the Rights of the Child, personally helped to arrange him in a private kindergarten while the line approaches. Elena was able to go to work.
Who then our Russian warriors protect if their children are thrown out of apartments?
But more in the apparatus of the Commissioner, they can’t help her with anything.
- The business of the family of Miroshnichenko is in our control, Elena was advised by our lawyer, they helped her with the kindergarten. But we cannot somehow influence the court decision, and we do not have the authority to go there with a lawsuit. Moreover, the appeals are already underway, and at this stage new circumstances are not considered. I can only say that the optimal solution would be allowed Elena to live in this apartment until adulthood of the children, ”says Ivan Katanaev .

New circumstances are, for example, the official recognition by the Chita administration Elena and her family in need of housing. Miroshnichenko was put in the queue for the municipal apartment, but when this line is suitable, it is not known: there are a lot of people like it, they need it. Nevertheless, according to the law, military personnel who have such a status cannot be evicted from service apartments.
“But the other day I received a letter from the Ministry of Defense,” says Elena. - There we are refused to recognize and write that there are no reasons for me to live with children in this apartment. Like, now we are nobody - we have nothing to do with this department. But how do we not have it? I am a soldier, except on maternity leave now. And my children are the children of the military. Do they go to the street? And our Russian warriors write to me! I even wrote to the Putin administration: who then our Russian warriors protect if their children are thrown out of the apartments?
Elena, during the time that passed from the first court, wrote and called a lot where. Both the presidential administration, and tried to break into the direct line with him - did not work out. And Anna Kuznetsova applied to the federal authorized personnel of the child. The situation has not changed yet. And her appeals go to those departments where she wrote before.
- I even phoned Putin, said that I was asking about a personal meeting with him. They told me: everything is only through assistants. Why do I need these assistants? They will get something there, which the president will not find out about, ”says Elena. - They still do not consider anything themselves, send them to the same Ministry of Defense, from where I later get the answers. So, maybe Putin about my business and about how they treat children with children, he will hear later - if anything, I will reached the Supreme Court, and to the ECHR.
At the same time, says Elena, departmental apartments of the Ministry of Defense in Chita are empty. There are no queues for settlement in them, and her family does not take a place.
- In the west of Russia with official apartments, it is unrealistic to get. And here they stand empty - no one wants to live in them: utilities are very expensive, for example, I cry 7-8 thousand a month, ”she says. -So people who managed to get a job somewhere else somewhere in terms of housing, the commanders almost force them to call here, because these apartments need to be kept. And we are evicted. Where is the logic?
In addition to this apartment, Elena has nowhere to live with her family. To rent housing when three children are in their hands, it is unrealistic. It makes no sense to return to Orenburg: with official apartments there is a tense. “And without her, we, the four, the four will sit on the neck of my mother - the disabled of the second group,” says Elena. “And Katya has just entered the institute. Where do we go?”

What will happen next, Elena does not make. He says: the family lives on a powder barrel for several months. Contactly forecasts in the case are given by specialists.
- Elena Miroshnichenko addressed us. With the return of the child to the queue to the kindergarten under the military unit, we helped her. But as for the apartment, the question is ambiguous, ”says Denis Tkonichny , military prosecutor of the Chita garrison. -Elena is not connected from any of the military units on the territory of the Chita garrison. The responsible tenant was her husband, who was now dispersed from the apartment, and Elena’s family relations were stopped with him. So formally in the actions of officials who evict it, there are no violations. But with the fact that minor children should move out of the apartment, of course, we must understand. But in this case, the military prosecutor's office has no authority to appeal the court decision, we are not a party to this case. Only Elena Miroshnichenko herself can do this - as a defendant in a lawsuit. If she is refused this instance, you can contact the Presidium of the regional court, if they do not make a decision there, and you can reach the Supreme Court. We must use all the legal opportunities to protect your rights.
Elena, as it can, uses these opportunities. He says: she is a lawyer herself. For help, I decided not to contact professional lawyers: expensive. And some told her directly: we feel sorry for your money, a hopeless thing.

But she hopes that this is not so. Now the prosecutor’s office - not a military, “civilian” - and at the same time filed a lawsuit to the side of Elena that the children of the military were allowed to survive in the departmental apartment of the Ministry of Defense at least until adulthood.
This lawsuit has not yet been considered. But according to the appeal filed by Elena, the court of the Trans -Baikal Territory already decided on September 13: the family was given a delay for one year. That is how much Elena and her children can live in a departmental apartment. Then the eviction should follow.
Elena Miroshnichenko will appeal this decision in the Supreme Court of Russia.
"Thank you all, everyone is free"
- I gave half my life to the state. And now the state tells me: I served - go to all four sides, nothing is supposed to you, ”says Alexey Popov .
He and his former colleague Alexander Kynyra are pensioners of the Ministry of Emergencies. Now they filed the same claims as Elena Miroshnichenko: they ask not to evict them with their families from official housing until the children are 18 years old. Alexei Popov has two children: the eldest is a student, the youngest is 14. Kynyra has three: the eldest is studying in the 11th grade, the youngest is not even a year.

Applications about the postponement of Popov and Kynyra were filed in the twenties of August, when the claims were considered - they were not informed for more than two weeks. Both the city court, the Supreme Court of the Republic of Tuva and its Presidium, have already passed. In all instances, they decided: in the departmental apartments of the Ministry of Emergencies, they do not have the right to live. “The decisions are made as a hiding,” notes Alexei Popov. Only the Supreme Court of Russia remains, but Popov is sure that there is no special hope that there will be another decision there. Former Emchens and the provision of a delay do not hope too much:
- Another of our comrade, Vadima, the bailiffs with his family have already evicted, but he has four children. At the time of eviction, only one school graduated, ”says Alexey Popov. - Now he and his friends live with his family. He does not like to talk about this subject: it is insulting and painful. I do not want to chop all this once again.
All employees of the Main Directorate of the Ministry of Emergencies in Tuva, who are now evicted from service apartments, have worked for 20–25 years. By length of service they have the right to retire. Alexey Popov, for example, worked for 12 years in the police, in 2004 he tripled the fire investigator at the Ministry of Emergencies, and soon became the head of the department of supervisory activity and preventive work. At first he worked in the village of Saryg Sap. And when he was transferred to Kyzyl, and even for a promotion, the Popov family sold the little village house: then it seemed that it would never be needed again.
In 2015-2016, the department began reorganization and other "optimization". Alexei says: "In some areas where 5-6 people should work, 3-4 really worked because of these optimizations. But now the previous order is restored." And then the position that he occupied was abolished. For some time, Popov worked again in Saryg Sapa, lived with his brother. And soon friends offered him a good job on a “citizen” - a civil defense specialist and emergency situations at one of the enterprises.

- Of course, I immediately agreed: my specialty! In Tuva, it is generally difficult with work, especially not a very young person. The guarantees that after the end of the contract in the Ministry of Emergencies I would immediately get to the normal place, no. And sitting like a decrepit pensioner, a man at 45 years old is not to face. And here is such a proposal! Since I had a long time, I was sure: everything that was necessary, I had already earned and I am not losing anything. He quit from the Ministry of Emergencies, came to a new place. I wanted to be longer for the family. But it turns out that he failed the family. I could not have imagined that they would do this to me, ”says Alexey Popov.
Almost immediately after the dismissal, the Ministry of Emergencies filed a lawsuit to evict the Popov family from official housing. Three courts supported the lawsuit. The same thing happened with the families of Kynyras and Azi who retired by length of service.
“You know, I recall a folk tale about the dog: when she was old and could not carry the service, as it should, the owners were thrown away so as not to feed her in vain,” says Alexey Popov. “So we are also told now, as in that joke:" Thank you all, everyone is free. " I don’t know, maybe from a legal point of view, all this is right, but with human morality it has not smelled.
Meanwhile, according to the law, employees of the Ministry of Emergencies (as well as law enforcement agencies, military) can receive a one -time social payment (ERU) for the purchase or construction of housing . This decree of the Government of the Russian Federation has been operating since 2013. In theory, people, retiring, should immediately receive such payments, and only then dismiss official apartments. But in Tuva, something went wrong.
“I got in line for ERUs in 2016, since that time it has not advanced for any person,” says Alexey Popov. - Yes, and, as far as I know, in general, for the entire time of the action of this law, no one received anything from us. But the queue is growing, which means that it will be more difficult to pay ERUs to ERUs.
In the summer of this year, employees of the Ministry of Emergencies of Tuva recorded a video message to Putin , talked about their problems - both about eviction, and that they did not see the payments. Sent a straight line. There is no answer.
The department of the Ministry of Emergencies in the Republic of Tuva is certified: in this situation, the region is not to blame.
-We would be happy to help former colleagues and humanly really would like to do it. But we do not have a legal opportunity for this, ”says Dmitry Kryzh , chief specialist in public relations of the Main Directorate of the Ministry of Emergencies in the Republic of Tuva.
The house in which families that fall under eviction live was built at the expense of the Russian Emergencies Ministry and initially had the status of official housing, says Kryzh. Now the queues for settlement in these apartments are waiting for 20 families of employees of the Ministry of Emergencies, serving in Kyzyl. Among them are four large families, he adds.
- As for the one -time social payment, the funds for this are allocated not by the region, but by the federal center. We only send financing requests and do it regularly. But, as far as I know, since 2013, money for these purposes did not come to the republic at all. I hope that the issue will soon somehow solve, ”says Dmitry Kryzh.
In the meantime, the issue has not resolved the issue, the families of firefighters and retirees can be sent to the street at any time. All according to the law.
- I never had any complaints during the service in the Ministry of Emergencies - monetary allowance, overalls, everything else that is supposed to - everything always stood out on time. Including, therefore, work in the department is considered prestigious: many guys seek to get to the Ministry of Emergencies Academy, but they take the best there. And in the end, they can turn out with them as with us, ”says Alexey Popov. - We do not pretend to these apartments by itself, we perfectly understand that they have a long line. How we get ERUs - we will free them on the same day. And so, I think, it is wrong when a person after many years of service simply send where his eyes look.
Now pensioners have one hope - that the court will allow their children to live in these apartments. Until they grow up.
