Krasnodar lawyer Mikhail Benyash was arrested for two months

The Leninsky District Court of Krasnodar has arrested lawyer Mikhail Benyash for two months, accused of violence against policemen. This was announced in his telegram channel by journalist Alexander Savelyev, who was present at the meeting.

The decision was made by Judge Diana Belyak. At the meeting, Benyash noted that he has a two-month-old son, and his wife is currently undergoing surgery. The defendant's lawyers asked him to choose house arrest as a measure of restraint.

• Lawyer Mikhail Benyash was detained on 9 September. At the same time, an unknown person wringed his hands and choked him, after which he was handcuffed and thrown face down on the asphalt. The police department also beat him. According to Benyash, he was taken to the hospital twice: “They diagnosed abrasions on the face, arms, neck, cheekbone and jaw, hemorrhage in the left eardrum and traumatic otitis media.”
• After the arrest, two protocols were drawn up against the lawyer: on disobedience to police officers (Article 19.3 of the Code of Administrative Offenses), as well as on organizing an uncoordinated event (part 2 of Article 20.2 of the Code of Administrative Offenses) due to the fact that he published a post about the upcoming action, and in the post it was said that the action was not approved. Under article 20.2 of the Code of Administrative Offenses, Benyash was assigned 40 hours of compulsory work, and under article 19.3 of the Code of Administrative Offenses, the lawyer was arrested for 14 days.
• On September 23, it became known that a case of violence against a representative of the authorities was brought against Benyash (part 1 of article 318 of the Criminal Code). According to the investigation, during the detention on September 9, a lawyer in a police car bit one officer on the hand, and hit another three times in the face with his elbow.
• On September 24, information appeared that a case of obstruction of justice was also initiated against Benyash (part 1 of article 294 of the Criminal Code). According to investigators, on May 6, during the meeting, the lawyer “repeatedly interrupted, gave instructions, expressed demands and objections to the decisions of the judge” and did not react to the remarks. As a result, Benyash was forcibly removed from the courtroom and removed "from further participation in the consideration of cases of administrative offenses." On the same day, as stated in the message of the Investigative Committee, the lawyer tried to enter the courtroom, and thus, according to the investigation, obstructed the administration of justice.
